Filing frequency/ Generally, monthly – 14 days after the end of the tax
deadline period.
Invoicing General Albanian invoicing rules apply, this means that all
invoices must be issued in the Albanian language. In
Albania there is also a requirement to issue hand-written
paper invoices.
Currency payment Albanian VAT must be paid in local currency, the Albanian
Lek (ALL).
FX settlement rate The rate of the previous day should be used to calculate
the VAT obligation for each transaction.
These services include (please note that this list is not exhaustive):
>> The SIM card of the cell phone receiving the service is located in Argentina
>> The digital service is received via an Argentinian IP address
>> The invoicing address of the recipient is one located in Argentina
>> The bank account used for the payment or the invoicing address on the credit
card statement is one located in Argentina
Not all digital services are in the scope. Note that the download, or access to, e-books
are exempt from this new VAT law in Argentina.

Affected digital service Argentina’s Federal Public Revenue Administration (AFIP)
businesses compiled a list of 180+ digital service businesses that are
affected by the new VAT rules.
Note on Argentina rules The Argentine approach to assigning liability for the
collection and remittance of VAT in this new rule is
interesting. The place of supply rules are in place but the
liability is not on the non-resident supplier. The liability for
the collection and remittance of VAT, in practice, falls on the
Argentinian customer’s payment provider.
The ATO defines the services and digital products affected by the July 1, 2017, GST law
change as:
>> Streaming of movies, music, apps, games and e-books
>> Downloading of movies, music, apps, games and e-books
>> Services such as architectural or legal services
Further information
The ATO use third-party data and have undertaken significant internet profiling so as to
identify foreign-based businesses that they believe are affected by the law.
In some cases, the ATO have used tax treaties with other countries to confirm these
business details. As such, some foreign-based businesses may receive a letter or
phone call from the ATO informing them about the new law.
This is to raise awareness and provide links to more detailed information so that these
foreign-based businesses can comply with the law in Australia.

Threshold Suppliers must register for Australian GST when the total
value of their sales exceed AUD$75,000 (circa
USD$54,000, EUR€48,000, GBP£42,000) over a 12-month
period.

FX settlement rate Advice from the ATO is that merchants can convert
amounts on the earlier of either the:

FX settlement rate The FX rate on the last day of the reporting period should
be used when preparing settlement reporting.
Indeed, according to article 476 (25) of the TC, the acquisition of software licenses for
the commercial development of digital content, in accordance with the regulations
issued by the Ministry of Technologies and Communications may be excluded from
the VAT.
>> Its commercial value cannot be determined by the value of the supplies used for
the development of the service.
>> The digital content can be copied, transmitted and can be used through telecom-
munication networks or technological tools.
>> The digital content must be products provided in a digital format as a sequence
of ones and zeros that can be read by a computer and give instructions to it,
such as computer software, videos, movies, music, games, electronic books and
applications.
The Colombian Ministry of Technology has made available a self-diagnosis format that
can be used by providers and consumers in order to determine whether a specific
service is subject to the VAT exclusion.

Threshold From January 1, 2019, a new €10,000 sales threshold for
microbusinesses is used.
Filing frequency/ Generally, quarterly - 20 days after the end of a tax period.

FX conversion The European Central Bank (ECB) rate at the end of the
quarter applies to cross-border B2C sales from non-EU

B2B validation available Yes. The EU provides the VAT Information Exchange
System (VIES) for validating VAT numbers used in B2B
transactions.

Iceland
The same applies to the sale by data centres of mixed services to buyers with resi-
dence abroad and not with a permanent establishment in Iceland.
The Icelandic definition of affected digital services mirror the EU VAT Directive
(Appendix II) and include (but not exclusively) the downloading or streaming of:

The services are always regarded as used where the buyer of the services resides or
has a place of business.

