Adultery is not a crime now in India

य भचार (अनै तक यौन संबंध) अब भारत म जम

According to Indian laws, so far the sexual relations outside the norms of the
community of the couple with any other person was being considered as
crime. But, on 27th September 2018 the Supreme Court declared the 157-
year-old Indian Law (Section 497) as unconstitutional. Consequently, the
sexual relations outside the norms of the community of both the husband with
other women and likewise the unlawful relation of wife with other men will not
be called adultery. It clearly means that the wife as and when desires can
make a sexual relation with any other man without any consent of her
husband. In the same manner, the husband whenever wants can set up a
sexual relation with any other woman. For example, a female employee of a
company is free to go anywhere with her boss and can set up a sexual
relation with him. The boss’ wife is not eligible to raise any legal procedures
neither against the female employee nor her husband. Similarly, if a woman
wants to have sex with her family driver without her husband's consent, the
husband does not have the right to forbid.
Earlier, on 6 September 2018, the Supreme Court ruled the 158-year-old
Indian law (section 377) unconstitutional by delivering a verdict that man or
women do not commit a crime when they establish sexuality, which means,
two men or two women can marry each other. The reasons of these two
decisions are stated that the current laws are based on the ancient traditions
of India under which the woman was subject to a man. Now, it is an era of
freedom. The woman does not become husband's slave after getting married,
but she has the right to have sex with any man despite getting married.
Whether her husband and her family allow for it or not. Similarly, on the
contrary, the man also has the option to establish sexual relation with any
other woman, despite getting married.
Being both the judgments of India's Supreme Court against Indian culture and
humanity, their far-reaching dangerous consequences are being predicted by
the followers of all religions. Because after that, there will be an increase in
vulgarity, immorality, nudity and adultery, there will also be clashes/disputes in
each and every house, and divorce cases will occur more.
Deepak Mishra, the Supreme Court's Chief Justice, who is to retire after a few
days, on October 2, 2018 is giving hastily decisions on important issues, that
are being considered against Indian culture and humanity in general. If
someone requests the Chief Justice that before his retirement on October 2,
2018, he should deliver another historical decision, after that, he would be

famous not only on national level but also on global level, and it is that
menstruation of a woman every month, pregnancy of 9 nine months, passing
the woman through a condition of death struggle and dangerous phases
during childbirth, breastfeeding the child and all other works related to the
newborn, why does the woman only perform these activities alone? Instead,
these tasks should be equally balanced between both man and woman, Firstly
once a man should perform all these works, then the second time a woman
should do them. Obviously, the answer should be that this is a system of
Omnipotence/Power, so we will also clearly say that these two decisions are
also against the system of Omnipotence.
Political parties, national and religious organizations should consult Indian law
experts and raise their voices against these decisions, so that laws should be
enacted, taking the majority of Indian people into consideration, not taking into
account Europe's culture, where the parent's identity is also known by DNA.

All schools of thought of Ummate Muslima in the light of Quran & Hadith are
against these two verdicts. All Muslims though with a little knowledge of Islam
know that these are Haram and against the humanity. But it is real that these
two sins are found in the lives of some Muslims due to some reasons. Let us
know in the light of Quran & Hadith the prohibition of adultery and its causes
so that we can save our community from these two big sins.

Sexual intercourse between a man and woman without Nikah (Islamic way of
marriage) is called adultery (Zina), even if both the parties do it by mutual
consent. As a matter of fact, adultery is penetration of man’s reproductive
organ (penis) into woman’s reproductive organ (vagina) without being married
in a way as prescribed by Islam. However, other than husband and wife, it is
absolutely forbidden for any man or woman to lustfully look at the opposite
sex, indulge in conversations that are all about sexual desires, meeting all
alone, touching or kissing each other. As per the word of the leader of all the
prophets (AS), Prophet Muhammad (PBUH), all of these acts are to be
understood as a form of adultery, though the punishment for these acts is not
as severe as it is for the act of adultery.

