AFFIDAVIT OF DESISTANCE

I, ONTO LINATOC, of legal age, Filipino, married, and residing at

Sauz Subdivision, Brgy. 4, Lipa City, after having been sworn to in
accordance with law, hereby depose and state:

1. That, I am the private complainant in Criminal Case No. 199-1041 for

Less Serious Physical Injuries against ORLAN APILAN y GOMO, which
case is pending before MTCC Branch 1, Lipa City;

2. That, I am no longer interested in the further prosecution of the

aforementioned case against the said accused as we have fully
pondered that the filing of the case was a result of misunderstanding
and misapprehension of facts;

3. That, with the execution of this affidavit I am hereby informing and

formally requesting the Honorable Court and the Office of the City
Prosecutor of Lipa City that a commensurate motion to dismiss should
come next;

4. That, this affidavit is executed freely and voluntarily and that no force,
intimidation, undue influence or duress was employed nor any
monetary consideration was promised or offered for the execution of
this affidavit;

5. That, I am executing this affidavit in order to attest to the truthfulness

of the foregoing and to tell the proper authorities concerned for
whatever legal purposes that this affidavit may serve.
