Ethical and Legal Issues in Recruiting and Selection

‘Ethics is concerned with how we should live our lives. It focuses on questions about what is
right or wrong, fair or unfair, caring or uncaring, good or bad, responsible or irresponsible, and the like’
(Jaksa and Pritchard cited in Wilcox, p. 182).

An organizational or companies will be recruiting employees to increase their performances, and


there will be a selection to find the right people to the right job.

In recruiting and selection process must be fair, without look by the race, religion, sex and
gender. If someone have the capability and competences to work in a company, all of the ethical issues
should not allowed because everyone have the same opportunity to get job.

Nowadays sex and gender equality are one of the issues in recruiting and selection process.
Mostly companies still adjust sex and gender issues. Sex or gender discrimination often to happen to
women. Women are considered as inappropriate person. Sometimes companies underestimate women
in work situation. Women is identic with low or no power to do a job. But the company should respect
women to get a job, because all people in the world has the human rights.

Race and color discrimination still be issues in recruiting and selection. In America for the
example an organization or companies still looking for white skin people. For those people such as from
Africa that is had black skin, discrimination often to happen in recruiting and selection. In Indonesia,
Chinese people often to be target of discrimination. Indonesian people “pribumi” also often to be target
of discrimination by the Chinese peoples who lives in Indonesia.

Political affiliation issues also is the issues in recruiting and selection. Sometimes in interview,
the interviewer ask something about the political affiliation and expecting to be answer by the same
political affiliation from the companies. For the peoples who answer different from the company desire,
sometimes they will be not accept to work or get a job in that company.

Disability or medical condition discrimination often to happen in recruiting and selection. The
people with disabilities are protected by the Disability Discrimination Act 1995. But in reality nowadays
in recruiting and selection, the company often not accept the people who had disability.

Age is one of the issues in recruiting and selection. Sometimes a company underestimates young
peoples who has little experience in work, but sometimes the company awards the young people by the
spirit and power to do a job. For old peoples, company awards them because of the experience, but
sometimes the company look the old peoples with low power to do a job.
HIV and Aids issues. Sometimes in recruiting and selection, the company underestimates
peoples with HIV and Aids and not accept their in work. But peoples with HIV and Aids are the same
with other people who has same opportunity in life to get a job.

Sometimes in recruiting and selection, the company do not accept pregnant women because of
her pregnancy.

Religion also is the issues in recruiting and selection. We cannot denied that religion is very
sensitive issues, If the person in interview tell about their religion, and the interviewer are has different
religion, sometimes they will reject the new applicant.

Ethnicity or national origin issues. In recruiting and selection there is discrimination to the new
employee applicant because of their come from particular country and former country.

There are so many issue that can influence in recruiting and selection. Companies should be fair
in order to find the right people in the right position. In reality all factor in recruiting and selection
depends on the needs of the company. Every company had their own rules and procedure in recruiting
and selection. They try to find the right people to work in their company.

Legal issues occurs when the company searching new employees, generally the company should
and must avoid any participating in any kind of legal or ethical issues in recruiting and selection process.
The company should to respect the human rights to be succeed because, when companies be fair, they
will get the qualified employees to work in their companies. If the employees had the qualified to be
work in companies, it is mean that the employee has the competencies and skill to increase the
performance of the company that they work. It will better to companies to develop the employees to
increase skills that companies needs and wants, than to give the work for the people that do not had
competencies because nowadays peoples compete to increase their own skills in order to get a job.
