DHANAPALAN NATIONAL MOOT COURT COMPETITION 2019 ——ee MOOT PROPOSITION Son of the Soil Association Versus Union of Sindia The Union of Sindia is the second largest populated country in the world, having gained independence in the last century, the growth of the nation is marvelous enough, being the second largest growing economy and the youngest nation in the world, The country is the largest market in the world and one of the top to supply human resource to other countries. The country has since its inception been known as a humanitarian nation being active in all human rights oriented initiative in the world. In 2018, UN rated Sindia as third most humanitarian nation in the world which made way for several international investment thus boosting its economy and UN declared Sindia as the host for UN humanitarian Summit to be held in April 2019. The country is located in the south east of Asia and shares its border with many countries including Punyadesh,A fanistan,Balistan, Punyadesh which is located in the east of Sindia sharing borders with seven of its states with large borders with two states namely Allam and ‘West Salami. The international borders in these two states are mostly riverside area and forest. ‘The borders in these two states are fragile to manage as it comprises of land and river Jalnath running in between. Sindia helped in the liberation of Punyadesh from Balisthan in 1971 and since then both the nations have stood for each other at International front. Since inception, Punyadesh has severe problems such as high density of population, poverty, unemployment and frequent floods, inter and intra religious clashes based on linguistic grounds, Punyadesh has religious composition of Muslims comprising 80% of its 30 crore population and Hindus, Christains , Buddhist being minorities. Out of 80 % Muslims , 72% are Puniya speaking and others are Hindi speaking Muslims. ‘The State of Allam was created in 1950 as a separate state of Sindia and it comprised of major ethnic groups namely Allamese comprising 60% of population. Other 40 percent comprised of Puniya, 30% which also is a dominant language of neighbouring Muslim State Punyadesh, 8 % indigenous population of Kinvi speaking people. Hinduism remained religion of 60% people. In 1981, there was a sudden increase in the population of the state of Allam by 35 % as per census of the nation , whereas the annual population growth of the nation was 22%. In 1979 a major flood affected the neighbouring nation Punyadesh and again flood occurred in 1985 and 2003 in the river Jalnath. Since the 1979 flood and the release of 1981 census of Sindia there were allegation of illegal migration from the neighboring Punyadesh. In 1991 a major public uprising started in state of Allam after census report released stating that population grew by 40% again and 50 % increase in number of voters. The situation went beyond control therefore the centre that is National Peoples Alliance led by Sindian Congress signed an accord with the state Student’s union to make a National Register of Citizenship for the state of Allam taking 1991 as the cutoff year. —. DHANAPALAN NATIONAL MOOT COURT COMPETITION 2019 ——ee The first NRC draft was released in 1994 where 40 lakhs were identified as illegal migrants and were shifted to camps as the Punyadesh refused any illegal migration from their country which made it impossible to compulsorily deport them leading to questioning by international and regional human rights agencies With frequent floods and other issues in Punyadesh the illegal migration continued, Frequent demand was made by state of Allam to protect the borders, though Border Security Force was deployed the issue kept on augmenting as the riverside borders were too delicate to handle. In 2011, the census revealed that the population of state of Allam increased by 50% , the Allamese people number reduced to 52 % of the total population and Puniya population increased 10.43% . Lot of allegation and news of causes of migration came like communal clash against minorities in Punyadesh, Public beating of Puniya people, discrimination ete were common in the state of Allam, which were continuously questioned by Human Rights activist. Son of the Soil Association and other associations were prominent in organizing public movements against Punyadeshis. [legal migrants taking up the resources and employment opportunities of the local Allamese were reported in newspaper. The unemployment rate of State of Allam increased to 30% . Apart from this the migrants versus natives became a Hindu vs, Muslims issues. The Allam State Congress party came to power in 2014 election. In 2015 due to pressure the National Peoples Alliance at centre and with regional ruling party one of its ally opened the NRC and updated it, wherein 50 lakh people were identified as illegal migrants. In 