RESOLUTION

Pursuant to Art. 263 of the Revised Penal Code, undersigned will hereinafter
resolve the complaint solely based on the evidence of the complainant and the
respondent.
Complainant alleged that on On 05 April 2018 at around 4:00 in the morning,
he was walking on the side of the road along Paseo Del Congreso heading to the
Malolos Public Market to buy some things for their carinderia business. When all
of a sudden an approaching motorcycle with sidecar swerving left and right at a
very high speed hit and bump unto him, despite of the fact that he already head on
a concrete post on the side gutter of the road to avoid the said motorcycle.

Such incident cause the complainant to suffer injuries such as fragmented

leg bone and partially blinded left eye. As alleged, the driver of the vehicle was
found to be intoxicated with alcohol.
As a consequence, the complainant was required to rest and to have a
continuous medical treatment for more than ninety (90) days depending on the
progress of his medical condition.
After carefully reviewing the records of the foregoing complaint, the
undersigned prosecutor finds that the allegations of the complaint bore out the
crime of Serious Physical Injuries.

WHEREFORE, premises considered, the undersigned Prosecutor recommends

the filing of Serious Physical Injuries against respondent BILL JOHN
SUBILLAGA.
