The Fringe Element
Albuquerque-area author and columnist James Nathan Post has embarked on a new project – that
of producing his own TV shows for cablecast on Channel 27 to go along with his books. Each hour-
long (58 minutes actually, same as the shows that Koehler and I do) show features commentary,
comedy skits and musical performances. At present, Channel 27 has yet to actually run any of the
shows he's produced, but Post has the shows available on DVD, and can be ordered from his
websites – www.postpubco.com or www.thefringeelement.net
San Juan County Rifle Raffle

gun shows at the State Fairgrounds in Albuquerque and could use

Paul Gessing and the staff of the Rio Grande Foundation have been
getting columns and letters to the editor printed in the local
newspapers, including the Albuquerque Journal. on a regular basis.

Dona Ana – The LPDAC Central Committee has been having monthly
meetings, as well as an information table at the Las Cruces Farmer's

San Juan – The San Juan County LP is sponsoring a new fundraising
drive for the LPNM in addition to the annual rifle raffle that they run.
This new effort will raffle off a new, limited-edition Harley Davidson

attend this conference.
What – 2008 Leadership Conference

When – Presidents’ Day Weekend, 2008 (February 15-17)
The annual Leadership Conference is a meeting of all Libertarian
activists, organizers, candidates, and financial supporters. No matter
which category or categories you fit in, you will find more events that
will interest you than you will be able to do.
This is where all Libertarians gather with the single purpose of building
our party’s structural integrity beyond the level required to defeat the
other two parties. There will be an eight hour seminar on activist and
candidate training. There will be job training for county and state
officers, from filing with the FEC to how to organize volunteers in your
area to organizing new affiliate parties in your state.
Those who will be attending the 2008 National Convention on
Memorial Day in Denver need to attend the 2008 Leadership
Conference in preparation. I hope everyone goes to our national
convention. It is hands down the biggest event of the Party, occurring
every two years. And the Annual Leadership Conference in Las Vegas
will prepare first time convention goers to perform their responsibilities
at the Convention.
At the 2008 Leadership Conference, the platform and bylaws
committees will meet, and there will be various seminars on how to be
a better and more effective delegate, with topics ranging from Roberts’
Rules of Order to Conventioneering.
If you have ever wanted to attend a meeting of the Libertarian National
Committee, you will have your chance on this glorious three day
weekend in Henderson Nevada (Las Vegas).
Additionally, the tentative schedule of events includes both a debate of
our Presidential candidates and a debate of our candidates for chair of
the 2008 LNC. There will also be forums and lectures, concerning how
we reach out to both Democrats and Republicans now that their
combined approval rating is less than 50%. It’s closer to 25%. The
glass isn’t even half full for the other two parties. Right now,
conference planners are finding libertarian leaning Republicans and
Democrats; to give their perspective on where the two party system
has the weakest psychological hold on the electorate and where the
LP should be staking out political ground.
There will be seminars from individuals accomplished in the fields of
fundraising and marketing. In short it is the goal of the Leadership
Conference organizers to offer a conference where you just can’t see
everything you want to. A full agenda will be included in next month’s
edition of the New Mexico Liberty newsletter.
Agenda
This agenda is designed with the interests of every libertarian at every
level of activism in mind. Everyone who attends will be forced to
choose between several simultaneous events of interest.
More information will be available to all members of the libertarian
community than at any prior National Leadership Conference. There
will be an eight hour seminar on communication. The first part
designed for activists to better communicate the message on a one on
one basis. The second four hours will be dedicated to those who want
to represent the Party publicly as a candidate or a leader.
There will be courses on everything from how to take minutes at your
local county meeting to the procedures of the National Convention,
scheduled for Memorial Day 2008 in Denver.

There will be courses for treasurers to deal with basic accounting and
Federal Election Commission procedures, so our local parties can
compete in our national effort.
There will be courses on how to better utilize volunteers and how to
make their work more rewarding. And to learn how to use some of the
new advanced software tools created for our activists through national
cooperation.
Betty Rose Ryan who has planned several successful state
conventions, and who is coordinating our upcoming National
Convention, will teach you how to hold a fun and effective convention
right in your own state.
And, there will be many debates scheduled about the direction our
party should take in the area of affiliate relations, a national affiliate
agreement, and controversial issues within the party like abortion,
immigration, national defense, and the purpose of our platform.
At lunch a panel of current and former Democrats and Republicans
will discuss how we can most effectively speak our peace to both the
left and the right of the two party political spectrum.
At dinner a debate between those vying for the Libertarian nomination
for President of the United States of America will shed light on who
our strongest candidates are.
More events are under consideration and the schedule is not yet full,
so please let us know if there are any other suggestions you have that
will make this conference even more useful and more exciting for your
fellow libertarian attendees.

