FOREWORD

1. PURPOSE : This staff instruction prescribes responsibilities, policies, and


procedure to be used by the Directorate General of Civil
Aviation (DGCA) for the harmonization of the Civil Aviation
Safety Regulations with the ICAO Standards and
Recommended Practices and the notification of any
differences to ICAO.

2. REFERENCES : This Staff Instruction should be used in accordance with the


Act on Aviation, the applicable Civil Aviation Safety
Regulations (CASRs) and the equivalent ICAO Annexes,
and Staff Instruction on Procedures for the Development of
Regulations, Staff Instructions and Advisory Circulars.

3. AMENDMENT : Amendment of this Staff Instruction will be approved by the
Director General of Civil Aviation.

CHAPTER I - APPLICABILITY

1. General

This document prescribes the procedures followed by the Directorate General of


Civil Aviation (DGCA) for the harmonization of the Civil Aviation Safety
Regulations (CASRs) with the International Civil Aviation Organization (ICAO)
Standards and Recommended Practices (SARPs) and the notification of any
differences to ICAO as required by Article 38 of the Convention on International
Civil Aviation.

2. Authority

a. The Act on Aviation establishes the authority and delegates the responsibility
for the regulation of Civil Aviation in Indonesia to the DGCA.

b. The DGCA and subordinate Directorates are responsible for establishing Civil
Aviation Safety Regulations, enforcing such regulations to assure civil aviation
safety throughout Indonesia.

c. The Republic of Indonesia as a member state of ICAO has signed the


Convention on International Civil Aviation and pledged to adhere to this
Convention.

CHAPTER II - INTERNATIONAL STANDARDS AND RECOMMENDED


PRACTICES

1. Adoption of international standards and procedures.

Article 37 of the Convention states as follows:


Each contracting State undertakes to collaborate in securing the highest
practicable degree of uniformity in regulations, standards, procedures, and
organization in relation to aircraft, personnel, airways and auxiliary services in all
matters in which such uniformity will facilitate and improve air navigation.

To this end, the International Civil Aviation Organization shall adopt and amend
from time to time, as may be necessary, international standards and
recommended practices and procedures dealing with:

a. Communications system and air navigation aids, including ground marking;


b. Characteristics of airports and landing areas;
c. Rules of the air and air traffic control practices;
d. Licensing of operating and mechanical personnel;
e. Airworthiness of aircraft;
f. Registration and identification of aircraft;
g. Collection and exchange of meteorological information;
h. Log books;
i. Aeronautical maps and charts;
j. Customs and immigration procedures;
k. Aircraft in distress and investigation of accidents.

and such other matters concerned with the safety, regulatory, and efficiency of air
navigation as may from time to time appear appropriate.

2. Departures from international standards and procedures.

Article 38 of the Convention states as follows :


Any State which finds it impracticable to comply in all respects with any such
international standard or procedure, or to bring its own regulations or practices
into full accord with any international standard or procedure after amendment of
the latter, or which deems it necessary to adopt regulations or practices differing
in any particular respect from those established by an international standard, shall
give immediate notification to the International Civil Aviation Organization of the
differences between its own practice and that established by the international
standard. In the case of amendments to international standards, any State which
does not make the appropriate amendments to its own regulations or practices
shall give notice to the Council within sixty days of the adoption of the
amendment to the international standard, or indicate the action which it proposes
to take. In any such case, the Council shall make immediate notification to all
other states of the difference which exists between one or more features of an
international standard and the corresponding national practice of the State.

3. Requirement for the Notification of Differences.

The Convention on International Civil Aviation requires a member State to file


differences existing between its regulations and the ICAO Annexes in accordance
with Article 38.

CHAPTER III - DEVELOPING CIVIL AVIATION SAFETY REGULATIONS (CASRs)

1. Responsibility

a. The Act on Aviation delegates the responsibility for the regulation of civil
aviation in Indonesia to the Director General of Civil Aviation.

b. The Director General of Civil Aviation and subordinate Directorates are


responsible for the development of Civil Aviation Safety Regulations,
enforcing the regulations to assure civil aviation safety.

2. Harmonization of CASRs with the ICAO SARPs.

a. The development of CASRs shall adhere as much as possible to the


equivalent ICAO Standards and Recommended Practices in accordance with
Article 37 of the Convention on International Civil Aviation.

b. Procedures for the development and amendment of CASR are contained in


SI PUB – 01 Procedures for the Development of Regulations, Staff
Instructions and Advisory Circulars.

CHAPTER IV - PROCEDURES FOR THE NOTIFICATION OF DIFFERENCES

1. General

In accordance with Article 38 of the Convention on International Civil Aviation,


any differences in the CASRs from the Standards of the Annexes must be notified
to ICAO.

2. Procedures

a. At six monthly basis, the DGCA Directorate responsible for the development
and amendment of the respective CASR, shall notify the Legal Division in the
DGCA of any differences between the CASR and the equivalent ICAO Annex ,
which may arise from the amendment of the Annex or the amendment of the
CASR, by using the standard reporting form.

b. The standard reporting form given in Appendix A, concerning the differences


to SARPs should be completed by the respective Directorate of the DGCA and
forwarded to the Legal Division for final approval by DGCA, then formal
notification to ICAO.
