Case Digestion for Obligations and Contracts

How to digest cases?

1. What is needed are the following:

a. Facts. Answerable by what, when, where, who and how. This usually refers to the
summary of the case. What is the story before the matter was elevated to the regular
courts. You can also include (optional) a brief summary of the ruling or decision of lower
courts (MTC, RTC, CA etc.)

b. Issue/s. Answerable by what is the case all about. The issue/s can be found in the
content of the case and in relevance to the discussions we had. Usually one to two lines
only and starting with statements “Whether or not.”

Ex. Whether or not plaintiff are joint or solidary debtors or creditors.

c. Ruling. Your Ruling should answer to the issue/s of the case. Indicates the final
decision of the Supreme Court. If decisions of lower courts were modified, sustained,
reversed, with merit or without merit etc.

2. Your case digestion should be brief, specific and concise. SCRA means Supreme Court
Reports Annotated. Date indicates the date of the case.

3. A digested case usually is one page to 1 and a half page only. Facts, Issues and Ruling are
written in a paragraph form.

4. Format:

5. Deadline: Second meeting upon resumption of classes.
