 TERMS AND CONDITIONS OF RENTING A CAR
DECLARATION:
I 0 hereby declare that all the
information provided above is true to the best of my knowledge. I understand and accept that only
authorised driver(s) are allowed to drive the car and any unauthorised driver will void and terminate the
contract immediately without any refunds. In Addition, i understand that i am not authorised to subhire
the car. I accept to pay KES 150,000 as penalty for allowing an unauthorised driver to drive or for sub-hiring
the car to a third party.
UNLESS I have purchased an Excess Waiver OR the car is being driven by a driver who is an employee or
contracted to me by Hire N Drive (K) LTD, I am liable to the company for the minimum sum of KES 150,000
and a maximum sum of 10% of the current insured value of the motor vehicle which shall constitute and
cover the entire cost of loss of opportunity/income, the cost of insurance excess if any, the cost of towing
and any other incidentals incurred due to accidental damage, write-off, or theft. This is notwithstanding
whether I am to blame for the accident/theft or not.

I understand and accept that the excess waiver is payable on demand. Even when I have purchased
Insurance excess cover independently, I will reimburse Hire N Drive (K) Ltd in full and Hire N Drive (K) Ltd
will assist me with all the required documents for me to make a claim to my insurer(s)

If the damage to the car is less than the minimum payable excess, I accept to pay for the cost of repairs at a
garage approved by Hire N Drive (K) Ltd plus an additional cost of loss of business which will be equivalent
to the daily rental rate multiplied by the number of days that the car will be in the garage.

I will not use the car for criminal activity; illegal businesses; nor carry unauthorised number of passengers,
goods, illegal drugs, illicit alcohol; nor perform stunts with the car; nor tow other cars; nor use it to carry
fare paying passengers. If this happens I accept to pay the amount that is equivalent to the current insured
value of the car without question or argument.
I accept the following terms
1 The vehicle remains the property of Hire N Drive (K) Ltd and or its car rental partners.
2 No authority to conduct repairs or variations without prior written permission.
3 Any damage to the car, tyres, windscreen, mirrors or underside will be charged at the current
market rate and performed at a garage that has been approved by the company.

4 No refunds for early termination of contract. No refunds incase of an accident.

5 In the event of an accident or breakdown I am entited to a replacement car immediately and not
later than 12 hours within Kenya and 24 hrs in East Africa.

6 The dispatch form as marked during pickup shall be used as the reference for assessing damages to
the vehicle.

7 I will inform the company of any penalties, fines or liens by reason of breach of any traffic laws, by-
laws or any other regulations by any competent authority acquired and settled or unsettled during
the duration of the rental.
8 The company is not liable to meet any claims in respect of death, bodily injury or any physical,
psychological or any other harm of persons using, in or upon entering alighting, or carried in the
vehicle.
9 Any repairs that have not been authorised will be charged. Minimum sum chargeable is KES 75,000
for unauthorised repairs and a maximum of the entire insured value of the car. This will be
determined by the damages assessed not later than 48 hours after return of the car.