The 2008 National Leadership Conference will be held in the
entertainment capital of the world, the great city of Las Vegas
(Henderson, Nevada). You may know it better as Lost Wages or Sin
City. And, on Presidents’ Day Weekend 2008, Las Vegas will be
known as the home of the 2008 National Leadership Conference.
The Leadership Conference will be held at the Sunset Station Hotel
and Casino. Room Discounts for the Libertarian Leadership

The 2008 National Leadership Conference is the largest and most
exciting one in our history. I expect the one in 2009 to be even better.

 Ending the Empire of Lies

Despite its widely-advertised – and for the most part sincere –
aspirations, American civilization presently stands on a foundation of
corrosive lies that, slowly but insidiously, have poisoned its every
effort to become the first truly decent society in the history of the
world.
Several years ago, at a New Mexico state Libertarian Party
convention, I delivered an address called "Empire of Lies". I had a lot
of different lies in mind then – the sinking of the "helpless, unarmed"
Lusitania, the Gulf of Tonkin "Incident", and the attack of the Word
Trade Center "because they hate our freedom" – are some examples.
Here are three more . . .
SOVEREIGN IMMUNITY
The first of those three lies – and I wouldn't wish to give the
impression that these are the only lies propping up this culture's power
elite – is the doctrine of Sovereign Immunity, a curiously medieval
provision in a nation proud to have thrown off the rule of kings.
The idea at work here is that, since the authority of the monarch is
backed up the will of the deity, "the king can do no wrong", or be
expected to pay much in the way of consequences for anything that
he or his minions do. You can't sue him – which is to say, the system
won't let you sue him – nor can you have him busted if, for example,
he comes to your wedding and forces your bride to have sex with him
first.
Because this doctrine is still alive and well in what represents itself as
a republic, you have to beg for the permission of the government in
order to sue it. I recall quite vividly the first time I ever heard that –
from my parents, when I was five or six, although I don't remember
why – and even then, exactly as it does now, it seemed wildly absurd,
and transparently self-serving, if you happen to run a government.
"Why if people could sue the government, nothing would ever get
done!"
"Yes, and. . .?" I remember thinking.
Now I know that there's a small legal cottage industry dedicated to
getting the government's permission to sue it, and then suing it, an
exercise that protects nobody, and seldom benefits anybody but
lawyers. But imagine what American history would look like – better
yet, read my first novel, The Probability Broach – if those farmers in
western Pennsylvania had been able to sue George Washington and
his buttboy Alexander Hamilton to keep them from preferentially taxing
whiskey.
Imagine how American history might have turned out if southerners
could have taken Abraham Lincoln to court to prove that they had a
right to secede. Or if they could have obtained an injunction to stop
Philip Sheridan's mind-bogglingly destructive Shenandoah campaign.
Or if a restraining order could have kept William Tecumseh Sherman
from marching through Georgia. Six hundred thousand lives – and
more than a century of rebuilding the southern infrastructure and
economy – could have been spared, not to mention the lives of their
descendants, possibly among them the individual who might have
found a cure for cancer.
Later, Woodrow Wilson could have been held legally responsible for
lying the United States into World War I, Franklin Roosevelt for the
enormities he committed in a futile attempt to end the Depression (as
it turns out, created by Wilson's policies) and provoking the Japanese
into attacking Pearl Harbor, Truman for murdering a hundred
thousand innocents in Hiroshima and Nagasaki and for prosecuting an
illegal war in Korea, and John Kennedy and Lyndon Johnson for lying
our way into Vietnam.
I know that Randy Weaver successfully sued the federal government
for two or three million dollars (if it had been my wife and kid they
murdered, that word would at least have started with a B rather than
an M), although I don't know what circumstances made it possible.
What if, instead of being railroaded into prison, the surviving members
of the Branch Davidian church had been able to sue the Bureau of
Alcohol, Tobacco, Firearms, and Explosives, and – surely the most
innacurately named entity in the entire six thousand year history of
government – the Federal Bureau of Investigation's bloody-handed
"Hostage Rescue Team"?
Finish out the rest of recent history for yourself. The fact is that most
of the government atrocities of modern times would never have
happened, if the threat of a lawsuit carried any weight. There would
have been no Oklahoma City bombing (I know, you think Timothy
McVeigh did it; you can go back to sleep, now; sorry I disturbed you),
no destruction of the World Trade Center, no wars in Afghanistan or
Iraq.
Instead, a greatly-reduced federal government (state governments, as
well) would be up to its earlobes in lawsuits, and the rest of us might
enjoy something a little more closely resembling freedom than we do
now. There would be no shield laws to protect politicians and
bureaucrats from the consequences of their insanity, stupidity, and
malice, so taxpayers would suffer less, whenever the government is
sued.
LIMITED LIABILITY
The second untruth on which the present establishment depends is
the mercantilist privilege of "limited liability", the "legal fiction" (for
which read, lie) that a corporation is an individual person, in and of
itself. It is, in fact, the marketplace equivalent of Sovereign Immunity.
Under limited liability, whenever a corporation commits a hideous
blunder, or perpetrates some evil against somebody, its owners – the
stockholders – can only be held responsible to the limit of whatever
they have invested in the company. When I looked it up, I was
surprised to see how recent the concept of limited liability is. I'd had a
vague impression that it had arisen with the Hanseatic League, or
originated within European trading associations during the Bronze
Age.
In fact, it is a child of the 19th century, born illegitimately of exactly the
same corrupt arrangement of state-sanctioned privilege that Adam
Smith had complained bitterly about in his Wealth of Nations in 1776,
that had helped to spark our American Revolution in the same year,
and which we continue to see reflected in obscenities like the
Supreme Court's Kelo decision, that allows a local government to
steal somebody's private property and hand it over it to somebody
else – provided that there's more tax revenue to be realized by the
process.
Leftist historian Gabriel Kolko pointed out four decades ago that
American corporations had already swollen to unmanagable size by
the late 19th century. To make up for their bulk and unweildiness – in
a market environment that usually favored smaller, faster, more
nimble entities – they had to be propped up from the outside by
legislation like the Sherman Antitrust Act, the actual function of which
(and this was no accident) was to act as a barrier to market entry by
any newer, smaller companies that, among other things, could not
afford huge, powerful legal departments to fend off attacks by the
government.
Protected by laws like this, and shielded by limited liability,
corporations were free to keep expanding into the disgustingly bloated
monstrosities they are today, while smaller businesses – which still
supply a majority of jobs in this country – find it ever harder to
compete.

