Preliminary Investigation is an inquiry or a proceeding the purpose of

which is to determine founded belief that a crime has been committed and the
respondent is probably guilty thereof, and should be held for trial.

In the conduct of preliminary investigation, the prosecutor does not decide


whether there is evidence beyond reasonable doubt of the guilt of the
respondent. A prosecutor namely determines the existence of probable cause,
and to tile the corresponding information if he finds it to be so.

Probable cause implies the probability of guilt and requires more than bare
suspicion but less than evidence to justify a conviction.
