Clarifications: Moot Proposition

Ques 1. As stated in the proposition the dead body was found naked whereas the
post mortem clearly states that the girl was wearing a torn white kurta with
multi-coloured dupatta. As these two statements are the contradictory kindly
state which of the statement is to be taken into consideration. If both of the
statements are to be considered as it is then kindly clarified whether the
statement in the proposition about the naked girl was made by the police or not?

Answer: The Statement used in the proposition and the post mortem report are absolutely
correct and definite.The girl was found partially naked with the torn kurta , and in the
partially decomposed state.

Ques 2. Cause of death of the girl found in the Hostel Room no. 1025.

Answer: Nothing other than the details provided under the Medical Report is required to be
considered.

Ques 3. Date of release of post mortem report.

Answer: Not relevant.

Ques 4. Do we have to bring witness along with us?

Answer: No.

Ques 5. Are we allowed to make assumptions regarding the facts as there is in-
completion of facts?

Answer: No, Participants are required to strictly follow the facts provided in the Moot
Proposition.

Ques 6. Are we allowed to argue completely on the basis of facts?

Answer: Discretion of the participants. However, the participants are encouraged to keep in
Consideration the open-endedness of the Moot Proposition and use it to their advantage and
make innovative contentions but the participants must not deviate from the provided facts
or make assumptions.
Ques 7. Are the participants allowed to make more exhibit like they are done in
proper trial?

Answer: No

Ques 8. Facts are very silent regarding the police investigation, please clarify those.

Answer: kindly refer to the statements of Accused and witnesses attached in Exhibits I & III.

Ques 9. Please give reference for the places of 'Bhet' and 'Kurchipuram' with
respect to the republic of India.

Answer: Not relevant.

Ques 10. Please provide the details of the girl who was raped. (especially whether
she was in the same college and from when she went missing etc...)

Answer: The only fact pertinent to note in relation to the girl found in Hostel Room no.
1025 is that she is not from the Hostel or the University.

Ques 11. Have the parties got a "No Objection Certificate" from the High Court to
Appeal in the Supreme Court?

Answer: Yes

Ques 12. Dr. Sanjay Kumar, who committed the autopsy report is a government
doctor? Also, he has given his statement in the court or not?

Answer: Not Relevant

Additional –

Ques. This is regarding the hard copies of the memorial, as in the brochure nowhere it
has been mentioned as to when do we have to submit it.

Answer: The participants are required to bring Seven Hard Copies of the Memorial (of each
Side ) of the appellants and respondents resp. on the day of the competition (3rd April 2020).
