FOREWORD

1 PURPOSE : This Staff Instruction prescribes responsibilities, policies,


and procedures to be used by the Directorate General of
Civil Aviation (DGCA) for the development and
amendment of Civil Aviation Safety Regulations (CASR),
Staff Instructions (SI) and Advisory Circulars (AC) within
each Directorate’s area of responsibility. This Staff
Instruction may be made available to the public so that
they may better understand the authority and
responsibility of the DGCA.

2. REFERENCES : This Staff Instruction should be used in accordance with


the applicable regulations.

3. CANCELLATION : Staff Instruction Number SI PUB-001 original issue,


issued on 30 October 2000 is cancelled.

4. AMENDMENT : The amendment of this Staff Instruction shall be approved


by the Director General of Civil Aviation.

CHAPTER I GENERAL

1. Purpose

This Staff Instruction prescribes responsibilities, policies, and procedures to be


used by the Directorate General of Civil Aviation (DGCA) for the development
and amendment of Civil Aviation Safety Regulations (CASR), Staff Instructions
(SI) and Advisory Circulars (AC) within each Directorate's area of responsibility.

2. Definitions

For the purpose of this Staff Instruction, the term –

Reference Documents means ICAO Annexes and its associated relevant


Documents, US Federal Aviation Regulations and its associated relevant
guidance materials, and civil aviation regulations and its associated relevant
guidance materials of other civil aviation authority of ICAO signatory nations.

Amendment means any change to, addition or deletion of any information, after
the date the original CASR was signed by Minister of Transportation, or the
original Staff Instruction or Advisory Circular was signed by the Director General
of Civil Aviation.

3. Regulatory References

The Aviation Act directs that certain articles of the Act relating to aviation
products and services, will be further regulated by government regulations. The
Minister of Transportation (MOT) is responsible for the enactment of such
regulations, known as the Civil Aviation Safety Regulations (CASR).

In accordance with the Act on Aviation, as a member of ICAO, the Government of


Indonesia declares that, “It’s Annexes and it’s and its associated relevant
Documents, and other related international conventions, are the provisions that
shall be complied while considering the national interest”.

Minister of Transportation Decree on the Organization and Work Procedures of


Ministry of Transportation delegates to the Director General of Civil Aviation
(DGCA) the authority to implement CASR. The DGCA is also delegated the
authority to develop, enact and publish, policies and procedures relating to that
responsibility.

4. Policy

The Republic of Indonesia as a member state of ICAO has signed the Convention
on International Civil Aviation and pledged to adhere to this Convention.

Therefore in the development of CASR, the DGCA shall, as long as it is


practicable and with the considerations of aviation safety, efficiency, viability and

the public interests, be in compliance with ICAO Annexes and its associated
relevant Documents.

For practical purposes, the DGCA has elected to adapt Federal Aviation
Regulations (FAR), as a primary model for the numbering system, the content,
and the format of writing. In term of the content, the DGCA has also elected to
adapt regulatory and policy documents and instruments of other foreign ICAO
signatory nations where it is more appropriate to Indonesia. None of these other
national civil aviation authority documents however, shall be considered
controlling.

5. Applicability

This Staff Instruction establish the procedures for the development and
amendment of CASR, Staff Instructions and Advisory Circulars with respect to:

a. Indonesian designed, manufactured and/or Indonesian registered aircraft, and


aircraft engines, propellers and appliances fitted to those aircraft,

b. Personnel licensing,
c. Aviation training schools,
d. All private or commercial operations of aircraft registered in Indonesia or
operating within Indonesian airspace,
e. Operation of aerodrome, air navigation facility, service, or product relating to
the matter of aviation, and
f. Internal issue within the DGCA such as human resources and general affairs.

CHAPTER II DEVELOPMENT AND AMENDMENT OF CIVIL AVIATION SAFETY


REGULATIONS

1. Adherence to FAR format, content and numbering system

a. The CASR should parallel the FAR issued by the FAA in format, content and
numbering as closely as practicable, except:

1) Where a FAR, or part thereof, is not in compliance with the Act on


Aviation, or, not in agreement with an ICAO Standard and its associated
relevant Documents and such difference is not approved by the MOT or
his delegate,

2) For the purpose of consolidating, editing, adding or excluding information


or standards,

3) Where changes are necessary to more accurately serve the interests and
needs of Indonesia as outlined in Chapter I paragraphs 2 and 3, and

4) Where international harmonization of a standard, is considered prudent.