2017, parliamentary election Democratic Peoples Alliance led by All Janata Party won with huge majority. In December 2017 the PM of Sindia as a first major international initiative signed the Convention on the Reduction of Stateless of 1961 and became a party to it. In 2018, the central legislation passed an amendment in the Citizenship Act 1955 wherein following changes have been made as follows: Sec 6AA has been inserted in the act which says 1). The state shall provide citizenship to illegal migrants from Punyadesh,Afanistan, Balistan who have migrated to Sindia on or before 31" December 2018 except Puniya speaking Muslims illegal migrants from Punyadesh, PROVIDED they are resident of Sindia for 6 years continuously in order to maintain international relations and human rights obligation under international instruments. 2) illegal migrants from Punyadesh,Afanistan, Balistan, except Puniya speaking Muslims illegal migrants from Punyadesh, shall be a) Exempted rom provisions of passport (shall be Sindia) Act, 1920. An act, which mandates foreigners to carry passports b) Exempted from the application of the provisions of the Foreigners Act, 1946, by the Central Government. — A 03} @r contrat Sav €ottege Prof. R.V. DHANAPALAN NATIONAL MOOT COURT COMPETITION 2019 ——ee 3) The provision shall remain in force for granting Citizenship till 31" Dec of 2021 until repealed earlier by the parliament. Provided all provision in any law contrary to this section shall remain inoperative till the section is in operation to the extend needed to accomplish the purpose of this section 6 AA. Provided the Parliament shall extend the provisions for a further period if needed: ‘The amendment came into force on 31" Dec 2018. After that agitation started in the Union of Sindia often leading to violence especially in the state of Allam which shares larger border with Punyadesh and which is likely to get affected the most. The agitation were done stating the act as “Anti- Allamese” Act. Son of the Soil Association and many Allamese people referred the Act as political play for attracting vote banks in 2019 Assembly election by DPA, whereas it received huge welcome among the Human right activist . Uprising and protest rose in Allam asking for repealing of the act and stating illegal migration as threat to life of local people , national resources and burden on the nation. With the situation being so terrific the Son of the Soil Association , a prominent association of native Allamese people with many top Allamese Ministers and Businessman as members filed a PIL in the Supreme Court questioning the validity of the Amendment act. The case is filed against the Union of Sindia alleging amendment Act 2018 as discriminatory and prejudiced to the interest of its citizen for the sake of illegal migrants, whereas the External Affairs Ministry of Union of Sindia gave a press release stating that to keep up the international human rights and peace in the state alone the act have been passed. The case is posted for argument before the Honorable Supreme Court of India. 1. Whether the PIL filed by “Son of the Soil Association” seeking interference of Supreme Court is maintainable? 2. Whether the citizenship to illegal migrants on par with other migrants upholds Art 21 and other international human rights obligation of the State? 3. Whether the amendment act violates fundamental rights of the citizen thus ultra vires of the constitution? Note: The laws of Sindia are in pari materia with laws of India. —. The Central Law College National Law Moot court competition has been conceived with the aim of creating opportunities for learning and development of jurisprudence onemerging trends in Law and develop aims to cutting edge skills in research, writing and advocacy. b. Further, itis aimed to facilitate the evolution of the jurisprudential analysis of the laws and consequential emergence of new laws. I.VENUEAND DATE 15 — 17th March 2019 College Campus The Central Law College Yercaud Main Road, Kannankurichi, Salem Tamil Nadu- 636008. II. LANGUAGE ‘The competition proceedings shall be only in English language. IILELIGIBILITY Participation is restricted to bonafide undergraduate students of 5 years/ 3 years LL.B. programme of any University/College/Institution (recognised by the Bar Council of India). IV.TEAM COMPOSITION Each Institution participating in the competition shall send a team consisting of two Speakers and one Researcher. Team shall not disclose their identity or that of their institution or city, ete. Such disclosures will invite penalties including disqualification. The decision in this regard shall be at the discretion of the Moot Committee. V.DRESS CODE » For Boys- Formal dress code of Black Pant, White Shirt with Black Blazer. » For Girls- Black Pant, white shirt with Black Blazer or white chudithar suits with black blazer or