Mr. Ram, a merchant, of Gujarat made a contract to dispatch [3+3+4. 100 tons of gur to Ms. Lal at Delhi at a certain price and the latter paid Rs. 20,000 as earnest money. None of the parties knew that the government had, sometimes previously, passed a law prohibiting transport of gur from one State to another. Mr. Ram was unable, by reason of this law, to send the gur. Ms. Lal claims damages for non-performance as well as refund of the earnest money. Will she be entitled to these remedies? PFA assured that while growing and harvesting Basmati Rice they have not used any pesticides. GB ultimately purchased PFA’s entire growth. After the delivery of the Rice GB rejected the goods on the grounds that Rice is contaminated with pesticides. PFA sued GB for price.
