THE JUSTICE LAW

The project on the justice laws implies three main changes.

 First, the status of magistrates changed. (it aimed at changing the procedure for the
appointment of chief prosecutors).
 The law on judicial organization was modified as well as the one of the Superior Council
of Magistracy.
 Also, there is still the real risk that the president will be removed from the appointment
of chief prosecutors.
 Even if the laws of justice are voted without corrections after review, the president is
bound to promulgate them.

After these changed were made public, the ambassadors of seven EU states expressed
their concern about them. The warning was signed by the ambassadors of Germany, France,
Netherlands, Belgium, Sweden, Denmark and Finland. The Ambassadors of the EU Member
States have stressed the importance of open consultation process with all the interested
members in this matter, including the request for the Venice Commission’s opinion which is an
advisory body of the Council of Europe, composed of independent experts in the field of
constitutional law. The Venice Commission's primary task is to assist and advise individual
countries in constitutional matters in order to improve the functioning of democratic
institutions and the protection of human rights.
General Prosecutor Augustin Lazar accused attempts by some state powers to deprive
Romanian prosecutors of independence, in suspicious ways, through vicious parliamentary
projects and procedures and stressed that a view of the Venice Commission is urgent. Also, the
Judges 'Forum and the Prosecutors' Association called on the Parliament not to adopt the law
amending the justice laws, saying that "the only solution to overcome this critical situation is
the resumption of dialogue, based on the principles of institutional transparency.”
The reactions from the romanian side came immediately. PSD (Social-Democratic
Party) deputy Florin Iordache (romanian politician, member of the Romanian Parliament and
Vice-President of the Chamber of Deputies) declared that the amendment to the three
normative acts does not require the Venice Commission's opinion because the laws strengthen
the independence of the judiciary and the fight against corruption, the political factor being
eliminated and that Venice Commission’s opinion is not needed.
The second man in the state, the President of the Senate, Calin Popescu Tariceanu also replied
that the laws cannot be understood by people without specialist training and that they will not affect
the independence of the judiciary and the fight against corruption and that it would have been
natural for the ambassadors to be better informed.
Tudorel Toader (former judge at the Constitutional Court of Romania between 2006-
2016, Rector at "Alexandru Ioan Cuza" University of Iasi between 2016-2017, romanian
magistrate and current Minister of Justice) met with the Ambassadors of the United States,
Canada, Belgium, France, Germany, Great Britain, Holland, Slovenia and Sweden for a
presentation of the legislative developments in Romania regarding the laws of justice.
All three projects passed the Parliament.
