That in Accordance With Resolution 181 of 2019, the ANE has Allocated the
frequency band 698 to 806 MHz to the land mobile service on a primary basis
which, in the valuations of coverage advantages, is identified as a great tool to
Provide Wireless Broadband to services with rural areas and low population
density at an efficient cost.
Auction for 750MHz focused in price and coverage; and 1900Mhz and 2500MHz
focused just in price.
The validity of the permit for the use of the radio spectrum in the blocks
assigned according to the procedure modified in this Resolution, for the 700
MHz, 1900 MHz and 2500 MHz frequency bands, shall be twenty (20) years
counted from the moment of signature of the particular administrative act of
assigning respect for the permission of use of the radio spectrum. The effective
exercise of the use permit is subject to the approval of compliance guarantees
and non-contractual civil liability, the registration or modification of the Single
ICT Registry, according to the application in each case, and the initial payment
of the monetary consideration due .
This auction grants Permits for the use of the radio spectrum at the national
level for the following frequency ranges:
1.700 MHz Band: 703 MHz to 748 MHz paired with 758 MHz to 803 MHz.
2.1900 MHz Band: 1865 MHz to 1867.5 paired With MHz 1945 MHz to 1947.5
MHz.
3.2500 MHz Band: 2500 MHz to 2525 MHz paired with 2620 MHz to 2645 MHz,
and 2540 MHz to 2555 MHz paired with 2660 MHz to 2675 MHz.
Incoming or non-low band operators, who are allocators of the spectrum in the
700 MHz band within this objective selection process, an incentive will be
applied for the coverage offered in the locations of Annex IV of this Resolution to
which forced as a result of the assignment in this frequency band. The incentive
will be that the operators object of this article will only pay 10% of the value of
the consideration for the use of the spectrum in those new point-to-point links
that are part of the first jump of the base stations that are installed to offer
coverage in any of the locations chosen by the operator, to comply with the
obligation to extend coverage referred to in literal b of article OBLIGATIONS OF
PERMITS THE USE OF SPECTRUM. For the purposes of the incentive discussed in
this article, it is understood that the first jump is the first link from the base
station deployed by the PRST to offer coverage in the locations of Annex IV.
The assignees of permits for the use of the radio spectrum will require the
following specific obligations, whose compliance will be verified by the Ministry
of Information and Communications Technologies
Annual goals minimum accumulated to comply, counting the time in years from
the date of finality of the administrative act of assigning permission to use the
radio spectrum in the 700 MHz band auction result present, are as follows:
• 20% of the total municipalities with fewer than 100,000 inhabitants in which it
has an obligation to technological upgrading in the first year of validity of the
permit.
• 50% of the total municipalities with fewer than 100,000 inhabitants in which it
has an obligation to technological upgrading, in the second year of validity of the
permit.
• 80% of the total municipalities with fewer than 100,000 inhabitants in which it
has an obligation to technological upgrading in the third year of validity of the
permit.
• 100% of the total municipalities with fewer than 100,000 inhabitants in which
it has an obligation to technological upgrading, in the fourth year of validity of
the permit.
To fulfill this obligation, the assignee shall submit to the Ministry within ninety
(90) calendar days following the firmness of the administrative act of assigning
permission to use the radio spectrum result of this process, a detailed plan and
schedule work, which enter dates of technological update of each of the
municipalities with population less than 100,000 inhabitants which in Q2 2019
the technology deployed did not offer peak speeds theoretical referenced in
Table 1. in addition, the assignee must submit at the least one (1) semi-annual
report which describes the state of compliance with this obligation.
For the fulfillment of this obligation, the assignee shall send to the MINISTRY,
within ninety (90) calendar days following the firmness of the administrative act
of assigning the permit for the use of the radioelectric spectrum resulting from
this process, a detailed plan and the schedule of work, in which indicate the
dates of commissioning of each of the locations according to the conditions
offered, by which he was assigned, as well as a description of the way in which
it will be carried out. In any case, the assignee must submit at least one (1)
semiannual report describing the status of compliance with this obligation.
The coverage of the mobile service that is offered in the chosen locations as part
of the selection process, cannot be reduced or eliminated during the validity of
the permit or its renewal, except for the prior demonstration of circumstances of
fortuitous event or force majeure; event in which it must proceed in accordance
with the provisions of paragraph 3 of this article.
In addition, random field checks will be carried out, which will not exceed 5% of
the totality of the locations that have been proposed for the extension of
coverage covered in section b) of this article, where at least 90 % of
measurements taken must be above the power level defined for RSRP. To define
the locations in which the field verification will be carried out, the simulation of
coverage provided by the PRST will be analyzed and it will be checked if there
are differences with respect to the simulations that are made from the
information available in the Spectrum Management System (SGE).
ANNEX IV
LIST OF LOCATIONS FOR EXTENSION OF COVERAGE
Note: The related geographical coordinates for each of the locations covered by
this Annex of this Resolution, indicate the location of the territory corresponding
to the locality where the Telecommunications Services and Networks Provider
shall offer mobile coverage to the population, of in accordance with the
definition of coverage covered by paragraph 1 of Article 23 of this Resolution. In
no case, these coordinates suggest or indicate the location of the infrastructure
necessary to offer the coverage to which the provider undertakes for each
location and are included exclusively for reference purposes so that the
participating operators and permit assignees can advance the activities aimed
at guaranteeing compliance with the coverage obligations covered by this
auction process.
The sources of the information in the “Latitude” and “Longitude” fields are the
National Administrative Department of Statistics (DANE) and those contained in
the formal applications filed before THE MINISTRY until September 4, 2019
