SUBJECT: HARMONIZATION OF MOTOR VEHICLE (MV) CLASSIFICATIONS OF
LTO AND LTFRB
Pursuant to Republic Act No, 4136 (Land Transportation and Traffic Code) and Section
5 "Reclassification and New Models of Motor Vehicles” of Republic Act No. 8794 (Fin
‘Aet imposing a Motor Vehicle Users Charge on-Owners of All Types of Motor Vehicles
and for Other Purposes) that mandated the DOTC to issue any change in the
classification of motor vehicles, the following classification of motor vehicles is hereto
issued for compliance of the Land Transportation Office (LTO) in the registration of new
and it-use vehioles and for the issuance of the Certificate of Public Convenience by the
Land Transportation Franchising and Reguiatory Board (LTFRB).
Section 1. OBJECTIVES
‘The objectives are the following: z
4.4. To conform with the ASEAN direction of harmonizing the classification of motor.
Vehicles based on the United Nations Economic Commission for Europe
(UNECE) regulations;
4.2 Te provide guidelines in the classification of various types of motor vehicles
consistent with UN-ECE regulations;
4.3. To come up with a policy on modified motor vehicles and their classifications;
and
To harmonize regulations on motor vehicle classification of LTO for registration
and franchise application evaluation of LIFRS.
Section 2. COVERAGE a
This Order shall cover the classification of motor vehicles of both LTO and LTFRB
consistent with the Philippine National Standards (PNS 1891:2006 ICS 43.040.01) on
the classification and definition of power-driven vehicles.
Section 3, DEFINITION OF TERMS
3.1. Motor Vehicle — refers to any vehicle propelled by any power other than muscular

power using the public highways, but excepting road rollers, trolley cars, street-
sweepets, sprinkles, lawn movers, bulldozers, graders, fork lifters, amphiblan
trucks and cranes, if not used on public highway and vehicles run only on rail or
tracks, and tractors, trallers and tractioh engines of all kinds used exclusively for
agricultural purposes.
‘Modified Motor Vehicle ~ refers to any physical change or alteration in the
existing motor vehicle design such as body configyration, engine displacement
and others except those enumerated in Section 5.2 and which shall be subject to
the inspection by the Motor Vehicle Inspection Center (MVIC) prior fo its
registration. .
PNS 1891:2006 ~ refers to the OT! Bureau of Product Standards adoption of and
adherence to the Classification and Definition of Power-Driven Vehicles and
Trailers under the 16 Apiil 1899 Consolidated Resolution on the Construction of
Vehicles of the United Nations Economic and Social Council (UNECE), attached
hereto as Annex A.
Customized Local Road Vehicle (CLRV) ~ refers lo a motor vehicle that is-
manufactured, assembled or rebuilt using new or remanufactured parts or 2
combination of both, driven or used upon highways for the purpose of
transporting people and/or, goods as per PNS 2060:2007 and shall be registered
asa rebuilt vehicle.
Customized Local Road Vehicle Classification ~ refers to the classification of
customized local road vehicies specified in PNS 2060:2007
Certificate of Conformity (COC) ~ refers to a certificate issued by the Department
of Environment and Natural Resources to a vehicle menufacturer/assembler or
importer certifying that @ particular new vehicle or vehicle type meets the
requirements provided under the Clean Air Act and its rules and regulations.
New Motor Vehicle — refers to a vehicle constructed entirely from new parts that
are submitted to LTO for initial registration
Rebuilt Motor Vehicle — refers to a locally-assenibled vehicle using new or used
engine, major parts or components
Certificate of Compliance to Emission Standards (CCES) ~ refers to a certificate
issued by DOTC/LTO to a rebuilt vehicle or second hand vehicle imported into
the country based on an inspection by the LTO MVIC in accordance with the
emission standards set by DENR and as a requirement for the initial registration
of the subject vehicle,3.10 Motor Vehicle Inspection ‘System Report (MVISRJ~ refers to an inspection report
ae by LTO-MVIC to all motor vehicles that felled the inspectlon process of