Threshold Yes. Threshold of ISK2,000,000 (circa USD$16,000,
EUR€14,000, GBP£12,500) over 12-month period

FX settlement rate The Icelandic Tax Authority requires that each invoice is ei-
ther issued in ISK, or the VAT is stipulated in ISK at the rate
of the issue date.

then the official penalty interest after that.
OIDAR is a category of services provided through the medium of internet and received
by the recipient online without having any physical interface with the supplier of such
services.
India’s Central Board of Excise and Customs (CBEC) defines affected services in GST

FX conversion The New Zealand IRD states that using a New Zealand
commercial trading bank’s exchange rate, such as
Westpac, is recommended for FX conversion with the
potential to use ECB rates as a fallback option.
B2B validation available Available via New Zealand Companies Office Register.
The definition is based on the EU VAT Directive (2206/112/EU) and the EU VAT
Regulation (Council Implementing Regulation NO 282/2011 of 15 March 2011).
They can be used as guidelines when deciding what is included in the term electronic
services.

EUR€5,100, GBP£4,500).
Filing frequency/ Quarterly – 20 days after the end of each quarter. For
deadline example, for Q4 2017 returns the deadline for filing is
January 20, 2018 (20 days after end of Q4 2017).
The requirement to register under this new registration system will also apply to digital
property and services distribution platforms (“digital platforms”) with respect to taxable
supplies of incorporeal movable property or services received by specified Québec
customers.
>> A digital platform will mean a platform that provides a service to non-resident
suppliers, by means of e-communication (e.g. an application store or a website),
enabling them to make taxable supplies of incorporeal movable property or
services in Québec to specified Québec consumers.

consecutive 12-month period exceed ZAR50,000 (circa

Republic of Korea (“Korea”), the e-services are deemed to be supplied within Korea.

Currency payment In principle, VAT shall be paid in South Korean Won (KRW).
In case of being paid from abroad, taxpayers are allowed
to pay VAT in USD by applying the current standard foreign
exchange rate.

Fines/penalties Failure to file a VAT return when one is due will attract a
fine equal to 20% of the VAT owing.

with the Swiss FTA when their annual B2C Swiss sales
exceed CHF100,000 (circa USD$100,100, EUR€88,300,
GBP£78,200).
Data storage Every taxable person must keep records for a period of at
least 10 years.
Fines/penalties Not fulfilling the duty to register, to submit the tax re-
turns, or make false statements can lead to a fine of up
to CHF800,000 (circa USD$840,000, GBP£640,000, or
EUR€700,000).

in Taiwan when their annual sales exceed TWD480,000
(circa USD$15,600, EUR€13,700, GBP£12,100).

Currency payment VAT payments must be made in New Taiwan Dollar (TWD).
FX settlement rate The FX rate used to calculate the VAT payable is the
current buying spot exchange rate on the last day of the
bi-monthly VAT filing period.

The change doesn’t affect business to business sale, the reverse charge mechanism
will continue to be implemented.
The rule change relates to Article 9(1) of the Law No. 3065 (dated: November 28, 2017),
No. 7061 on Modification in Some Tax Laws and Some Other Laws.

deadline period.
This means, among other criteria, that the words ‘tax in-
voice’ must be clearly displayed on the invoice in addition
to the name, address, and tax registration number of the
supplier.
Currency payment UAE VAT must be paid in local currency, the UAE Dirham
(AED).
FX conversion The UAE VAT law states that the exchange rate to be used
in translating foreign currency to the UAE Dirham is the rate
approved by the UAE Central Bank.
FX settlement rate As of January 2018 the UAE VAT Law and Executive
Regulations did not specify specifically how foreign
exchange rates for settlement should be treated.
>> For these purposes, audiovisual content is defined as the content produced
based on sounds, images or images in movement (video), separately or combined, with
or without synchronism between them (“Digital Services of Audiovisual Content”).
>> Mediation or intermediation activities carried out via the Internet, technological
platforms, computer applications, or similar means, with the purpose of intervening
directly or indirectly in the offer or demand of the provision of services (“Digital Services
Marketplace”).