white saree with white blouse and black blazer. ISTRATION » The Registration shall be restricted to 20 teams on first come first serve basis. > Only one team is allowed from each participating institution, v Filled in scanned copy of Registration form and the scanned copy of D.D. shall be sent by email to the given ID: clenationalmoot2019@gmail.com on or before 15.02.2019. VILORIENTATION ‘There will be an Orientation Program for all the participants on 15th March 2019 followed by a draw of lots. Team codes and side will be allotted during the orientation only. And the fixtures will be decided therein, A. ROUNDS 1.There will be two preliminary rounds of arguments, a quarter final round, a semi- final round anda final round. The top 8 teams from the preliminary rounds shall qualify to participate in the Quarter Finals. Winners of the Quarter-Finals will proceed to Semi- Finals. Winners of the Semi-finals will qualify for the Final Round. 2.The team shall argue cases against each other. For the said purpose, fixture of team will be decided by draw of lots prior to the commencement of the competition i.e. on 15"March 2019 at the College premises. B. PRELIMINARY ROUND 1.There will be two preliminary rounds of arguments per team, once as Petitioner and Respondent each. 2.No team will face each other for more than once in the preliminary rounds. 3,Preliminary Rounds will be held on concern date. 4,Top 8 teams from the Preliminary Rounds will advance to the Quarter-Final round. The basis of selection will be decided follows: i.Win in both prelims with aggregate points in both rounds, ii,0ne Win and adding Aggregate raw points in both rounds, iii, Team with maximum Aggregate raw points in both rounds, and iv.Team with maximum aggregate marks reducing Memorial marks (in case of tie) —. DHANAPALAN NATIONAL MOOT COURT COMPETITION 2019 ——ee v the criteria (ii) will be applied only when teams for quarter final couldn’tbe shortlisted as per criteria (i) in addition to team qualified under criteria (1) criteria (iii) will apply when required teams for quarter-final couldn’t be obtained under criteria (i) and (ii) respectively, in addition to team qualified under criteria (i) and (ii) Memorial marks will be added to the scores of all the rounds. QUARTER -FINALROUNDS During the Quarter - Final rounds, the team will be required to argue either on behalf of the Petitioner or the Respondents. The teams to argue on a particular side will be decided by a draw of lots prior to the commencement of the Quarter final rounds In the Quarter- Final Rounds, each team will be allowed 25 minutes to argue. The division of time between the two speakers is left to the discretion of the team. In addition to the 25 minutes time allotted for arguments, 2 minutes will be provided for Rebuttals and 2 minutes will also be given to the opposite team for Sur-Rebuttal The Quarter-final round will be a knockout round with a win enabling a team to get into the Semi-finals. Memorial scores will be added to the oral scores for this round where in the total scores will be 100 marks. SEMI-FINALROUNDS During the Semi- Final rounds, the team will be required to argue either on behalf of the Petitioner or the Respondents. The teams to argue on a particular side will be decided by a draw of lots prior to the commencement of the Semi -Final rounds. Inthe Semi-Final Rounds, each team will be allowed 30 minutes to argue. The division of time between the two speakers is left to the discretion of the team. In addition to the 30 minutes time allotted for arguments, 2 minutes will be provided for Rebuttals and 2 minutes will also be given to the opposite team for Sur-Rebuttal The Semi-Final round will be a knockout round with a win enabling a team to get into the Finals. During the Final round, the team will be required to argue either on behalf of the Petitioner or the Respondents. The teams to argue on a particular side will be decided by adraw of lots prior to the commencement of the Final Round. a. In the Final Round, each team will be allowed 45 minutes to argue. The division of time between the two speakers is left to the discretion of the team. In addition to the 45 minutes time allotted for arguments, 2 minutes will be provided for Rebuttals and 2 minutes will also be given to the opposite team for Sur-Rebuttal. b. The winner of the Final Round will be declared as the Winner of the Moot Court Competition. Memorial scores will be added to the oral scores for this round. c. Participating team will be required to strictly follow the time limits forall the rounds. VIILRESULTS Results of the preliminary rounds shall be announced after the completion of rounds of all the teams. Similarly, the results of the Quarter-Final/Semi-Final Rounds shall be announced after completion of the rounds. The results of the Final Round shall be announced in the Valedictory Ceremony. Attendance of all participants are mandatory onall three days including valedictory. IX. MEMORIALS 1. All the teams are required to submit Memorials/Written submissions for both the petitioner and the respondent. 