CITY OF WOODBURY, GEORGIA SHELTER IN PLACE ORDER WHEREAS, the President of the United States declared a National Public Health Emergency on March 13, 2020; and WHEREAS, the Governor ofthe State of Georgia declared a State Public Health Emergency on March 14, 2020 and urged “local officials to do what’s inthe best interests of their communities to keep people safe and stop the spread of coronavirus” on March 19, 2020; and WHEREAS, the World Health Organization has declared Coronavirus Disease 2019 (COVID- 19)a world health emergency and a pandemie; and WHEREAS, the number of confirmed cases and deaths from COVID-19 is escalating rapidly, internationally, nationally, and locally; and WHEREAS, based upon the experience of other local governments in Georgia, a growing number ‘of other cases are likely to occur, and WHEREAS, on March 16, 2020, the Center for Disease Control (CDC) and the President ofthe United States stated that any gathering of over 10 people should be discontinued or prohibited; and WHEREAS, public health experts, including those at the CDC and the National Institutes of Health (NIH), have advised that individuals infected with COVID-19 are contagious even while ‘experiencing minor or no symptoms and implored leaders to take immediate action w prevent further community spread of COVID-19; and WHEREAS, preventing and slowing community spread of COVID-19 provides health systems ditional time to obtain personal protective equipment necessary to protect health care workers ‘and medical equipment necessary to teat COVID-19, and is therefore vital to the health of the nation; WHEREAS, in the judgment of the Mayor and City Council, as ofthe date of this Order, there exist emergency circumstances as a result of COVID-19 within the geographical boundaries ofthe ‘Woodbury Charter requiring extraordinary and immediate corrective actions forthe protection of the health, safety, and welfare of the citizens of Woodbury and the surrounding communities, and WHEREAS. to prevent or minimize injury to people resulting from this pandemic, the Mayor and City Couneil finds that certain actions are required, including but not limited to, the social distancing measures set forth herein; WHEREAS, pursuant to Article 1 Section 9 ofthe Charter ofthe City of Woodbury, the ‘Mayor and City Council have the right, duty, power, privilege and authority to exercise and enjoy all other powers, duties, functions, rights privileges, and immunities necessary and proper to promote or protect the safety, health, peace, security and general welfare of said government and its inhabitants and to exercise all implied powers necessary to cary into execution all powers granted in this Chater as fully and completely as if such powers were fully enumerated herein and to do and perform all ofthe ects pertaining to its property, affairs and local government which are necessary or proper inthe legitimate exercise of its comporate powers and governmental duties and funetions; and WHEREAS, pursuant to 0.C.G.A. Sec. 38-3-28, the Mayor and City Council is authorized to ‘make, amend, and rescind orders, rules, and regulations as necessary for emergency purposes ‘and o supplement carrying out the emergency management laws, and WHEREAS, pursuant to 0.C.G.A. Sec. 38-3-51, the Governor's declared public hnealth emergency authorizes the Mayor and Council to use emergencies powers in O.C.G.A. Sections 38-3-1 through 383-64; and WHEREAS, pursuant to 0.C.G.A, Sec. 38-3-6, during an emergency, 0.C.G.A. Sections '38-3:1 through 383-64 are supposed to be liberally construed to effectuate their purposes; and WHEREAS, it isthe desire ofthe Mayor and City Council to provide for declarations of emergencies, the powers to be implemented asa result thereof and to provide for measures to address the state of emergency declared by the Mayor and City Couneil on March 19, 2020 Now, Therefore, the Mayor and City Council forthe City of Woodbury hereby orders and ‘ordains the following: (@) All individuals currently living within the limits ofthe City of Woodbury, ‘Georgia (the “City”) shall shelter at their place of residence. To the extent individuals are using shared er ouldour spaces, dhey musta ul imes as reasonably possible ‘maintain social distancing of at least six feet from any other person when they are their residence. All persons may leave their residences only for Essential ‘Activities, Essential Travel, Essential Governmental Functions, oto operate Essential Businesses, all as defined in this Order. A curfew is imposed from 9:00 p.m. until 6:00 am. and {from 8:00 p.m. until 6:00 am. for minors whereby ll citizens are to beat their place of residence, (© All businesses with a facility in the City shall, except Essential Businesses as defined below, are required to cease all activities at facilites within the City of Woodbury except Minimums Basic Operations as defined in below, including religious, civic and social organizations. or clarity, businesses may also continue operations consisting exclusively of employees or contractors performing activities at their own residences (ie., working from home). All Essential Businesses are strongly encouraged to remain open. To the greatest extent feasible, Essential Businesses shall comply with Social Distancing Requirements as defined below, including, but ‘not limited to, when any customers are standing in line. (6) All public and private gatherings