In order to facilitate easy and accurate cross reference to the FARs, each
CASR will contain a cross reference table which will illustrate where a
particular section of a FAR or other publication is different with or located in
the CASR. There is no requirement to justify differences other than with the
ICAO Annexes, where the procedures for the notification of differences are
contained in Staff Instruction SI LEG-02.

b. Unless valid reasons exist to the contrary, all revisions to the Airworthiness
Standards of the Federal Aviation Regulations will be made mandatory by
issuing a revision to the CASR . If a revision is not issued, the justification
must be endorsed by the DGCA. Airworthiness Standards include CASR
Parts 23, 25, 27, 29, 31, 33 and 35.

c. Each regulations relating to other than Airworthiness Standards, such as


aircraft operations, aerodrome and air navigation facility will be reviewed in
detail as published in the reference documents established in paragraph
4 of Chapter I. A determination will be made as to the extent they will be
incorporated as a standard into the CASR’s, and which document provides
the most appropriate legal intent.

2. Procedures: Receiving, Distribution and Evaluation of Reference


Documents

a. Receiving Reference Documents

For the purpose of meeting the policy as described on paragraph 4 of Chapter


I, the Administration Section of each respective Directorate is responsible for

obtaining and ensuring that at least ICAO Annexes and its associated
relevant Documents, and US Federal Aviation Regulations and its associated
relevant guidance materials, within the area of its responsibility used for
drafting or revising a CASR, are maintained in the technical library and are
current. Where a reference document has been published on a web site or is
otherwise published in an electronic form, ability or possession of right to
access this site or ability to obtain and to maintain current published
electronic form is considered an acceptable method of maintaining currency.

b. Distribution of reference documents

The original will be maintained in the library. Copies of the document or


formal amendments thereto, will be forwarded within seven (7) working days
after receipt to each Sub Directorate where copies of the reference
documents are being maintained. Immediately after receipt of the documents,
appointed person for that Sub Directorate will amend their copy of the
document and will log the change into the Record of Amendments.

c. Evaluation

Immediately after receipt of the document, the Deputy Director of the


responsible Sub Directorate for the development and amendment of CASR,
Staff Instruction and Advisory Circulars, will assign it to an inspector/specialist
for evaluation and preparation of the draft CASR if deemed necessary. The
assigned inspector/specialist will review the reference document in detail and
determine if a new CASR or amendment to the CASR is appropriate. The
inspector/specialist may consult with others in the Sub Directorate or other
Sub Directorates relevant with the scope of responsibilities of that Sub
Directorate based on the subject matter being reviewed in this evaluation
process. If a corresponding CASR or CASR amendment is not issued, the
justification must be endorsed by the Director of each respective Directorate.

d. Other foreign documents

From time to time the DGCA will receive regulations or standards issued by a
foreign civil aviation authority other than the FAA. These regulations and
amendments when received by the DGCA will be processed by the same
procedure as described in Sub Paragraphs a. to c. of this Paragraph.

3. Procedures: Process for Initial Development of a New CASR

The development and implementation of an initial CASR will take place in 8


phases.

a. Determination of a need for a CASR.

When, based on the evaluation on paragraph 2.c., the determination is made


that a new safety regulation or an amendment thereto is needed, each
respective Director will issue an instruction to develop a new or to amend a
CASR to the Sub Directorate responsible for the development and
amendment of CASR, Staff Instruction and Advisory Circulars.

b. Assignment of development inspector/specialist

The Deputy Director for Sub Directorate responsible for the development and
amendment of CASR, Staff Instruction and Advisory Circulars, will assign an
inspector/specialist from his Sub Directorate to act as the CASR development
team leader. Where, due to the subject matter, require more than one Sub
Directorate to be involved, at least a team member from each Sub
Directorate will be assigned. The responsible Deputy Director will determine
who the development inspector/specialist will be. The development
inspector/specialist team leader shall establish a regulation working file which
will contain all relevant information supporting the regulation, including:

1) Copies of relevant FAR or foreign regulations, -

2) Copies of pertinent meeting minutes,

3) Copies of relevant correspondence including all discrepancy lists,

4) Copies of pertinent comments addressing all discrepancies,

5) Records of any significant spoken communication,

6) All drafts of the CASR,

7) Any other information deemed significant by the development team,

The file will be organized in chronological order to enable quick access to any
particular piece of information. This file contains supporting documentation for
the regulation and is intended to be the primary reference if information is
required regarding the CASR at a later date.

c. Review of the related Articles in the Act on Aviation and appropriate reference
documents.