Just like murder, oppression, lying, fraud and theft, adultery too is a major sin
which is strictly prohibited in all the major religions. Moreover, all the religions
have specified exceedingly severe punishment for those who are found guilty
of adultery. The punishment of stoning to death of the one found guilty of
adultery is not only specified in Islam but also in Christianity and Judaism.
This is such a major sin that in this world there is no other sin for which a more
severe punishment is commanded. This is so because ever since the world
came into being till the present day, all human societies have not only cursed
this major sin but also instructed their respective populations to abstain from
all kinds of deeds that could take a person closer to adultery.

Even if we look carefully at the essential nature of human being, there is a

strong case for forbidding adultery else the human being –a creature made by
Almighty Allah as the best of all the creatures– will stoop down to the level of
animals. The entire world’s safety lies in forbidding adultery and punishing its
doers in the most dreadful manner possible. If the human being –one who is
meant to rule over all the birds, cattle, beasts and other creatures made by
Almighty Allah– starts spending his worldly life only in terms of attending to his
sexual desires (satisfying or pleasing himself by mingling with whoever he
runs into), the very existence of human civilisation will become history. This is
so because in the case of a man and a woman, after the Nikah, by the word of
Almighty Allah, intercourse leads to the birth of a child. Considering the
children as their very own and source of strength and support in future, the
parents bear all the hardships and difficulties for their children, make proper
arrangements for their education and upbringing and so on. What needs to be
understood is that through all this, other get to know about the parents of the
boy or girl, something that leads to building of relations followed by building of
the larger neighbourhood. This leads to people becoming aware of their
obligations towards each other, something that contributes to the coming into
being of a full-fledged social set up. If humans too were left to themselves just
the way animals are, human civilisation would have ceased to exist and this
world would have come to end much earlier.

Islam has not only forbidden adultery. Instead, Almighty Allah has
commanded believers “not even go close to adultery. It is indeed a shameful
act, and an evil way to follow” (Surah Al-Asra’, verse no. 32). In this verse,
Almighty Allah has called adultery Faahishah (a shameful act). In Surah Al-
Inaam, verse no. 151, Almighty Allah has commanded believers to not go near
shameful acts, whether they are open or secret. In Surah Al-Aaraf, verse no.
33, Almighty Allah declares shameful acts as forbidden and says, “Say, my
Lord has prohibited only the shameful acts, whether open or secret”. In Surah
Al-Furqan, verse no. 67, describing the attributes of believers, Almighty Allah
says, “nor do they fornicate; and whoever does it, shall face the recompense
of his sin. On the Day of Judgement, the punishment for his sin will be
doubled for him, and he will remain there (in the Hell) disdained, forever.
Fawaahish and Faahishaat are used as the plural of Faahishah.

Adultery is a major sin:

I am referring to few sayings of Prophet Muhammad (PBUH) from Sahih
Bukhari, the most authentic of all the compilations of Hadith, so that, in the
times we live in, it becomes possible for us to both refraining ourselves and
saving others from committing this major sin that is spreading at an alarming
rate. Prophet Muhammad (PBUH) said, “Few of the conditions that hint at the
arrival of the Day of Resurrection are that knowledge will be lifted, ignorance
will be common, drinking of alcohol will become normal and adultery will
become widespread” (Bukhari). Prophet Muhammad (PBUH) said, “When a
person commits adultery he does not do so as a believer” (Bukhari). This

means that at the time of committing adultery, the person is deprived of

something as priceless as faith or, one of the prerequisites of faith is that the
person should not commit adultery or, the person who commits adultery is not
a true believer.

Reasons behind adultery and shameful acts:

Looking at ghairmahram (one with whom marriage is not prohibited) for no
reason: Prophet Muhammad (PBUH) said, “The adultery of the eye is the
lustful look, and the adultery of the ears is listening to bad talk, and the
adultery of the tongue is immoral speech and the adultery of the hand is to
hold something it is not allowed to hold, and the adultery of the feet is to walk
(to the place) where the person intends to commit adultery, and the heart
yearns and desires following which the reproductive organ either approves of
it or rejects its.

