APPLICATION FOR RECTIFICATION OF ORDER DATED


12.03.2018 AS PER SECTION-39 OF RERA ACT, 2016

The complainant respectfully submits as under:-

1. That the above order dated 12.03.2018 was disposed of by


the Authority on 07.06.2018.The Applicant above named beg
to present this application for rectification of certain mistakes
which are apparent from record in the said Order.

2. That the respondent had registered the project under RERA


in the name of one of his Director’s of “Prerna Constructions
Pvt. Ltd.” i.e. ‘JITENDRA MANGLA’, whereas the
agreement has been executed between Maheshwari Sewa
Sansthan Sahkari Avas Samiti Ltd.(herein referred as Land
owner of aforesaid project) and Prerna Constructions Pvt.
Ltd. (herein referred as Developer of aforesaid project) as
first party and Applicant as second party.

3. That as per the agreement the possession of the Unit is


likely to be delivered in November 2016. After the expiry of
November 2016, when the respondent was unable to
complete the project, the applicant filed a complaint in RERA
for refund of his deposited amount vide Complaint
No.1120173626.

4. That being a lay person and having little or no knowledge of


the legal procedures, the applicant had filed an online
complaint in RERA against the project “Manglam Niket” but
as the project was registered under the promoter as
“JITENDRA MANGLA”(one of the directors of Prerna
Constructions Pvt. Ltd.), by default the complaint filing
system took the name of one of its director’s as promoter as
the project being registered in one of its director’s name only
and thus the applicant did not realized the fact that at the
time of execution of order, only one of the Director’s of
“Prerna Constructions Pvt. Ltd.” will be held liable for the
execution of order, which is a major error of law in this order
which is to be rectified.

5. That the order has been disposed by the Hon’ble Authority


07.06.2018, after the expiry of 45 days from the date of
disposal of order the applicant filed “request for execution” in
RERA against which the Hon’ble Authority issue “RC” dated
30.03.2019 against ‘JITENDRA MANGLA’