A complete review of all reference documents will be undertaken and the


standards contained in these documents will be compared to the Act on
Aviation and the ICAO Annexes and its associated relevant Documents. All
proposed regulations must be in accordance with the Act on Aviation and any
differences to the ICAO documents must be recorded. The suitability and
precise wording of any regulation shall be determined in accordance with
paragraph I of this chapter.

d. Preparation of Initial draft.

Preparation of the initial draft/s will be the responsibility of the development


team under the supervision of each respective Head of Section of Sub
Directorate responsible for the development and amendment of CASR, Staff
Instruction and Advisory Circulars of each respective Directorate, and will be
based upon the following criteria:

1) The language must be uncomplicated and easy to understand, yet use


clear and concise statements that meet legal language criteria,

2) All statements must be translatable into Bahasa Indonesia without loss of


legal intent,

3) All regulations relating to a specific subject, must be located in the subpart


designated for that particular subject,

4) All areas of the regulations must ultimately ensure aviation safety and be
appropriately enforceable, and

5) All regulations must serve the social and economic needs of Indonesia
and affirm the principles of the Act on Aviation.

In addition to the above criteria the actual document layout and numbering
must be in accordance with paragraph 6 of this Chapter. The Team Leader is
also responsible for coordinating the draft with other inspector/specialists in the
Sub Directorate and with other relevant Sub Directorates. This co-ordination
may include meetings and discussions to insure that the draft is developed as
complete as possible. Two versions will normally be prepared one in Bahasa
Indonesia and the other in English. Each version will have a cover page as
shown in Appendix A and B, of this Staff Instruction.

e. Review and evaluation of initial draft.

All draft CASRs must receive a proof reading and evaluation to ensure they
are:

1) in accordance with Paragraph 3. d. above,

2) not changed in legal intent during translation, and

3) properly edited for typographical and grammatical errors.

The evaluation person or persons must have sufficient subject knowledge to


ensure they will be capable of identifying irregularities and prepare a list of all
discrepancies identified by them. This list of discrepancies will be forwarded
to the development team for their consideration and corrective action. During
this phase the legal office will be available to provide legal consultation.

f. Preparation of the final draft.

After appropriate consultation and discussion, the final draft will be generated
incorporating all required corrections.

g. Review and recommendation of the final draft.

Under the signature/s of Deputy Director responsible for the development


and amendment of CASR, Staff Instruction and Advisory Circulars, the final
draft will be presented to each respective Director for his acceptance. When
the Director is satisfied that the draft CASR meets the requirements of this
Staff Instruction, he will forward it under signature, to the DGCA
recommending it for approval. The DGCA presents the proposed regulations
to the Minister of Transportation for his signature.

h. Document enabling and effective date.

The document shall be considered enabled on the date it is signed by the


Minister of Transportation. The effective date however, is established by the
DGCA. After discussions with the responsible Directorate, the DGCA will
determine the appropriate schedule of implementation and the final
compliance date, giving consideration for staggered compliance dates of
specific Sections. Full compliance is required on or before the implementation
date or dates specified by the DGCA.

4. Procedures : Issuance and Distribution

a. The Sub Directorate responsible for the development and amendment of


CASR, Staff Instruction and Advisory Circulars of each respective Directorate,
is responsible for insuring that each CASR is processed at the appropriate
government level in accordance with article 3.g.

b. After the CASR has become enabled and the DGCA has established the
effective date/s, the Administration Section will publish the electronic copy of
the CASR, and both the DGCA employees and the public can assess it
through Ministry of Transport web : http//www.dephub.go.id.

c. A summary of all CASRs will be prepared by the Sub Directorate responsible


for the development and amendment of CASR, Staff Instruction and Advisory
Circulars of each respective Directorate, and will be published annually under
a ‘DGCA CASR Index’ in an Advisory Circular “Status of Civil Aviation Safety
Regulations, Staff Instructions and Advisory Circulars”. The information in the
summary will consist of CASR number, title, date issued or amended,
effective date and amendment level.

