4/5 - Per the ARHA newsletter: Governor Kay Ivey on Friday, April 5 issued a Stay at Home order to be
applied statewide. The order will be effective beginning Saturday, April 4, at 5:00 p.m. and will expire
Thursday, April 30, 2020 at 5:00 p.m.

The order provides for essential businesses to remain open and their employees to be able to attend
work. Restaurants and hotels are deemed essential services - see compliance details in the
attached orders.

The Governor also temporarily suspended all residential evictions and foreclosures, which will be of great
help to our industry's displaced workers. See below for the Declaration of Emergency and Stay at Home
Order.

On 3/27, Gov. Kay Ivey announced the closing of most non-essential businesses [for 3 weeks] in the
state as the number of confirmed COVID-19 cases continue to climb in the state of Alabama.

Effective, March 19th- It was just announced that the Alabama Department of Public Health (ADPH) is
prohibiting any restaurant, bar or brewery in the state of Alabama from serving food or drink on premises.
The regulations are designed to limit the spread of coronavirus, with exceptions for facilities serving
emergency personnel and health care providers.

All restaurants, bars, breweries or "similar establishments" are banned from on-premises consumption of
food or drinks as of 5 p.m. TODAY.

Take-out and delivery are still allowed. More details are available at AL.com

Effective Wednesday, March 18, locations licensed by the ABC board to sell alcohol either for on-
premises consumption and/or off-premises consumption may now sell via curbside pick-up or take-out
services. Delivery is not included because it would require legislative action in order to change a state
law.

You are limited to one 750-ml bottle of spirits, one 750-ml bottle of wine, or a six-pack of beer per

3/17- Gov. Kay Ivey's office announced the Alabama Department of Public Health (ADPH) is prohibiting

March 27, 2020 (Anchorage, AK) – Alaska Governor Mike Dunleavy, with the Alaska Department of
Health and Social Services (DHSS) today issued the State of Alaska’s 11 th and 12th COVID-19 Health
Mandate to protect the public health of Alaskans and disrupt the spread of the virus.

Health Mandate 011: Social Distancing: Mandate 011 states, “All persons in Alaska, except for those
engaged in essential health care services, public government services, and essential business activities,
are mandated to remain at their place of residence and practice social distancing,” effective March 28,
2020 at 5:00pm. The mandate will be reevaluated by April 11, 2020.

Mandate 011 orders individuals to practice social distancing, orders closure of non-essential businesses,
and orders employers to take reasonable precautions.

Health Mandate 012: Intrastate Travel

Mandate 012 states “all in-state travel between communities, whether resident, worker, or visitor, is
prohibited unless travel is to support critical infrastructure; or for critical personal needs,” effective March
28, 2020 at 8:00am. The mandate will be reevaluated by April 11, 2020.

Mandate 012 prohibits personal travel except as necessary to meet critical personal needs or work in
critical infrastructure jobs.

3/23- Governor Dunleavy issued the 9th and 10th mandates set to go into effect over the next two days.
The 9th mandate extended the ceasing of operations for personal care facilities to the entire state of
Alaska, where it had previously been limited to the entire state of Alaska, where it had previously been
limited to the Fairbanks North Star and Ketchikan Gateway Boroughs. It also banned gatherings of more
than 10 people.

Health mandate number 10 imposes a mandatory quarantine for anyone coming into Alaska from
domestic or international travel, and that businesses and employees of critical infrastructure must put into
place a plan detailing how they would avoid the spread of COVID-19. Failure to adhere to mandate 10
carries with it a fine of $25,000, or no more than one year of prison, or both.

To prevent or slow the spread of Coronavirus Disease 2019 (COVID-19), the State of Alaska is issuing its
third health mandate.

Mandate 3.1
By order of the Governor, beginning March 18 at 5 p.m., and continuing until April 1 at 5 p.m., the
following mandates are in effect:
With the goal of minimizing in-person interaction in enclosed spaces, effective March 18 at 5 p.m. all bars,
breweries, restaurants, food and beverage kiosks or trucks, and other establishments serving food or
beverages within the State of Alaska shall be closed to the public dine-in service. All buffets and salad
bars are closed to self-service. A copy of this order, or a sign communicating the closure information,
shall be prominently posted by the person having control of the establishment.