Talking to Ghairmahram: In the Holy Quran, Almighty Allah has ordered

women that in case they fall in need of talking to Ghairmahram men, they
should not be too soft in their speech, nor they should talk too nicely by
uttering each word in an unusually pleasing manner. Almighty Allah says, “Nor
be too suggestive in your conversation so that one who has disease in his
heart starts indulging in fancies (about you). And do speak with appropriate
words” (Surah Al-Ahzaab, verse no. 32). Although the voice of a woman is not
Satr (part or parts of the body that are to be covered in front of Ghairmahram)
–a woman can talk to a Ghairmahram if needed– it is quite difficult to deny the
fact that there is an attraction in the voice of a woman. This is the reason why
jurists have not allowed women to give call to prayer (Adhan). Prophet
Muhammad (PBUH) has strictly commanded that other than his wife, a
husband should not talk to women in a soft manner because that will develop
the woman’s interest in him (Al-Nihaayah). These days, in the age of social
media, chatting with Ghairmahram, sharing of all kinds of photographs, and
online conversations have become quite common. However, we need to
understand that it is a deadly disease. We need to try our best to keep our
children away from all these because these are the channels through which
we come across incidents that not only disgrace the immediate and extended
family but also lead to severe punishment in the Hereafter.

Late Marriage: Prophet Muhammad (PBUH) said, “O young men! Whosoever

among you has the physical and financial capacity to do so must marry at the
earliest because marriage protects our eyes and reproductive organs (from
committing wrong acts)” (Bukhari). These days, generally speaking, girls and
boys get married at an older age because finishing their education in college
and university takes a long time. However, to the extent possible, we must
make sure that the marriage of our boys and girls does not get delayed.

The intermingling of men and women who are strangers to each other:
Prophet Muhammad (PBUH) said, “When a woman steps out of her house,

the devil is on a lookout for her” (Tirmidhi). Similarly, Prophet Muhammad

(PBUH) said, “When a man and a woman (who are stranger to each other) are
in thee company of each other with no one around them, then the third person
with them is the devil, one who urges them to indulge in a sinful act” (Musnad
Ahmad). These days, in schools, colleges and universities, as a result of co-
co
education, the intermingling of men and women (who are not known to each
other) has become quite common. Moreover, with the passage of time,
women are found more and more inclined to do work. Verily, women can
acquire worldly knowledge alongside being educated in the Holy Quran and
Hadith,
dith, and, in the same manner, can also do work or business provided they
follow the guidelines outlined by Islamic Shariah with respect to these
domains. However, our experience tells us that numerous women associated
with the existing education system (followed
(followed across the globe) and workplace
are victims of sexual harassment. I do not mean to say that we should not
send our girls for higher education, or that it is forbidden for women to work.
However, what I want to emphasise is that we simply cannot neglect neg the
ground reality. This is why, to the extent possible, we must look for safe and
secure institutions for our boys and girls because no matter what, one day we
have to bid farewell to this world and account for our worldly life in front of
Almighty Allah.

समय चाहे कसी भी मAहला के साथ यौन संबंध बना सकता है । जैसे अगर
कोई मAहला कसी यि त क" कंपनी म% काय करती है तो वह औरत अपने
बॉस (कंपनी का मा3लक) के साथ जहाँ चाहे घम
ू सकती है और यौन संबंध बना
सकती है । बॉस क" प नी को अपने प त या अपने प त क" कंपनी म% काम
करने वालB औरत के @वGR क़ानन
ू ी तौर पर बोलने क" अनम
ु त नहBं है। इसी
तरह अगर कोई औरत अपने प त क" अनम
ु त के बग़ैर अपने फैमलB Tाईवर से
यौन संबंध रखना चाहती है तो प त को मना करने का अVधकार नहBं है ।
इस से पहले ६ 3सत4बर २०१८ को १५७ वष:य भारतीय क़ानन

