AFFIDAVIT OF DESISTANCE

I, JOSELITO C VILLANUEVA, Filipino, of legal age, and resident of

Brgy.Vista Alegre, Bacolod City, Negros Occidental, after having sworn to an
oath do hereby depose and say:

That I am the private complainant in the Criminal Case entitled

People of the Philippines vs. DENNIS D.MONTANEZ docketed under Criminal
Case No. 20-01-34248 for Theft, now pending before the Municipal Trial
Court in Cities, Branch2, Bacolod City;

That the accused had asked for my forgiveness and after thorough
deliberation, I have decided in the spirit of human compassion to agree to
the settlement offered by the accused;

That in view of our amicable settlement and reasonable

compensation in satisfaction of civil damages incurred, I have decided not
to pursue the prosecution of this case against accused DENNIS
D.MONTANEZ;

That for the reason above-stated, I am no longer interested in further

pursuing the instant case and I’m asking the Office of the City Prosecutor,
Bacolod City and the Court that may hear my case to cause for the
dismissal of the same;

That this affidavit is voluntary on my part without any influence from

anyone else;

That this affidavit has been translated to me in the Ilonggo dialect,

the language I understand and speak;

That I am therefore respectfully requesting the Trial Prosecutor and

the Honorable Judge of MTCC Branch 2, Bacolod City, Negros Occidental to
cause the dismissal of the above-entitled case.
