Facts:

The accused-appellant Edgar Villnueva, Ronald Aviso and the Victim Amando Mandame after
having a drinking spree at the house of accused-appellant Wilson Villanueva, brother of Edgar
because of his birthday. After drinking beer, Edgar invited the two to attend a dance at the plaza of
Donsol in preparatory to the celebration of the fiesta.

At around 9.00 P.M, upon reaching Tres Marines Drive, a road leading to and about 200 meters
from Donsol Emergency Hospital or 150 meters away from the Municipal Building. While the three
were walking side-by-side at one arms length apart on their way to the dance they met along the
way their friends Ronald, Herrera and Balano who walked with them.

While they were walking on their way to the dance, the accused Edgar Villanueva suddenly
lighted his lighter signaling to his brother, Wilson Villanueva who then suddenly appeared out of
nowhere and hacked the victim Amando Mandane who instinctively cried “Aray!” and slumped to
the ground. The accused Edgar Villanueva then rushed ti his side and joined the latter.

Ronald Aviso, who was steps ahead from the victim, upon hearing the cry “Aray”, looked back
and saw Wilson Hacking Amando, Ronald tried to help Amando and lift him up from the ground but
he was hacked by Wilson on his right shoulder, followed by Edgar, who stuck him on the right side of
his waist determined to finish him off, at this instance, Ronald ran for his life.

Pacifico Herrera, Jr. who was walking far behind of Edgar, Ronald, and Amando saw the flashing
of the lighter then heard the thudding sound from the hacking. He saw Edgar and Wilson running
away. He then, together with his companion Balano went to the place where the sound came from
to investigate and met up with the accused brothers upon reaching a distance of 1 meter away from
each other, accused brothers aimed their bolos at the 2 witnesses and motioned to hack him which
made the two witnesses scamper for safety.

Facts

 September 1, 1991
 Riverside Street, Barangay Commonwealth, Quezon City

At around 4:00 P.M Ricardo de la Cruz was playing mahjongg together with four others in a
store. Suddenly, he heard people shouting outside. Immediately, Ricardo rushed outside of the store
and saw Rolly Obello holding Danilo de Claro by his two arms and certain Antonio Go who came
from the back of Rolly suddenly stabbed Danilo on the abdomen with the fan knife. After stabbing
Danilo, Tony and Rolly ran away.

Ricardo chased them, picked up a stone and when he was about to throw the stone, Rolly
stopped him and said: “Buda(Ricardo’s nickname), hinde katalo yan “ (referring to Tony) Ricardo
desisted from throwing the stone, then Tony and Rolly boarded a jeep and speed away.

As soon as the two fled, Ricardo returned to Danilo to help him. When Ricardo lifted Danilo, He
noticed that blood was oozing from Danilo’s chest, so he inserted his fingers on the stab wound to
stop the flow of blood but the same proved to be futile. Danilo said: “Buda, take care of me”, and
then pushed Ricardo and he fell to the ground.

Ricardo together with Danilo de Claro, Jr. carried Danilo and brought himto the hospital. At the
hospital they were informed by the attending physician that Danilo suffered three (3) stab wounds
which caused his death.

However, of the three (3) stab wounds suffered by Danilo, Ricardo only witnessed Tony deliver
his last stab blow which hit Danilo’s abdomen.