अनै तक यौन संबंध जैसे गुनाह से पाक करने क" को3शश कर% ।

करना (Intercourse) य3भचार (िज़ना) कहलाता है, चाहे वह दोनH ओर क"
अनम
ु त से हB यH न हो। असल म% य3भचार (िज़ना) नकाह के xबना पG
ु ष
के गुyतांगH का मAहला के गुyतांगH म% *वेश (दाcख़ल) होने का नाम है, ले कन
जीवन साथी (प त व प नी) के अलावा कसी भी पG
ु ष और मAहला एक दस
ू रे
को काम-वासना क" नज़र से दे खना, एक दस
ू रे से कामक
ु (से सी) बातचीत
करना, या एक दस
ू रे का अकेले म% 3मलना, या एक दस
ू रे को छूना या चंब
ु न
लेना भी ^राम है । इन सब कायF को सारे नxबयH के सरदार ^ुज़रू -ए-अकरम
स`ल`लाहु अलैAह व स`लम ने य3भचार (िज़ना) क" एक क़aम क़रार Aदया
है , हालां क इन कायF क" वे कठोर सज़ा नहBं है जो अvल य3भचार (िज़ना)
क" है ।
क़ ल, ज़ु`म, झठ
ू , धोखाधड़ी और चोरB क" तरह य3भचार (िज़ना) भी एक ऐसा
घनौना अपराध है क सभी धम म% न 3सफ सzती के इस घनौने अपराध से
साथ मना कया गया है , बि`क य3भचार करने वाले मद और औरत के 3लए
कठोर से कठोर सज़ा भी नधा]रत क" गई है । न केवल इaलाम म% बि`क इसाई
और यहूदB धम म% भी इस घनौने अपराध के अपराVधयH क" सज़ा रजम
(प थरबाज़ी) है। यह ऐसा जुम है क द ु नया म% इस से iयादा बड़ी सज़ा कसी
दस
ू रे जुम क" नधा]रत नहBं क" गई, यंू क द ु नया के अिaत व (वज
ु ूद) से
लेकर आज तक सभी मानव समाज ने इस अपराध पर न केवल लानत भेजी
है , बि`क ऐसे कायF से बचने क" 3श{ा (तालBम) भी दB है, जो य3भचार
(िज़ना) क" तरफ़ ले जाने वाले हH।
इंसानी *कृ त ( फ़|रत) भी खुद य3भचार (िज़ना) क" ^ुरमत क" मांग करती
है , अ0यथा इ0सान िजसे अ`लाह तआला ने अशरफ़-उल-मख़लक़ ू ात बनाया है
वह जानवरH क" लाइन म% खड़ा हो जाएगा। द ु नया क" सलामती भी इसी म% है
क य3भचार (िज़ना) को ^राम क़रार Aदया जाए और इसके अपराVधयH को
इबरतनाक सज़ा दB जाए, सभी प}{यH, च]र0दH, पशओ
ु ं और अ`लाह के अ0य
*ाcणयH पर शासन करने वाले हज़रत इ0सान केवल से स को परू ा करने के

