Per the uncontroverted averments of the complainant on 04 December 2010, ai abou | 1.30 p.m. he was driving a Mitsubishi Lancer 2001 model with plate number XAJ 615. He came from Quezon City going to Boni Avenue when he was sudcieniy bumped from behind by a taxi ca with plate number TXG 371 driven by respondent. When coniplainant confronted respondent about the Incident, the latter explained his car breaks did not work and he was chatting with his passenger. The estimate cost of the repair df complainant's vehicle is Php 10,000.00. This Office finds probable cause to charge respondent with Reckless Imprudence Resulting in Damage to Property. Respondent failed to exercise due diligence when he did not check his breaks before driving his taxi cab. Neither was he concentrating with his driving as he was conversing with his passenger. As a result he collided with complainant and caused damage to him in the amount of Php 10,000.00. WHEREFORE, premises considered. it is recommended that respondent SAMUEL G.