5. Supplementary Procedures for Initial Development of CASR

Where deemed appropriate the procedures above may be supplemented by the


DGCA to ensure the best quality safety regulations are being introduced into the
aviation community. Such changes may make provision for the utilization of
outside resources such as national or international consultants or other service
providers. Or prior to final draft, the DGCA may elect to distribute copies of a draft
to interested segments of industry for feedback purposes.

6. Procedure: Editorial and Layout Criteria

a. Subject and numbering system.

The CASR’s will follow the same subject and numbering system as used in
the FAR’S. For example, “CASR Part 21 - Certification- Procedures for
Products and Parts,” is the same as “FAR Part 21 Certification Procedures for
Products and Parts.”

b. Paper size and margins.

The paper used must be A4 (210 x 297 cm), with the following margins:

Top : 2,5 cm
Bottom : 3,5 cm
Left : 2,5cm
Right : 2,0 cm
Gutter : 0 cm
Header : 1,27 cm
Footer : 1,27 cm

c. Paragraph.

Alignment : Justified
Indentation : Left 0.63 cm, right 0cm
Special : Hanging by 0,63cm
Line spacing : Single
Tabs : 0.63 cm

d. Font.

Arial, 12 point font shall be used.

e. Text identification.

Within the text of the CASR, each separate paragraph, and subparagraph
must be designated using letters and number, following the same system
used in the FAR. Using odd numbers for Parts and main paragraph headings.
The following designations must be used:

Level 1: Subpart followed by a letter: Subpart A, Subpart B, etc.


Level 2: CASR Part number followed by number: xx.1, xx.3, xx.5, etc.
Level 3: a., b., c., etc.
Level 4:1., 2., 3., etc.
Level 5: a), b), c), etc.
Level 6:1), 2), 3), etc.

Such designations facilitate reference to individual instruction for compliance,


record keeping and amendment purposes. If a FAR paragraph or
subparagraph is not included in the CASR, the same identification will be
used and the text will be marked “Reserved.”

Where a CASR does not meet the above criteria, a table of cross-reference
must be developed. This table must have sufficient information to
demonstrate the interrelationship of the CASR to the same FAR. Where the
information contained in a CASR is extracted from other documents that
document must also be identified.

7. Procedure: Amendment of CASR

a. Responsibility.

The Sub Directorate responsible for the development and amendment of


CASR, Staff Instruction and Advisory Circulars of each respective Directorate,
is responsible for tracking CASR to insure that they are current and are being
issued and amended promptly as the necessity arise.

b. Necessity.

The necessity to amend a CASR will be determined through a number of


detection methods. The most common are described below.

1) Amendment of a reference document.


At regular intervals and/or immediately after receiving amendment to a
reference document, the Sub Directorate responsible for the
development and amendment of CASR, Staff Instruction and Advisory
Circulars of each respective Directorate, will meet to review the
reference documents related to each Directorate responsibility, to
determine the importance of any stale dated information which may be in
the current CASRs. After each review a report will be sent to each
respective Director stating whether or not an amendment is considered
necessary at that time.

2) Ongoing surveillance of the aviation community.


During the certification, surveillance, inspection, auditing, or other safety
oversight activities as carried out by the DGCA inspectors/engineers,
regulatory deficiencies may be detected. Any DGCA inspector/engineer
detecting such deficiencies must make an appropriate report to his/her
Deputy Director who will further repot it to the Director. The Director then
will dispose the report to the Deputy Director responsible for the
development and amendment of CASR, Staff Instruction and Advisory
Circulars. This report will be filed in the Regulations Co-ordination Book
and the appropriate action will be determined during the review process
described in (1) above.

3) Aviation occurrences, accidents or incidents.


During the investigation of aviation occurrences, it may be determined
that a regulatory deficiency could be a contributing factor. Any report
received as the result of such investigation will be cause for an immediate
review meeting as described in number (1) above.

4) Industry presentation.

From time to time the industry may detect a deficiency in a regulation.


Where the industry makes a presentation it will be entered into the
regulation co-ordination book and be discussed as described in number
(1) of this paragraph.

c. Deliberation.

Each review meeting will result in the deliberation of the Sub Directorate
responsible for the development and amendment of CASR, Staff Instruction
and Advisory Circulars. The deliberation must result in the aviation activity in
question, being rated as; under regulated, over regulated, appropriately
regulated, or not applicable. The assigned priority and timetable for
amendment should also be determined at this meeting.

d. Amendment.

