The State of Nevada belong to the 9th Circuit of appeals (Map.) In the Constitution for the

state of Nevada, education is covered in the 11th article. Within the 11th article, there are 10

subsections depicting the functions for the Nevada school system (Underwood.) The first article

in section 1 states that Nevada will encourage positive development for students in a variety of

fields. It also creates a position of superintendent of public instruction and lays out the functions

and limitations for that position within the school system. Section 2 depicts that schools will be

required to adhere to specific guidelines and standards in maintaining a uniform quality of

education within a school system. Violation to adhere to the standards set forth will put a school

at risk of losing funding. Section 3 states that pledges of certain land and money to the state will

be used for education. Section 4 sees to the creation of State University, how it is to function,

and it the effective date before needing to be ratified by voters in a future election. Section 5

mandates that schools are to have an established grading system by which the school is to be

graded. Teachers and professors within the school/university must comply with the provisions

set forth or else sacrifice monies set apart for school functions.

Continuing on, section 6 states Legislature shall decide how to distribute funding for

school functions from the general fund and the methods within different sessions of legislature

by which this is accomplished. Section 7 covers the election and the functions of a Board of

Regents as well as the duration of the terms of office before requiring reelection. Section 8, when

created, the Board of Regents were to establish a college for the benefit of agriculture as well as

maintain a department of Mining. Also, proceeds accumulated from land donated by Act of

Congress were to be used to benefit departments of the State University. In section 9 it is

explained that Instruction imparted shall not be sectarian in nature and will not be tolerated.

Finally, section 10 describes that no money of any kind is to be used to support purposes that are

sectarian in nature.