Places of public accommodation are encouraged to offer food and beverage using delivery service,
window service, walk-up service, drive-through service, or drive-up service, and to use precautions in
doing so to mitigate the potential transmission of COVID-19, including social distancing.

In offering food or beverage, a place of public accommodation subject to this section may permit up to
five members of the public at one time in the place of public accommodation for the purpose of picking up
their food or beverage orders, so long as those individuals are at least 6 feet apart from one another while
on premises.

All entertainment facilities shall be closed to the public, including theaters, gyms and fitness centers,
bowling alleys and bingo halls.

The restrictions do not apply to any of the following:

 Places of public accommodation that offer food and beverage not for on premises consumption,
including grocery stores, markets, convenience stores, pharmacies, drug stores, and food
pantries, with the exception of their self-service buffets and salad bars.

 Health care facilities, pharmacies, child care facilities, residential care facilities, congregate care
facilities, and juvenile justice facilities.

 Crisis shelters, soup kitchens, or similar institutions.

 Employee cafeterias within a business, with the exception of their self-service buffets and salad
bars.

 Restaurants and food courts inside the secured zones of airports.

These measures are being implemented to protect all Alaskans and we appreciate the public and
business community’s understanding of these mandates in an effort to mitigate the impacts of this virus.

The emergency order includes a list of critical businesses that can continue to operate while
implementing social distancing techniques to the maximum extent possible—including switching to
curbside or delivery service. The critical business list includes health care operations, grocery stores,
convenience stores, maintenance and operations of critical infrastructure, first responders, criminal justice
personnel, critical government functions, defense and national security-related operations, food
cultivation, social services, journalism, gas stations, banks and other financial institutions, hardware
stores, plumbers, electricians, mailing and shipping services, laundromats, educational institutions for the
purpose of distance learning, restaurants (for takeout and delivery only), transportation services, hotels,
childcare facilities (to serve workers in critical jobs only), and some legal and accounting services. For a
full list, refer to the emergency order. These businesses should incorporate remote working whenever
possible and adhere to CDC social distancing guidelines including maintaining six feet between people.

4/7- Arizona Gov. Doug Ducey issued a series of coronavirus-related executive orders Tuesday, including
one that requires travelers to Arizona from hard-hit states New York, New Jersey and Connecticut to self-
quarantine for 14 days. https://azgovernor.gov/executive-orders

From the Arizona Restaurant Association:

4/7 -Today, Governor Ducey issued an Executive Order clarifying that restaurants may repackage and
sell raw food items and other products directly to the public - similar to a grocery store. The Arizona
Restaurant Association thanks Governor Ducey for making this important clarification that allows
restaurants to access new revenue streams and provides options to consumers.

In a press release Governor Ducey said "Even with dine-in and carry-out options still available to
patrons, many Arizona restaurants are struggling due to COVID-19. Today’s Executive Order provides
flexibility for restaurant owners to safely sell prepared and bulk foods or supplies they have on hand
and can’t use right now. We are proud to support Arizona restaurants with this reform.”

The Executive Orders state that:

 Restaurants currently licensed or permitted to serve prepared food may sell grocery items
including, but not limited to, paper goods, cleaning supplies, prepared food in bulk, meat and
vegetables whether or not those items are normally packaged for resale, provided the
following:
o Food sold must be wholesome and unadulterated.
o Open ready-to-eat foods must be within the date marking requirements to be sold.
o Products requiring refrigeration must remain under temperature control (41-degrees or
less) until ready for pick up or delivery.
o Customers should be instructed to get food home quickly and placed under
refrigeration.
o Bulk household goods should be sold in their original containers.
o Raw meats should be separated from other foods, especially produce and other ready-
to-eat food items to prevent cross contamination.
o Businesses shall assess their customer traffic flows to ensure a takeout or curbside
business model will maintain the Governor's social distancing requirements

The order also contains other provisions such as waiving the enforcement of Weights and Measures.