A country without special laws written to benefit huge companies,
while crippling and stifling smaller, newer outfits, would not be
dominated by corporate fascism the way America is today. Our market
system would be capitalistic – that is, compelled to offer the best
possible goods and services at the lowest possible prices – rather
than mercantilistic, in which the shoddiest goods and services are
offered at the highest possible prices because political pull (and not
customer satisfaction and return business) is the focus of company
effort.
It would be a country in which a Halliburton or a Blackwater USA
would actually have to please their clients or go out of business,
because nobody – stockholders and officers inside the corporation, or
politicians and bureaucrats on the outside – would be willing to face
the ruinous legal and economic consequences of starting a war to
benefit them.
On this same principle, libertarian philosopher and teacher Robert
LeFevre wanted to abolish the secret ballot in America, so that voters
could be sued for the criminal behavior of the politicians they had
elected.

Bo’s response was simple: “Y’all have put me under. I’m out of here.”
Bo Ward pulled out a handgun and shot himself in the head. Bo’s life
was out of his control. It was in the hands of other people.
I don't know that Ward really needed to kill himself as he did. Maybe
he could have gotten the Institute for Justice to take his case. But
that's not my call to make. It was Ward's call, and he made it, without
harming anyone else.
I feel NO pity for the politicians on Clarksville, Tennessee City Council.
If they're feeling remorse that their arbitrary decision caused Ward to
commit suicide, then maybe they might consider putting up a year's
worth of salary from their positions on the City Council towards a
memorial to Ward? Or they could just pay it forward, by repealing the
City zoning code, so that no one else needs to re-zone their property
as Ward needed to.
Ward used his death, as Nietszche advocated, using that death to
make a point, and he did it in such a way that the politicians could not
avoid that point – that they were willing to destroy someone's life in
order for them to have power over others.

LPNM in the Courts
The Tenth Circuit Court of Appeals recently ruled against the LPNM in
our court case against New Mexico's double-petitioning requirement,
i.e., that the LPNM first qualify as a “minor political party” by gathering
petition signatures, then each candidate must qualify to be on the
ballot by gathering still more petition signatures. The American Civil
Liberties Union's New Mexico affiliate (ACLU-NM) agreed to represent
the LPNM on a pro bono basis in October, 2006. The LPNM was shot
down in (state-level) New Mexico District Court, then appealed to the
(federal-level) Tenth Circuit Court in Denver. Here's the link to the