When an amendment has been ordered by each respective Director, the


procedures described for development of an initial CASR in paragraph 3 of
this chapter, will be followed as applicable to the development of the
proposed amendment.

CHAPTER III PROCEDURE FOR DEVELOPING STAFF INSTRUCTIONS

1. Adherence to FAA Orders format, content and numbering system

a. Staff Instructions issued by the DGCA should parallel with Orders issued by
the FAA as closely as practicable but the same considerations laid down in
paragraph 1 of Chapter II should be complied with.

b. All relevant FAA Orders will be reviewed to determine if they will be


developed as DGCA Staff Instructions. Indonesian Law and circumstances in
the country will be considered during this evaluation.

c. If a circumstance exists that requires the DGCA to issue a Staff Instruction


and a corresponding FAA Order has not been issued, the DGCA will develop
a unique Staff Instruction.

2. Procedure: Receiving, Distribution and Evaluation of FAA Orders

Similar procedure for receiving, distribution and evaluation of Reference


Document as described in Chapter II paragraph 2 apply to this paragraph.

3. Procedure: Receiving, Distribution and Evaluation of Foreign Guidance


Materials other than that Issued by the FAA

Similar procedure for receiving, distribution and evaluation of Reference


Document as described in Chapter II paragraph 2 apply to this paragraph. In
addition, the following should be observed:

a. If a Staff Instruction exists or is being prepared covering the same subject, no


further action should normally be necessary. If the foreign guidance material
provides additional or preferred methodology, a decision may be made to
amend the existing Staff Instruction to incorporate the additional information.
A Staff Instruction may also incorporate a guidance material or sample
manual as an appendix to the DGCA Staff Instruction.

b. If a final or draft DGCA Staff Instruction does not exist, the inspector/specialist
will contact the FAA or search the FAA website and determine if the FAA has
an existing Order or is developing an FAA Order on the same subject.

c. If an FAA Order or other FAA policy exists or is being developed, the DGCA
Staff Instruction should be based upon the FAA Order or policy, subject to
paragraph 1.a. and 1.b. above.

d. If an FAA Order or policy does not exist or is not being developed, the
specialist will determine if a DGCA Staff Instruction should be developed.

4. Procedure: Process for Initial Development of a New Staff Instruction

a. Determination of a need for a Staff Instruction.

1) Similar procedure of determination of a need for a CASR as described in


Chapter II paragraph 3.a. apply to this paragraph.

2) There will be occasions when the issuance of a DGCA Staff Instruction is


necessary and equivalent guidance material has not been issued by any
foreign civil aviation authority. The DGCA employees as well as members
of the public can identify the need for Staff Instructions.

b. Assignment of development inspector/specialist.

Similar procedure for the assignment of development inspector/specialist as


described in Chapter II paragraph 3. b. apply to this paragraph.

c. Preparation of Initial draft.

Preparation of the initial draft/s will be the responsibility of the development


team under the supervision of each respective Head of Section of Sub
Directorate responsible for the development and amendment of CASR, Staff
Instruction and Advisory Circulars. Similar to the preparation for the CASR,
the language must be uncomplicated and easy to understand, yet use clear
and concise statements that meet legal language criteria.

In addition to the above, the actual document layout and numbering must be in
accordance with paragraph 6 of this Chapter. The Team Leader is also
responsible for coordinating the draft with other inspector/specialists in the Sub
Directorate and with other relevant Sub Directorates. This co-ordination may
include meetings and discussions to insure that the draft is developed as
complete as possible. Two versions will normally be prepared one in Bahasa
Indonesia and the other in English. Each version will have a cover page as
shown in Appendix C and D, of this Staff Instruction.

d. Review and evaluation of initial draft.

All draft Staff Instruction must receive a proof reading and evaluation to
ensure they are:

1) In accordance with Paragraph c. above,

2) Not changed in legal intent during translation, and

3) Properly edited for typographical and grammatical errors.

The evaluation person or persons must have sufficient subject knowledge to


ensure they will be capable of identifying irregularities and prepare a list of all
discrepancies identified by them. This list of discrepancies will be forwarded
to the development team for their consideration and corrective action. During
this phase the legal office will be available to provide legal consultation.

e. Preparation of the final draft.