3/31- Today, Governor Ducey announced the deferral of all liquor license fees by 90 days. In
yesterday's update, the ARA reported that liquor license renewals were still due. However, in response

to continued industry concern, Governor Ducey issued a press release clarifying that liquor license
renewals will be delayed as part of his previous Executive Order.

This deferral is effective immediately, however businesses will still need to apply for a renewal under
the 90-day deferral program. We are still waiting on additional information from the Department of
Liquor Licenses and Control and once we have that we will send out another update.

Governor Ducey Issues "Stay Home" Order

3/30 Today, Governor Ducey issued an Executive Order requiring individuals to limit their time away
from home and limiting business activity to essential services. The order establishes the "Stay Home,
Stay Healthy, Stay Connected" policy for the State and goes into effect at 5:00PM tomorrow, Tuesday,
March 31, 2020 and continues through April 30, 2020.

Restaurant operations are listed as an essential service, and in his address Governor Ducey clarified
that "restaurants across the state will continue to offer takeout and delivery services." The Governor
further encouraged individuals to "please patronize your local restaurants and be as generous as you
can with your tips."

What does this mean for restaurants and restaurant employees? As stated above, restaurants are
listed as an essential service and can continue to operate takeout and delivery operations and
restaurant employees may continue to report to work as normal. There is NOT a requirement that
individuals carry papers or provide any proof that their activities fall under essential services, so there is
no need for owner/operators or employees to issue letters or have proof they are traveling to or from
work.

Per the Arizona Restaurant Association on March 23rd:Governor Ducey's Executive Order Includes
Restaurants as Essential Service
Today, Governor Ducey issued an Executive Order defining what businesses and operations are
considered "essential" by the State. The order included restaurants off-premises operations in the list of
businesses. This action prohibits counties, cities, and towns from issuing any order that prohibits the
performance or function of an essential service. In a press release, Governor Ducey said "Arizona is
focused on limiting the spread of COVID-19, while providing relief to families, individuals and businesses
impacted. This proactive order will ensure the state has one consistent, overarching policy that is based
on CDC and public health guidance — allowing business owners and workers to responsibly plan ahead.
We will continue to proceed with a calm and steady approach and act with urgency, while providing
certainty whenever possible.”
The order defines restaurants off-premises operations as:

 Restaurants and other facilities that prepare and serve food, but only for consumption off-
premises through:
o in-house delivery
o third-party delivery
o drive-thru
o curbside pickup

The order defines a multitude of other services and business as essential including the suppliers that
restaurants rely on.

Previous: The Arizona Department of Public Health strongly recommends that dining establishments in
areas of known community spread (including Maricopa, Pima and Pinal counties) discourage dine in
traffic and instead provide curbside pickup or drive thru service.

COVID-19 Emergency Measure Allowing Restaurants to Sell Alcohol


for Off-Premise Consumption Guidance
On Friday, March 20, 2020, the Arizona Department of Liquor Licenses and Control (DLLC) issued
rules to implement Governor Ducey’s Executive Order 2020-09, which allows restaurants to offer
alcohol for sale along with delivery and takeout orders. Today, DLLC issued a guidance
document for implementation.

DLLC Guidance:

 Restaurant licensees may temporarily sell alcohol through delivery, pick-up, and curb-side
service.
 Restaurant licensees that use pick-up and curb-side to sell alcohol must still only allow
individuals 18 or older to sell the alcohol.
 Beverages sold for delivery, pick-up, or curb-side service must be in a "sealed container" -
a sealed container is any container of spirituous liquor which:
o has an unbroken tax seal from the United States, or
o has a cap, cork, or seal placed there by the manufacture.
 Licensees may sell mixed drinks if they seal the container before removing it from the
licensed premises and ensure the seal remains in place until the consumer takes
possession.
 Licensees may seal containers by capping and applying a plastic adhesive seal or by
corking flush with the top of the bottle.