of any number of people occurring outside a household or living unit are prohibited, except fr te limited purposes as expressly permitted below. Nothing in this Order prohibits the gathering of members living in the household or living unit, 1) Forthe purpose ofthis order Essential Business means: Healthcare Operations and Essential Infrastructure Grocery Stores, supermarkets, food banks, convenience stores, liquor stores and other establishments engaged inthe retail sale of food including pet supplies and any other household consumer products (such as cleaning and personal care products); Food Cultivation including farming, livestock and fishing; Businesses that provide food, shelter, and social services and other necessary needs; Newspapers, television, radio, and other media services; Gas stations and auto-supply, auto-epair and related facilites; Banks and related financial institutions; Hardware stores and lodging institutions; Plumbers electricians exterminators and other service providers who provide ‘services that are necessary to maintaining the sefety, sanitation and essential ‘operation of residences, and Essential Businesses and Essential Activities; Business providing mailing and shipping services; Restaurants and other facilites that prepare and serve food, but only for delivery or eary out; Businesses that supply products needed for people to work from home; Businesses or manufacturers that supply other essential businesses withthe support or supplies necessary to operate; Businesses that ship or deliver groceries, food, goods, or services directly to residences; Home-based care for seniors, adults, or children; Residential facilities including hotels, motels, shared rental units and similar facilites and shelters for seniors, adults, and children; xvii, Professional services, such as legal, accounting services, real estate services, ‘when necessary to assis in compliance with legally mandated activities; xviii, Utility, water, sewer, ga, electical, oad maintenance and transportation and telecommunications systems 2) For purposes of this Order, individuals may leave their residence only to perform any of the following “Essential Activities.” But people at high risk of severe illness from ‘COVID-19 and people who are sick are urged to stayin their residence tothe extent possible except as necessary to seek medical cae. i, Toengage in activites or perform tasks essential to their health and safety, orto the health and safety of their family or household members or partners or significant others including, but not limited to, pets), such as, by way of example only and without limitation, obtaining medical supplies or medication, visiting & hhealth care professional, or obtaining supplies they need to work from home. ji, To obtain necessary services or supplies for themselves and ther family or hhousehold members, o to deliver those services or supplies to others, such a, by ‘way of example only and without limitation, eanned food, dry goods, fesh fruits and vegetables, pet supplies, fresh meats fish, and poultry, and any other household consumer products, and producte necestary to maintain the safety, sanitation, and essential operation of residences. iii, To engage in outdoor activity, provided the individuals comply with Social Distancing Requirements as defined in this Section, suchas, by way of example and without limitation, walking, hiking, running or bicycling. iv. To perform work providing essential products and services at an Essential Business or to otherwise carry out activities specifically permitted in this Order. ¥. Tocare fora family member or pet in another household. 3) For purposes of this Order, individuals may leave thei residence to work for or obtain services at any “Healthcare Operations” including hospitals, clinic, dentists, pharmacies, ‘pharmaceutical and biotechnology companies, other healthcare facilities, healthcare suppliers, home healthcare services providers, mental health providers, or any related andor ancillary healthcare services. “Healthcare Operations” also includes veterinary care and all healthcare services provided to animals. This exemption shall be construed broadly to avoid any impacts to the delivery of healthcare, broadly defined. “Healthcare Operations” does not include fitness and exercise gyms and similar facilities. 4) For purposes ofthis Order, individuals may leave their residence to provide any services ‘or perform any work necessary to the operations and maintenance of “Essential Infrastructure,” including, but not limited to, public works construction, construction and all related activities, water, sewer, gas, electrical, roads and highways, public ‘transportation, solid waste collection and removal, internet, and telecommunications systems (including the provision of essential global, national, and local infrastructure for computing services, business infrastructure, communications, and web-based services), provided that they carry out those services or that work in compliance with Social Distancing Requirements as defined this Order, to the extent possible 5) For purposes of this Order, all frst responders, emergency management personnel, ‘emergency dispatchers, court personnel, and law enforcement personnel, and others who need to perform essential services are categorically exempt from this Order. Further, nothing inthis Onder shall prohibit any individual from performing or accessing “Essential Governmental Functions,” as determined by the governmental entity performing those functions. Each governmental entity shall identify and designate appropriate employees or contractors to continue providing and carrying out any Essential Governmental Functions. All Essential Governmental Functions shall be performed in compliance with Social Distancing Requirements as defined inthis Order, to the extent possible. 