c o m m e n c e m e n t o f th e se ssio n (January 2019 to D ecem ber 2019) directly asking th e s tu d e n ts
an d g u ard ia n s o f d iffe re n t school and locality AND supply a copy o f such re p o rt to th e se n d e r of
th is le tte r w ithin th e tim e fra m e as stip u lated u n d e r relev an t clause o f th e Right to Inform ation
Act, 2005.
9. P le a se issu e o n e c irc u la r/o rd e r fro m y o u r g o o d office t o all t h e sch o o ls u n d e r y o u r good
ju risd ictio n cle arly m e n tio n in g th a t NO SCHOOL IS ENTITLED TO TAKE BACK THE FREE
TEXTBOOKS DISTRIBUTED TO THE STUDENTS AT THE END OF THE SESSION(BECAUSE THESE
ARE THE PROPERTIES OF THE STUDENTS ONLY AND ARE THEIR LIFETIME RESOURCE AND ALSO
THAT TAKING BACK SUCH TEXTBOOKS AT ANY EXCUSE IS ACTUALLY ULTRA-VIRES GOING
AGAINST THE PROVISION OF PROTECTION OFFERED TO THE STUDENTS UNDER THE
CONSTITUTIONAL LAW AS STIPULATED BETWEEN THE LINES OF THE RIGHT TO EDUCATION

It is needless to mention that the information -seeker is asking all the queries as mentioned above from
serial No 1 to 9 IN GREATER PUBLIC INTEREST and also that this reply may be annexed to a fc fca se that
may arise before the Hon'ble Court if illegal taking back of free textbooks from the students studying in
Govt-run/Aided/Sponsored etc all kinds o f schools in West Bengal is not stopped by issuance o f circular,
GO and active intervention from the Government authorities before the commencement o f the coming
academic session. Taking back o f free textbooks from the students is a general tendency as observed in
every district and locality o f the state which activity is bad in law and executed by most o f the schools.
Your jurisdiction also, is not an exception.