After appropriate consultation and discussion, the final draft will be generated
incorporating all required corrections.

f. Review and recommendation of the final draft.

Under the signature/s of Deputy Director responsible for the development and
amendment of CASR, Staff Instruction and Advisory Circulars of each
respective Directorate, the final draft will be presented to each respective
Director for his acceptance. When the Director is satisfied that the draft Staff
Instruction meets the requirements of this Staff Instruction, he will forward it
under signature, to the DGCA recommending it for approval.

g. Document effective date.

The document shall be considered effective on the date it is signed by the


Director General of Civil Aviation.

5. Procedure: Issuance and Distribution

a. The Sub Directorate responsible for the development and amendment of


CASR, Staff Instruction and Advisory Circulars of each respective Directorate,
is responsible for insuring that each Staff Instruction is processed at the
appropriate government level in accordance with article 4.f.

b. After issuance, the Administration Section will publish the electronic copy of
the Staff Instructions, and both the DGCA employees and the public can
assess it through Ministry of Transport web : http//www.dephub.go.id.

c. A summary of all Staff Instructions will be prepared by the Sub Directorate


responsible for the development and amendment of CASR, Staff Instruction
and Advisory Circulars of each respective Directorate, and will be published
annually under a ‘DGCA Staff Instruction Index’ as a part of content of
Advisory Circular “Status of Civil Aviation Safety Regulations, Staff
Instructions and Advisory Circulars”. The information in the summary will
consist of Staff Instruction number, title, date issued, effective date and
amendment level.

6. Procedure: Editorial and Layout Criteria

a. Subject and numbering system.

The Sub Directorate responsible for the development and amendment of


CASR, Staff Instruction and Advisory Circulars of each respective Directorate,
will establish and control the number and the subject line of each Staff
Instruction. DGCA Staff Instructions generally will follow the same subject and
numbering system as used for DGCA Advisory Circulars. For example, the
letters “SI” followed by the CASR Part number followed by a specific number,
separated by a dash. For subject concerning internal issues, the letter “SI” will

be followed by subject acronym for example “HRD” for Human Resource


Development or with abbreviation easily associated with the subject for
example “PUB” for Publications, followed by a specific number, separated by
“dash”.

b. Paper size and margins.

The paper used must be A4 (210 x 297 cm), with the following margins:

Bottom : 3,5 cm
Left : 2,5 cm
Right : 2,0 cm
Gutter : 0 cm
Header : 1,27 cm

subparagraph must be designated using letters and number, following the
same system used by the FAA. The following designations must be used:

Chapter : I., II., Ill., etc.


Level 1 : Number each major paragraph: 1., 2., 3.,.etc.
Level 2 : a., b., c., etc.
Level 3 : 1), 2), 3), etc.
Level 4 : a), b), c), etc.
Level 5 : i., ii., iii., etc.

Such designations facilitate reference to individual instructions.

7. Procedure: Amendment of Staff Instructions

a. Responsibility.

The Sub Directorate responsible for the development and amendment of


CASR, Staff Instruction and Advisory Circulars of each respective Directorate,
is responsible for tracking Staff Instructions to insure that they are current and
are being issued and amended promptly as the necessity arise.

b. Necessity.

The necessity to amend an Staff Instruction will be determined through a


number of detection methods. The most common are described below.

1) Amendment of a related CASR or a related reference document.

Any time a CASR or a related reference document is amended, the Sub


Directorate responsible for the development and amendment of CASR,
Staff Instruction and Advisory Circulars of each respective Directorate,
shall review its impact on the need of amendment to the Staff Instruction.

2) Change to the DGCA structural organization or nomenclature of the


organization.

Change to the DGCA structural organization or nomenclature of the


organization may need amendment to the Staff Instruction.

c. Amendment.

When an amendment has been ordered by each respective Director, the


procedures described for development of an initial Staff Instruction of this
chapter, will be followed as applicable to the development of the proposed
amendment.

