ORDER

When these cases were called for the initial reception of defense of evidence, the accused and
the private complainant appeared with their respective counsels.

After witness JOSEPH CABANIT completed his testimony, the defense counsel manifested that
he has no more witness to present. He asked that he be allowed to orally offer his documentary
exhibits. The Court allowed the same.

The defense counsel offered exhibit “1,” together with its sub-markings- Judicial Affidavit of
Joseph Cabanit- is being offered to controvert the malicious allegations against the accused and to
prove that there is no basis of the indictment against him. The private prosecutor objected to said
Exhibit because it is not properly notarized and it is self-serving.

Order the objection of the private prosecutor, the Court admitted Exhibit “1,” together with its
sub-markings as to its existence and as part of the testimony of the witness who identified the same.

With the admission of the documentary exhibits, the defense rested its case.

In view thereof, these cases are now submitted for decision. Set the promulgation of judgement
on November 14, 2018 at 1:30 P.M.
