THE COURT: People versus Richard Wanke.

Mr. Wanke, can you hear me?

THE DEFENDANT: Yes.

THE COURT: All right. We're here to find out about

the witnesses' availability.

MS. HITE ROSS: Marilyn Hite Ross for the State and

Pamela Wells.

Right now we believe that all of our witnesses

are available. We reached out to them. We are pretty

10 confident they are.

ll THE COURT: For either date or both dates in

12 February? I know that we had it tentatively set on

l3 February 20.

l4 MS. WELLS: That's the main date they checked about.

l5 I haven't heard about any problems with either date. I

l6 know the 2lst is when they were mostly talking about.

17 The only issue is we have a motion for an

18 evidence deposition for a witness that has cancer and she

19 was coming up for this. We had scheduled it around her

20 treatment. She has moved out of state. So she's still

21 scheduled to come in on Monday. We would like to take

22 her deposition while she's here. She has to travel with

23 a companion because of her diagnosis.

MS. WELLS: It's in the motion, your Honor. It

is Wanda —~

THE COURT: I see it.

MS. WELLS: Barbara Welch. I keep calling her

Wanda. I don't know why I keep calling her Wanda.

Barbara Welch.

THE COURT: All right. Counsel, any objection to

that?

MR. SIMMONS: Robert Simmons on behalf of Mr. Wanke.

10 No. We acknowledge receipt of the motion. We

ll have no objection to taking an evidence deposition from

12 Miss Welch.

13 THE COURT: We'll do that evidence deposition. We

14 can do that Monday.

15 MS. WELLS: She's coming in on Monday, so we can do

l6 it Tuesday morning?

17 THE COURT: That will be fine. We can do it Tuesday

18 morning. And we'll find some space available. The

19 defendant will have to be present. And we'll notify you

20 Tuesday morning as to the location of that deposition.

21 Okay. So, counsel, what about your witnesses? All

22 available ~-

23 MR. SIMMONS: Yes, your Honor.

MR. SIMMONS: Yes.

MS. WELLS: Judge, the only other issue on witnesses

would be the out—of—state witness. I handed up an

affidavit for the out—of-state witness. You have signed

that before.

THE COURT: All right. Let's set a status on this

and we'll go through —— I still owe you a decision on a

couple motions.

MS. WELLS: Yes.

10 THE COURT: We'll set a status on scheduling, what

ll we will be doing and how we are going to use the time

12 between now and then. I don't feel that we will be as

l3 intensive as we were before. I feel that everybody is

14 ready for trial. I know that next week we have open,

15 too. I can set it next Wednesday or Thursday afternoon,

16 if you would like. Either one.

17 MS. HITE ROSS: I'm still open, Judge, because I

18 didn't put anything in.

19 MS. WELLS: I should available.

2O THE COURT: Which works best for you and co—counsel?

21 MR. SIMMONS: It appears for Mr. Zimmerman Wednesday


22 morning would work best.

23 THE COURT: Is that available?

24 MS. HITE ROSS: That's fine.