State Chair Jay Vandersloot has been repeatedly interviewed about
the situation –
So far I have been called by four agencies concerning our set back in
the court case.
1. KNME (PBS) inverviewed me on the telephone for about 12
minutes, but only used about 30-45 seconds of it on the radio.
2. One of the radio stations in Santa Fe also interviewed me for
about 10 minutes. However, I was not able to pick up the station,
and therefore do not know how much of it they used.
3. I was interviewed on the telephone by two different news
agencies, for about 15 minutes each. I do not yet know which
newspapers the information might get published in.
The LPNM's next step, according to Bryan Sells, the ACLU attorney
handling the case, is to file a petition to have the 10th Circuit Court
readdress the decision, a move which might require that the case be
heard by all the justices on the 10th Circuit Court.
Call for Candidates
At present, the LPNM has two (2) candidates for public office for the
upcoming 2008 elections –
• Myself, for State Representative, District 16
• Eric Pino, for State Representative, District 11
There's a specific reason that I keep stumping for LPNM members to
sign up for the State House and Senate races – getting on the ballot
only requires about 120 petition signatures – you can get this amount
of signatures by just asking your neighbors. This is in stark contrast to
the races for U.S. House and Senate. A U.S. House seat will require
about 1500 signatures, and since U.S. Senate is a statewide office,
the race requires 5300 signatures. And these are just the numbers
that are put out by the Secretary of State's Office – the reality is that
you will need about one-and-a-half to twice the official numbers, to
make sure that you can still qualify after they disqualify some of the
petition signers.
That being said, the 2008 election looks it will have a few open-seat
races, as Senator Pete Domenici is not running for re-election. The
open seats include U.S. Senate, all three U.S. House seats (their
current chair-warmers are seeking to follow Domenici), Albuquerque
City Council District 6 (Heinrich is looking to replace Heather Wilson
as she runs for Senate), and so on.
I'm not saying that Libertarians shouldn't run for the bigger offices, I'm
just saying that such a candidacy will cost a lot more, in terms of time
and money spent. I contend that the time and money might be better
spent by running for State House or Senate.
Whither Ron Paul?
To date, the presidential candidacy of U.S. Representative Ron Paul
(R-TX-14 (Galveston)) has excited libertarians, both inside and
outside the Libertarian Party, like no campaign before. Dr. Paul has
earned the moniker “Dr. No” because of his tendency to vote against
anti-Constitutional legislation, such as the gun laws, drug laws, tax
code, the Iraq invasion and occupation, federal subsidies of all kinds –
the list goes on, and on, and on . . .
To date, Dr. Paul has garnered more media attention and raised funds
than the past three Libertarian Party presidential campaigns in 1996,
2000 and 2004 combined – and this is before the primaries for the
2008 election. Quite often, the pundits interviewing Dr. Paul will
mention his 1988 run for president on the LP ticket, and they're NOT
snide about noting that candidacy. Support for Dr. Paul from
Libertarians cuts across the ideological spectrum – representing the
anarchist wing of libertarians, L. Neil Smith wrote an article for The
Libertarian Enterprise advocating that the LP nominate "None of the
Above" and cross-endorse Dr. Paul [1], and Arizona Libertarian Ernest
Hancock has jumped on board the Paul campaign. Meanwhile, Carl
Milsted, who I don't think anyone would refer to as an anarchist in the
slightest bit, dropped out of the LP back in July to back Dr. Paul.
That being noted, the LP's presidential candidates haven't been able
to generate much enthusiasm in their campaigns. Tom Knapp,
publisher of Rational Review, posits that the Paul campaign is at least
partially responsible for this – LPers are giving time and money to Dr.
Paul that could otherwise go to LP candidates. [2]
The question has been raised to myself as to whether the LPNM could
endorse Dr. Paul. The answer at present is NO, as the LPNM's
Constitution and Bylaws specfically forbid endorsing candidates who
are affiliated with other parties. I would not be surprised if the LP's
National Bylaws had a similar clause.
That being said, there's nothing wrong with, and no rules against,
LPNM members going to the Ron Paul meetups as private individuals
and offering their services. I count myself as one of those who have
done so – I've gotten spray paint all over my hands making banners,
stood outside the Albuquerque Balloon Fiesta holding signs, etc. It's
just that I can't do so as an officer of the LPNM. For those interested,
just run a Google search on “Ron Paul New Mexico” and follow the
links that pop up as a result.

As for writing your article, It should be concise (no longer than a full
page) and topical. A bit of humor helps, especially for op-ed pieces.
What I'm really looking for in the way of articles is what's going on in
the LPNM – what YOU the membership are up to in spreading the
message. For example, an article about the stupidity, insanity and evil
of the UN might get put in, depending on available space and the
quality of the article. A group of LPNM members counter-protesting
the raising of a UN flag by the city council WILL get put in, and
probably will get first priority.
Editorial Viewpoint
The basis for libertarian thought is the Zero Aggression Principle
[ZAP] –
A libertarian is someone who believes that no human being
has the right – under any circumstances – to initiate force
against another human being, nor to threaten, incite or
delegate its initiation.
New Mexico Liberty holds that Libertarian candidates, officeholders or
appointed spokespersons at all levels of government or the Party
should refrain from advocating new or more restrictive laws, new or
more expensive spending programs, or new or higher taxes. To
paraphrase from the medical profession, “First, do no harm.”
