CONTRACT OF SUBLEASE

(FOOD CART)

KNOW ALL MEN BY THESE PRESENTS:

This CONTRACT OF SUBLEASE made and executed into this ________ day of
________________ 2014 by and between:

x, a sole proprietorship duly registered under the Philippine Laws with principal location
inside the D School, C Ave., Q City, hereinafter referred to as the “LESSOR”
-and-

________________________________________, a resident of the Philippines residing


at ____________________________________________________, hereinafter
referred to as the “LESSEE”

WITNESSETH: That-

WHEREAS, the LESSOR is the true, lawful and registered lessor of one unit situated at
D School Canteen.
WHEREAS, the LESSOR is willing to let and the LESSEE lease the area consisting of
approximately two point five square meter (2.5sq/m) by two square meter (2sq/m), for
the purpose of devoting the same to commercial endeavors;

NOW, THEREFORE, for and in consideration of the foregoing premises and the
conditions and stipulations hereinafter set forth, the LESSOR hereby leases unto the
LESSEE that certain unit described, under the following terms and conditions:

1. DURATION OF LEASE – The lease shall be for a period of ten (10) months from
June 2014 to March 2015 or at the remaining school year of the D School

2. RENTAL – for the full duration of the lease, the following terms and conditions
will apply:
a. The term of this lease is for the period commencing on June 2, 2014 and
expiring on March 15 2015. Thus, this contract is subject to renewal by both
parties only upon mutual agreement on the terms and conditions for said
renewal. If the parties fail to agree on the rental, this lease shall be
considered automatically terminated on its’ expiration date.
b. The monthly rental shall be EIGHT THOUSAND PESOS (Php.8, 000.00),
payable by the lessee in check payable to MR X. Payment of the rental shall
be made without necessity of demand, and without any delay.
c. For the full payment of the lease, the LESSEE shall issue monthly posted
dated checks stipulated as follows:

1. Upon signing the contract, payment of two (2) months deposit of SIXTEEN
THOUSAND PESOS ONLY (Php.16, 000.00) and a one (1) month/s advance
worth EIGHT THOUSAND PESOS ONLY (Php.8, 000.00), shall be given
accordingly. The two (2) months deposit can be used as security deposit. This
security deposit can be used if there are damages during the leased term and
this can be refunded after the leased contract has expired but cannot be used
as rental payment.

2. The security deposit will be refunded within SIX (6) MONTHS after the
expiration of the lease contract and shall not be used for payment of monthly
rentals

The Security Deposit shall be forfeited in favor of the lessor upon:


a. Cancellation of the agreement after the lessee have signed and confirmed
such proposal
b. Failure to occupy the base for the full term of the lease
c. Pre-termination of contract for whatever reason
d. Failure to comply with the agreement attached to this contract

3. USE OF LEASED PROPERTY – The LESSEE shall use the leased property and
premises principally for commercial purposes and shall in no way or guise devote
the same to the other uses or purposes without the prior written consent of the
LESSOR

4. CHARGES FOR UTILITIES – electricity will be sub-metered. Water billing will be


divided into the number of tenants for the leased area. (This is the six hundred
additional in your original rental fee.)
a. JANITORIAL FEES – janitorial fees shall be collected every Friday from
every tenant, worth FIFTY PESOS (Php. 50.00) for every Food
Concessionaires and THIRTY PESOS (Php. 30.00) for Food Carts per
day.
b. COMMON AREA – common area electricity consumption shall be
measured by the School’s electricity meter and would be divided to each
tenant sharing the area.

5. RIGHT OF ENTRY AND INSPECTION – upon due notice or announcement at


reasonable hours of the day, the LESSOR, through his/her authorized
representative or agent, shall have the right to enter and inspect the leased
premises to a certain compliance by the LESSEE of the terms of this contract

6. In case of death or incapacity of the LESSOR, all obligations of the LESSE shall
accrue in favor of or be made payable to the heirs of the LESSOR without any
need for judicial intervention.

7. If the LESSEE wishes not to continue within the leased term, such two (2)
months deposit will be forfeited.

8. If the LESSEE seeks not to continue his/her lease at the Diliman Preparatory
School Canteen, the LESSE is given three (3) days to settle their accountabilities
such as electricity and water usage and pull out of their properties/equipment.
Also, they have to pay the total lease payment for the full duration of the
lease contract. If after, they have not satisfactorily followed the given
allowance to settle their property and/or equipment will be stored at the
storage room and they will be charged an amount particular to the storage
fee.
IN WINESS WHEREOF, the PARTIES have hereunto affixed their respective signature
on the date and the place herein first mentioned.