6) For the purposes ofthis Order, covered businesses include any for-profit, nonprofit, oF private educational entities, regardless ofthe nature of the service, the function they perform, or its corporate or entity structure. 17) For the purposes ofthis Order, “Essential Travel” includes travel for any ofthe following purposes, Individuals engaged in any Essential Travel must comply with all Social Distancing Requirements as defined in this Section below: i. Any travel related to the provision of or access to Essential Activities, Essential Governmental Functions, Essential Businesses, or Minimum Basic Operations. ii, Travel to care for elderly, minors, dependents, persons with disabilities, or other vulnerable persons. iii, Travel to or ftom educational institutions for purposes of receiving materials for distance leaming, for receiving meals, and any other related services. iv, Travel to retum to a place of residence from outside the jurisdiction v. Travel required by law enforcement or court order. vi, Travel required for non-residents to retum to their place of residence outside the County. Individuals are strongly encouraged to verify that their transportation out of the County remains available and functional prior to commencing such travel 8) For purposes ofthis Order, “Social Distancing Requirements” includes maintaining at least six-foot social distancing from other individuals, washing hands with soap and ‘water for atleast twenty seconds as frequently as possible or using hand sanitizer, covering coughs or sneezes (int the sleeve or elbow, not hands), regularly cleaning high- touch surfaces, and not shaking hands, Enforcement and Remedies ‘Individuals: In recognition that the City of Woodbury does not have the personel or resources to monitor and police distancing or gathering limitations or shelter in place requirements for all individuals eurently living within the territorial limits of the City, the City of Woodbury Police Department and other departments ofthe City as deemed necessary by the Mayor and City Council ate authorized to support compliance with this Order through information delivery and education of individuals regarding the imminent threat to public health posed by COVID-19. '. Covered Businesses: Any violations of this Order by covered businesses shall be considered Order violations subject to the general penslty provisions outlined in the Code ‘of Ordinances for the City. Effective Date ‘This Order shall become effective 9:00 pm. March 24, 2020 and will continue to be in cffect until 11:59 pxm. on April 6, 2020, ot until iis extended, rescinded, superseded, or amended in writing by the Mayor and City Council Public Ne Copies of this Order shall promptly be: (1) made available at City Hall for the City of ‘Woodbury; (2) posted on the City of Woodbury's website; and (3) provided to any member of the public requesting a copy ofthis Order. Validity of Provisions If any provision ofthis Order tothe application thereof to any person or circumstance is held to be invalid, the reminder ofthe Order, including the application of such part or provision to other persons or circumstances, shall not be affected and shall continue in full forve and effect. To this ‘end, the provisions ofthis Order are severable Severability (@) Itis hereby declared to be the intention of the Mayor and City Council that all sections, paragraphs, sentences, clauses, and phrases ofthis Order are and were, upon their enactment, believed by the Mayor and City Council to be fully valid enforceable, and constitutional. () Ih is hereby declared to be the intention ofthe Mayor and City Council tha, tothe greatest extent allowed by law, each and every section, paragraph, sentence, clause or phrase of this Onder is severable from every other section, paragraph, sentence, clause or phrase ofthis Order. Itis hereby further declaed tobe th intention of the Mayor and City Council that, to the jreatest extent allowed by law, no section, paragraph, sentence, clause or phrase of this Order is ‘mutually dependent upon any other section, paragraph, sentence, clause or phrase of this Order. (©) Inthe event that any phrase, clause, sentence, paragraph or section ofthis Order shall, for any reason whatsoever, be declared invalid, unconstitutional or otherwise unenforceable by the valid Judgment or decree of any court of competent jurisdiction, itis the express intent of the Mayor ‘and City Council that such invalidity, unconsttutionality or unenforceability shall tothe greatest extent allowed by aw, not render invalid, unconstitutional or otherwise unenforceable any of the remaining phrases, clauses, sentences, paragraphs or sections of the Onder and that, to the ‘greatest extent allowed by law, all remaining phrases, clauses, sentences, paragraphs, and sections of the Order shall remain valid, constitutional, enforceable, and of full force and effect. soorpanen 24” dayot Qaceh 2020 Var GEORGIA MAYOR, Steve Ledbetter , Angela Fowler