 Licensees using delivery to sell alcohol must comply with the documentation requirements
outlined by DLLC which can be accessed by visiting

Arizona Restaurant Association Guidance:

Third-party delivery services

Alcohol deliveries should be made by restaurant employees and only made to individuals over the
age of 21 with an ID that matches the name on the form of payment. Third-party delivery services
lack crucial safeguards that help protect you from losing your liquor license, liability damages, and
reputational damages. There is currently no way for third-party delivery services to perform proper
ID checks and verify the ID matches order details nor is there a way for this to be documented as
part of the record requirements. Additionally, since orders processed by third-party delivery
services are paid to the third-party delivery service and not directly, to the restaurant it would be a
violation of Arizona Liquor Law since payment for alcohol must be paid to a licensed
establishment. It is for these reasons we strongly advise against offering alcohol for sale through a
third-party delivery service at this time until further clarification is offered by the appropriate
authorities.

Insurance Considerations

There are two important insurance issues to consider when thinking about offering alcohol for sale
with delivery or takeout.

The first, does your liquor liability coverage have an exclusion for alcohol delivery or takeout and is
your coverage sufficient for the expanded activity? You are highly encouraged to check with your
broker and ask if you are covered at the appropriate level of your new offering.
Second, if you are using employees to perform the delivery of alcohol (which is recommend by the
ARA – see above) in their personal vehicles, you should check with your broker to make sure you
have the proper coverage for DELIVERY. Your employees will need to have certain minimum
limits on their personal coverage, and they should check to see if they are allowed to use their
vehicles for business purposes. Ask your broker if the combination of your employee’s personal
auto policy and your business auto policy is enough to protect you? Bottom line check with your
broker and describe the activity you will be performing and ensure your policies are able to
cover you!

Last night Governor Ducey announced that he was taking additional steps to curb the spread of
COVID-19. One such step is ordering the restriction of restaurant activities to takeout, drive-thru
and delivery options. In a statement the Governor said, “These latest actions are based on the
facts and on data, and come after careful consultation with public health experts from every county
in Arizona, our hospitals, local elected officials, and private sector partners.”

Provisions of the new order include:

 Beginning at the close of business on Friday, March 20, restaurant operations are
restricted to takeout, drive-thru, and delivery options in counties with confirmed cases of
COVID-19
 Beginning at 5:00PM on Friday, March 20, allows restaurants to sell alcohol for delivery
and takeout
 Allows manufacturers, wholesalers and retailers to buy back unopened products from
restaurants, bars and clubs
 Beginning at the close of business on Friday, March 20, closes all bars, theaters and gyms
in counties with confirmed cases of COVID-19
 Halts all elective surgeries to free up medical resources
 Activates the AZ National Guard to assist grocery stores and food banks with re-stocking
and heightened demand
 Delays expiration dates on Arizona driver licenses for residents over the age of 65

Arkansas has banned indoor and enclosed outdoor social gatherings of more than 10 people, with few
exceptions, in an effort to slow the spread of the coronavirus.

The directive does not apply to businesses, manufacturers, construction companies, places of worship,
the Arkansas General Assembly, municipal or county governing bodies, or the judiciary. Outdoor

gatherings in unenclosed areas such as parks are also exempt, although social distancing of at least 6
feet must be observed.

Banned gatherings include sporting events, concerts, conferences, conventions, fundraisers, parades,
fairs, and festivals.

The ban is in effect until further notice.

3/25: The City of Little Rock is under a daily curfew from 12 a.m. to 5 a.m. as a measure to help curb
gatherings of people at night spots where coronavirus could be easily spread.

State and federal health officials have repeatedly advised that social distancing is an important step to
take towards preventing the spread of this highly contagious virus. In an effort to protect public safety, the
City of Little Rock has implemented measures aimed at minimizing exposure.

On March 31, six Bay Area counties issued new social distancing protocols along with an order extending
shelter-in-place until May 3. Here are the counties’ recommendations on the best practices for restaurants
and cafes, in addition to already established sanitary behaviors, and what diners should expect in order to
stay safe.

Q: What kind of signage should be made available?