the certificate issued by LTO Motor Vehicle Inspection Cefter to a motor vehicle
certifying that a particular motor vehicle passed the inspection process of MVIS
3.12 MVIC ~ refers to the LTO Motor Vehicle Inspection Center wherein all activities of
Motor Vehicle inspection System are being done
3.43 Motor Vehicle Type Approval - refers to the approval of a vehicle type prior to
mass production (refer to international definition)
3.14 Light Electric Vehicle (LEV) — refers to a two-wheeled or three-wheeled electric
vehicles equivalent to L1, L2, L3, Lé of the PNS 1891:2006 i
Low Speed Vehicle (LSV) ~ refers to a four-wheeled motor vehicle (other than
ATVs, trucks, duses and those that are excluded from the term “motor vehicle’
under Republic Act 4136) which uses alternative fuels like electricity and whose
maximum speed capability is nol more than 40 kilometers per hour equivalent to
M1, M2, M3 of the PNS 1801:2008.

3.46 High Speed Vehicle (HSV) — refers to vehicies péwered by alternative fuels such
‘as electricity with speed capability of more than 40 kilometers per hour equivalent
to M1, M2, M3 of the PNS 1891:2006
3:17 Three-Wheeled Vehicle (TWV) - refers to a motor vehicle with three wheels
‘symmetrically arranged in relation to the longitudinal median plane and with an
engine cylinder capacity (L5 category, PNS-UNECE 1891-2006).
Section 4. GUIDELINES AND REQUIREMENTS IN THE REQUEST FOR
CLASSIFICATION OF MOTOR VEHICLES PURSUANT TO SECTION 5
OF RA 8794 ON THE “RECLASSIFICATION AND NEW MODELS OF
MOTOR VEHICLES"
4.4 The following documents shall be submitte

2008-06 dated 05 March 2008 which reconstituted the TWG on Motor Vehicle
Classification created under Department Order No. 2006-0% dated 20 March
2006:

4.4.1 Letter— request;
4.1.2 Technical specification of the motor vehicle;
4.1.3 Photo of the vehicle submitted for classification;
4.1.4 For brand New and Completely Built-up Unit (CBU):42

41.4.a, Cerificate of Conformity (COC) fram DENR :
4.1.4.b. Vehicle Type ApprovabSystem test from the country of origin or
Vehicle Type Approval System test by DOTC-LTO if available;
and :
4.1.5 Customized Local Road Vehicle (CLRV) rebuilt and used imported motor
vehicles not covered by Executive Order No. 156 and pending aveilability
of Vehicle Type Approval System test at DOTC-LTO oF its designated
center shall present a valid CCES issued on a basis of CMVISC
The secretariat shall accept, evaluate and review the application and the
supporting documents as to their completeness and compliance:

An inter-agency deliberation on the application for motor vehicle classification
shall be conducted by the TWG on motor vehicle classification
Section 5. GUIDELINES AND REQUIREMENTS IN THE RECLASSIFICATION
ANDIOR REGISTRATION OF MODIFIED MOTOR VEHICLES
All modified motor vehicles either brend new or in-use may be subject of reclassification
and registration subject to the following:

a.change in vehicle type classification; .

A Certificate of Road Safety from the manufacturers/assemblers shall be

NOTE: For private electric motorcycles, indicate it LEV; For 4-wheeled motor
vehicles which are using alternatives fuels, indicate if LSV with its type.
5.2 The prescribed motor vehicle classification presentad in Section 6.1 hereof shail
+ be reflected in the MVIC inspection report and in the registration certificate
issued by the LTO and in the franchises issuéd by the LTFRS e.g. L4 mopeds,
Mt taxi, N14 truck for hire, 01 trailer.

Modified motor vehicle whether new or CLRV manufactured, assembled or
rebuilt shall be indicated in the Certificate of Registration issued by the LTO.

Section8. REPEALING CLAUSE
All issuances that are inconsistent in whole or in pert herewith are hereby superseded
andlor modified accordingly.
Section 9, EFFECTIVITY
This Order shall take effect fiteen (15) days following its publication in the Official
Gazette or in any newspaper of general circulation. :