3लए इस सांसा]रक जीवन को xबताने लगे क जब चाहा और िजस से चाहा

आनंद 3लया तो मानव स~यता हB समाyत हो जाएगा, यंू क मद और औरत
म% नका^ के काय (अमल) के बाद के प]रणाम (नतीजे) म% अ`लाह के ^ु म से
संतान (औलाद) पैदा होती, माँ बाप उसे अपनी औलाद और भ@वmय का सहारा
समझ कर उनके 3लए सभी समaयाओं और परे शा नयH का सामना करते ह[,
उनक" 3श{ा (तालBम) और *3श{ण (तरxबयत) का इि0तज़ाम करते ह[, साथ हB
दस
ू रH को यह पता चलता है क यह कसका ब.चा या ब.ची है तो ]रoतेदरB
बनती है और पड़ोस बनता है िजस से एक दस ू रे के अVधकार (^ूक़ूक़) मालम
ू
होते ह[ िजसक" वजह से एक समाज बनता है , अगर इंसानH को भी जानवरH क"
तरह आज़ाद छोड़ Aदया जाता तो मानव स~यता समाyत होकर यह द ु नया
बहुत पहले हB ख़ म हो चक
ु " होती।
इaलाम ने केवल य3भचार (िज़ना) को ^राम हB क़रार नहBं Aदया बि`क अ`लाह
तआला ने आदे श (^ु म) Aदया क य3भचार (िज़ना) के पास भी न जाओ। वह
निoचत •प से बड़ी बे^याई है और बेराह रवी है । (सरू ह-ए-इसरा: ३२), इस
आयत म% अ`लाह तआला ने य3भचार (िज़ना) को फ़ाA^शह (बे^याई) क़रार
Aदया है। (सरू ह-अल-अनाम: १५१) म% अ`लाह तआला ने फ़रमाया क बे^याई
(फ़वाA^श) के कामH के पास भी न जाओ, चाहे वह बे^याई खुलB हुई हो या
छुपी हुई। (सरू ह-अल-आराफ़: ३३) म% फ़वाA^श (बे^याई) के कामH को ^राम
क़रार दे कर इरशाद फ़रमाता है, “कह दो क मेरे रब ने तो बे^याई के कामH को
^राम क़रार Aदया है , चाहे वह बे^याई खल
ु B हुई हो या छुपी हुई”। (सरू ह-अल-
फ़ुरक़ान: ६७) म% ईमान वालH क" @वशेषताओं को बयान करते हुए अ`लाह
तआला इरशाद फ़रमाता है , “और वह न िज़ना ( य3भचार) करते ह[, जो शzv
( यि त) भी यह काम करे गा उसे अपने गुनाह (जुम) के बवाल का सामना
करना पड़ेगा, क़यामत के Aदन उसका अज़ाब (सज़ा) बढ़ाकर दोगुना कर Aदया
जाएगा और वह ज़लBल होकर उस अज़ाब (सज़ा) म% हमेशा हमेशा रहे गा”।
िज़ना ( य भचार) और अ!ल लता के कारण:
नाम&रम को बेवजह दे खना:
^ुज़रू -ए-अकरम स`ल`लाहु अलैAह व स`लम ने इरशाद फ़रमाया क आँखH का
“िज़ना ”बदनज़रB है और कानH का “िज़ना” गलत बात सन ु ना है और ज़बान

“िज़ना” गलत बात बोलना है और हाथ का “िज़ना” गलत चीज़ को पकड़ना है

ग़ैरम&रम से बात करना:
अ`लाह तआला ने क़ुरान-ए-करBम म% औरतH को ^ु म Aदया क अगर उ0ह%
कसी ग़ैरम^रम से बात करने क" ज़•रत पेश आए तो अपनी आवाज़ म% लोच
और नरमी पैदा न होने द% और न हB अ`फ़ाज़ (शƒदH) को बना संवार कर बात%
कर% । इरशाद-ए-बारB है : “और न हB चबाकर बात% करो क िजसके Aदल म% रोग
(बीमारB) हो वह तम0ना (आकां{ा) करने लगे और तुम माक़ूल (उVचत) बात
करो”। (सरु ह अल-अ^ज़ाब: ४) औरत क" आवाज़ ^ालां क सतर (छुपाने क"
चीज़) नहBं है, या न ज़•रत के मत
ु ाxबक़ औरत ग़ैरम^रम से बात कर सकती है,
मगर इस ^क़"क़त का इंकार नहBं कया जा सकता क अ`लाह तआला ने
फ|रB तौर (aवाभा@वक •प) से औरत क" आवाज म% क3शश (आकषन) रखी है ,
इसी3लए औरत को फ़ु„हा ने अज़ान दे ने से मना कया है। नबी-ए-अकरम
स`ल`लाहु अलैAह व स`लम ने इस बात से मना कया है मद (प त) अपनी

ू रB औरत के सामने नरमी से बातचीत करे िजस से
औरत को मद म% GVच पैदा हो जाए, (अल- नहाया)। इन AदनH सोशल मी…डया
के ज़माने म% ग़ैरम^रमH से चेAटंग करना, कई तर^ क" तaवीर% शेयर करना और
ऑनलाइन बातचीत करना काफ" आम हो गया, ले कन यह बहुत ख़तरनाक
बीमारB है, इस से अपने ब.चH और बि.चयH को जहाँ तक हो सके म^फ़ूज़
रखने क" को3शश करना बहुत ज़•रB है , यंू क यहB वह राaत% ह[ िजनके ज़]रए
ऐसी घटनाएं घटती ह[ िजनसे न 3सफ़ घर और ख़ानदान क" बदनामी होती है ,