A: Each public entrance must have a copy of the official social distancing protocol posted. In addition, the
protocols require a sign that tells both customers and staff that they should: “avoid entering the facility if
they have a cough or fever; maintain a minimum six-foot distance from one another; sneeze and cough

into a cloth or tissue or, if not available, into one’s elbow; and not shake hands or engage in any
unnecessary physical contact.”
Q: How can human contact be effectively minimized?
A: Avoid having customers and staff touch shared surfaces and tools by eliminating self-service stations
with silverware and napkins and disallowing reusable containers. If customers must sign receipts, show
them that the pens have been sanitized, and give them a separate container to return used pens. Sanitize
everything customers touch after each use: touchscreens, counters and check presenters. Cash and
cards should be handled with care by people who won’t be touching food or utensils — either with gloves
changed between each transaction, or with the liberal use of hand sanitizer. To that end, provide hand
sanitizer at the register for customers and cashiers.
Q: How should customers be made to follow social distancing?
A: Limit how many people can be in the space, or in front of the space. Estimate how many people can
be inside while maintaining 6 feet of distance from each other, then make that number the maximum
allowed inside at any given time. Have one dedicated staffmember stand at the entrance to implement the
policy and remind people to stand 6 feet apart while waiting.
Implement environmental social distancing reminders as well, like drawing lines on the sidewalk with
chalk or painter’s tape to show customers where to stand while waiting.
Q: Is wearing gloves enough to combat the virus?
A: While disposable gloves and hand sanitizer are helpful, they don’t replace hand washing. Staff should
change gloves after touching shared utensils, cleaning and any other action that would potentially
contaminate a sterile area.
Q: What are the best practices for staffing?
A: Restaurants should rearrange kitchen layouts and menu offerings to force at least 6 feet of space
between staff. For instance, having two people on the pasta station working elbow-to-elbow would violate
social distancing orders; it would be better to streamline the menu so one person could handle that
station alone. That may mean downsizing: Owners and managers should be realistic about what can be
produced with a staggered schedule and smaller staff.
Owners and managers should be flexible with sick leave. Don’t ask for a doctor’s note, especially now
that health care providers are slammed. Discourage staff from showing up if they are ill, and eliminate
financial barriers to staying home. That means paying people who might be exposed to the novel
coronavirus to not show up to work for the full two-week quarantine period. While Health Insurance
Portability and Accountability Act privacy rules restrict managers from asking staff directly about illnesses,
it is to everyone’s benefit that management is generous with sick leave. The protocol does require
symptom checks before staff begin work, so it’s essential to have managers be aware of what to check
for—fever, fatigue, and dry cough.
The city of San Francisco has promised to reimburse small businesses that have employees in San
Francisco with up to $10 million in sick leave during the coronavirus outbreak.
Staff’s individual needs should be taken into account when assigning roles. If someone is a caretaker for
a vulnerable loved one, or lives with people who are at higher risk for fatal infections, allow them to set
their own comfort levels with tasks that could potentially expose them to the virus.

Post hand-washing signs in all of the public and employee-only restrooms and food prep areas of your
business.

Re-useable Containers: It is a voluntary law and not recommended to allow reusable containers at
this time.

3/19 - Per the New York Times: Gov. Gavin Newsom of California on Thursday ordered Californians —
all 40 million of them — to stay in their houses as much as possible in the coming weeks as the state
confronts the escalating coronavirus outbreak. The order represents the most drastic measure any
governor has taken to control the virus, and a decision that Gov. Andrew M. Cuomo of New York, which
has far more cases than California, has resisted taking.

The order requires all indoor malls, shopping centers, playgrounds and other “non-essential” retail
businesses to close. “Essential businesses” include restaurants, grocery stores, pharmacies, food banks,
farmers markets, convenience stores, hardware stores and gas stations.

3/19 Per California Restaurant Association: Sunday afternoon Governor Newsom directed restaurants
statewide to cut their seating capacity in half and practice “social distancing” between guest parties.

Monday night Governor Newsom moved away from that request and directed restaurants
statewide to operate only via take out, delivery, drive thru, and curb side pick-up.

The California Department of Public Health has issued the following resource that indicates:

“Restaurants should be closed for in-restaurant seated dining and should be open only to drive-through or
other pick-up/delivery options.”

