Rest day- a period of not less than 24 consecutive hours

In a week, there should be at least one whole day of rest day.

Who determines the rest day? General rule: The employer.

Exceptions:

1. Part of the CBA provisions.


2. When the Secretary of Labor issued a rules and regulation concerning the rest day of a company
in cases of economic problem or crisis.
3. Employees’ preference based on religious grounds

What if there is no agreement? And the employer justified that there will be a loss. Example the rest day
chosen is TH, and not agreed upon, solution is two TH in a month but other week shall be other days

Emergency attendance on rest day-

Service Incentive Leave- 5 day leave with pay for every employee who rendered a year of service. Not
necessary to be continuous employment since there are regular seasonal workers. Even part time
workers are entitled to service incentive leave. Once the number of months is covered already. Not all
are covered. Example: GOCCs, managerial, field personnel.

If service incentive leave is not used then it shall be converted to monetary pay

SIL does not expire. It is accumulated. One is not forced to leave para magamit ang SIL

If employed less than a year, SIL shall be pro-rated

The company is not bound to give vacation leave. If an employee is given a similar benefit such as SIL.

Maternity Leave Benefit- a female member given 105 days

1. Notify employer of pregnancy


2. Payment shall be advanced by the employer
3. Employer must paid at least 3 months
4. First 4 deliveries
5. SSS must reimburse the employer of the 100% of the amount of employee benefits
6. Must be employed by the employer
7. Not convertible to cash

Paternity

1. Legally married
2. Private/ public
3. First 4 deliveries of legitimate spouse with
