AFFIDAVIT OF DESISTANCE

I, DELFIN BALLESTEROS y DOMAGAS, of legal age, Filipino, and a

resident of Barangay Tuliao, Sta. Barbara, Pangasinan, after having duly sworn to
in accordance with law hereby depose and state:

1. I am the complaining witness for Frustrated Homicide against FELIX

GARCIA y PARAYNO in the case entitled "People of the Philippines versus Felix
Garcia Y Parayno ", Criminal Case No. 2019-0541-D, which is pending before the
Regional Trial Court, Branch 44, City of Dagupan.

2. The filing of this case was due to misunderstanding between me and Felix
Garcia. In fact, I have already forgiven him, and have settled our differences in the
barangay. Copy of the barangay blotter is hereto marked as Annex “1”.

3. I therefore respectfully request that the above-mentioned case filed

against said Felix Garcia be dismissed as in fact I now withdraw my complaint
against him and I further manifest under oath that I am now desisting from
testifying against him in Court or in any other government entity or agency in
connection with the said criminal case.