2. One advance hard copy of memorials (both Petitioner and Respondent) along with the Soft Copy of the memorials from both the sides in word format (*.doc or *.docx) in a CD must reach the host institution (address of our college) for evaluation by 8° March 2019 before 3.00 p.m. No excuses in respect of delayed post services shall not be entertained. The memorials should be sent to the postal address through speed post only. 3. Late submission of soft copy or hard copy or both of the Memorials will be penalized by 2point forevery day. 4. Each team shall submit 5(five) hard copies of memorials, each for the Petitioner and Respondent, Names of the participants or their institutions or any kind of identification mark should not appear on any part of the Memorials. Five copies of the memorials shall be submitted during the desk registration at 3.30 pm on 15"March 2019 at THE CENTRAL LAW COLLEGE ,SALEM, TAMIL NADU. Acovering letter must be enclosed with the memorial (hard copy) specifying the name ofthe college/university of the participating team 6. Participants are advised to carry extra copies of their Memorials for their own use. The copies submitted to the organizer would be for the purpose of evaluation of memorial and for the use of judges of the competitions and will not be returned to the participants. 7. After the completion of the competition, the organizers shall reserve the right to use the memorials submitted by the participating teams, as they may deem appropriate i) The memorials should not exceed 25 typed pages (excluding front and back cover page) ii) The font and size of the text of all part of the memorial must be in Times New Roman. with font size 12 . DHANAPALAN NATIONAL MOOT COURT COMPETITION 2019 ——ee X-B- Evaluation: a) Each Memorial will be evaluated for 10 marks (for each side ) and the Team memorial marks will be the memorial mark of the petitioner/respondent as per their position in the case. b) Memorials will be adjudged by a special panel of Judges. The following will be the Evaluating Criteria and the marks will be allocated to each category as given below: 1. Knowledge of Facts = 10 Marks 2, Factual Analysis - 10 Marks 3. Knowledge of Law - 15 Marks 4. Use of Authorities and Citations = 10 Marks 5. Skill of Advocacy = 15 Marks 6. Language& Style - 10 Marks 7. Clarity, Brevity and Ingenuity - 10 Marks 8. Court Manners - 10 Marks 9. Memorials = 10 Marks TOTAL - 100 Marks X. AWARDS AND PRIZES: Awards and cash prizes for the Moot Court Competition are as follows: 1. Winners of the Moot Court Competition will be awarded with a Winner’s Trophy, mementos for team members and a Certificate of Merit. 2. The Runners-up team will be awarded with a Trophy, mementos for team members anda Certificate of Merit. 3. Best Student Advocate will be awarded a Trophy and a Certificate of Merit. 4. The Best Memorial Award (highest aggregate marks of both memorial), the Researcher will be awarded with a Trophy anda Certificate of Merit. 5. Each participant in the Moot Court Competition will be awarded a Certificate of Participation. Prizes and certificate shall be issued only in Valedictory and to the concerned participant only, therefore attendance is mandatory. Host institution shall not be responsible for their Certificates in case of absence. Xi. SCOUTING: 1, Teams will not be allowed to observe the oral argument of other teams. Scouting is strictly prohibited. 2. The Researcher shall sit with speakers of his/her team at the time of oral arguments, but shall notattend the court session of any other team. Further, the participants are strictly prohibited from contacting the framer of the moot proposition. Any attempt to do so will result in an immediate disqualification of the entire team XILHOSPITALITY: 1. Accommodation will be provided to the members of the team, restricted up to three only, from 12:00 pm on 15*March 2019 up to 12.00p.m on 18*March 2019. 2. Food and other facilities will be provided to the members of the team. Food will be provided from the dinner on 15" March 2019 upto the lunch on 17" March 2019. 3. Local Conveyance (transport between the accommodation and the Competition venue) to the participating teams will be provided by the Organisers. 4. Also, Pick up on 15" March 2019 arrangements will be made available only on request by the participants The Teams are required to report on 15" March 2019 at 3:00 pm at the THE CENTRAL LAW COLLEGE ,SALEM for the Briefing Session and Desk Registration during which Team codes will be given and Fixtures will be made (by lot). Participants must submit their memorials (5 sets) at the time of registration.
