Is the party who has received [2+2+2 some benefit under a void contract bound to restore it to the other party? State the difference between void agreement and void contract. b) Discuss various modes of discharging a contract? Mr. Ram, a merchant, of Gujarat made a contract to dispatch [3+3+4. 100 tons of gur to Ms. Lal at Delhi at a certain price and the latter paid Rs. 20,000 as earnest money. None of the parties knew that the government had, sometimes previously, passed a law prohibiting transport of gur from one State to another. Mr. Ram was unable, by reason of this law, to send the gur. Ms. Lal claims damages for non-performance as well as refund of the earnest money. Will she be entitled to these remedies? Can she also claim damages? Give reasons and cite appropriate case laws. 4. Discuss various types of misrepresentations? Promissory Estoppel 6. Aston company delivers to Boston movers, a common carrier, [10] to transport a machine, without delay to Aston company's factory. Aston company has informed Boston movers that its factory is stopped for want of the machine. Boston company unreasonably delays the delivery of the machine and because of that Aston company loses a profitable contract with Pepsi Foods. How [3+3+4 damages are assessed in contract? Patia Farmer's Association (PFA) offered Basmati Rice for [10] sale to Great Bazar (GB) but GB made it clear to PFA that they only want Basmati Rice which have been harvested without the use of any pesticide and would discard any supply from PFA if found pesticide or other related chemical contamination. PFA assured that while growing and harvesting Basmati Rice they have not used any pesticides. GB ultimately purchased PFA’s entire growth. After the delivery of the Rice GB rejected the goods on the grounds that Rice is contaminated with pesticides. PFA sued GB for price.