CHAPTER IV PROCEDURE FOR DEVELOPING ADVISORY CIRCULARS

1. Adherence to FAA Advisory Circulars format, content and numbering


system

a. Advisory Circulars issued by the DGCA should parallel Advisory Circulars


issued by the FAA as closely as practicable, but the same considerations laid
down in paragraph 1 of Chapter II should be complied with.

b. All relevant FAA Advisory Circulars will be reviewed to determine if they will
be developed as DGCA Advisory Circulars. Indonesian Law and
circumstances in the country will be considered during this evaluation.

c. If a circumstance exists that requires the DGCA to issue advisory material


and a corresponding FAA Advisory Circular has not been issued, the DGCA
will develop a unique Advisory Circular.

2. Procedure: Receiving, Distribution and Evaluation of Advisory Circulars


Issued by the FAA

Similar procedure for receiving, distribution and evaluation of Reference


Document as described in Chapter II paragraph 2 apply to this paragraph.

3. Procedure: Receiving, Distribution and Evaluation of Foreign Advisory


Material (AC’s) other than that Issued by the FAA

Similar procedure for receiving, distribution and evaluation of Reference


Document as described in Chapter II paragraph 2 apply to this paragraph. In
addition, the following should be observed:

a. If a Advisory Circular exists or is being prepared covering the same subject,


no further action should normally be necessary. If the foreign guidance

CHAPTER V DOCUMENT FORMAT, TEXT, AND STYLE

1. Drafting

The most important concept in drafting regulations or advisory material is to say


exactly what is meant, and say it clearly, concisely and accurately. Start out by
making sure that the terms used are consistent with the definitions of these terms
in the CASR. Give instructions in logical order. Use short sentences. Use
technical terms when they are necessary, but do not complicate simple
instructions by overusing them. Do not repeat instructions for emphasis. Have
someone else unfamiliar with the subject matter read the draft to see whether the
message is getting across clearly. In developing a Sub Part to deal with a certain
subject, all of the information relating to that subject should be contained in that
sub part. This will keep cross referencing and the need to search the entire
regulation for additional information down to a minimum. Make the document as
user friendly as possible.

2. Active Voice

Write regulations using the active voice. Regulations and advisory material
should “speak” to the person doing the work, telling them what is to be
accomplished. In general, the strongest writing uses verbs, and the strongest
verbs are those in active voice. Avoid using passive voice. Examples:

Do not use the passive: Use the active:

“The attach bolts shall be inspected every...” “Inspect the attach bolts every...”

3. Word Selection

a. Consistency.

Use the same word each time to refer to the same item or action. Do not use
synonymous terms for the sake of variety; such use only leads to
unnecessary confusion. Conversely, never use the same term to refer to two
different things.

b. Specificity.
Use specific terms -- do not use “aircraft” (unless it is in the name of
something) when a more specific term, such as “airplane”, “gyroplane”, or
“helicopter” is more accurate.

c. Positive slant.
When the same idea can be expressed positively or negatively, express in
positively. Example:

Do not use the passive: Use the active:

“Does not apply to airplanes with “Applies to all airplanes that


modification...” have not been modified...”

d. Precision.

Use adjectives that are precise. Terms such as “excessive”, “adequate”, and
“sufficient” are unenforceable because they call for value judgments. Instead,
define how excessive wear can be measured or what is included in an
adequate inspection. Do not user terms such as “prevent”, “correct”,
“precluded”, “ensures”, “will” or a “could” unless they are properly qualified.

CHAPTER VI SOCIALIZATION OF NEW CASRs, SIs, AND ACs.

The socialization process will be planned and executed by the Sub Directorates
involved in the development of the new or amended CASR of each respective
Directorate. It should give due consideration to the experience level of the target
group and the magnitude of change being imposed by the new regulation.

Socialization of new CASR must be given to all DGCA Inspectors as relevant to their
duties and responsibilities. In the case of Air Operators, Aircraft Maintenance
Organizations, Aerodrome Operators or Air Navigation Facility Operators,
socialization of the new CASRs which are relevant to the individual
Operator/organization will be offered to the management level of the
operator/organization. The socialization of a new CASR does not relieve the operator
/organization of their responsibility to provide specific CASR training as appropriate,
to its personnel, if such training is required by the operator’s/organization’s Approved
Training Program. Neither does socialization relieve an individual Inspector of their
responsibility for self study to ensure they have acquired a comprehensive level of
understanding.

Socialization of new Staff Instructions and Advisory Circulars will be provided to all
DGCA and industry personnel who have a need to know and as determined by the
Deputy Directors involved in the development of the new or amended Staff
Instructions and/or Advisory Circulars of each respective Directorate.