This morning, the Boulder County, Jefferson County, and Tri-County (Adams, Arapahoe, and Douglas
Counties) health departments issued a joint Stay at Home Order, effective at 8 a.m. on March 26 through
April 17. Restaurants and businesses that supply restaurants are classified as essential services and are
exempted from these orders. You can read the details of the Tri-County orders here. Boulder County

outlined in each of the orders are the same. Here is what you need to know to comply:

 The order requires individuals anywhere within the Tri-County, Boulder County, and Jefferson
County jurisdictions to stay at home unless they are conducting certain essential
services/activities.
 If individuals are using shared outdoor spaces they must maintain social distancing of at least six
feet from all individuals who they do not live with.
 Individuals experiencing homelessness are exempt but strongly encouraged to find adequate
shelter.
 All non-essential businesses are ordered to cease all business activities and close down for the
duration of the order.

 All public and private gatherings are prohibited, except those between people that live together.
 All travel to places outside those listed as essential services is prohibited. Individuals may only

 Social distancing requirements include maintaining a distance of at least six feet, washing hands
with soap and water for at least twenty seconds as frequently as possible or using hand sanitizer
does when hand sinks are not available, covering coughs/sneezes with the sleeve or elbow,
regularly cleaning high-touch surfaces, and not shaking hands.
 Any individual found in flagrant or willful violation of the order may be guilty of a Class 1
misdemeanor and subject to a fine up to $5,000 and an 18-month jail sentence.
 Essential activities are:
o Any task essential to a person’s health and safety, or the health and safety of a family
member they are assisting.
o Obtaining necessary services and supplies such as food, pet supplies, medications, etc.
o Outdoor activities either individually or in groups up to four people that allow for social
distancing.
o Performing work at an essential business.
o Caring for a family member or friend in another household.
o Moving from one house to another.
 Essential businesses include:
o Anything healthcare-related; hospitals, clinics, pharmacies, nursing homes, etc.
o Grocery stores, which includes stores that sell groceries and also sell other non-groceries
related products such as household needs and cleaning supplies
o Restaurants providing delivery, takeout, and drive-thru services
o Veterinary care and animal shelters.
o Utilities, power, water, gas, etc.
o Public works construction and other private construction operations.
o Skilled trades such as electricians and plumbers.
o Airports
o Oil and gas operations
o Transportation needs including public transit and roads and highways

3/20: Alcohol To-Go and Delivery Rules Announced

Today, Governor Polis signed an executive order that allows liquor licensees licensed for on premises
consumption to sell alcohol for carry out, and delivery. This order is in effect now and will stay in effect
until April 18th. You can read the full order here.

Here is what you need to know:

 Operators must have one of the following licenses: Beer and Wine, Brew Pubs, Club Licenses,
Distillery Pubs, Hotel & Restaurant, Lodging and Entertainment, Tavern, or Vintners Restaurant
 The order applies to all types of beer, wine, and spirits (cocktails and mixed drinks included).
 Beverages must be in a sealed container – according to LED, sealed containers include plastic
cups with plastic lids, even if there is a straw hole, as long as there isn’t a straw in it. Restaurants
can also refill growlers.
 Sale of food must be on the same receipt or transaction.
 As always, sales to someone under 21 or someone who is visibly intoxicated are prohibited.
 For delivery orders, individuals placing the order must be 21 years of age or over, and must
provide their name, date of birth, and delivery address. This information must be verified upon
delivery.
 Establishments licensed as a distillery pub or a brewery may only sell what’s made on site. (We
believe this was supposed to say “distillery” and are seeking a change.)
 Deliveries may only be made to the address provided at the time of the order.
 Persons making the delivery must be 21 years old or older and an employee of the licensee. (We
are working with LED and the Governor’s office to allow third parties to deliver, as most
restaurants aren’t set up for delivery.)
 Licensee must retain all records regarding the delivery of alcohol beverages.

3/19 Governor Polis Extends Dine-In Closure Until April 30. Governor Polis issued an amended
order yesterday to extend the dine-in closure until April 30, 2020. The order also clarified that hotel
restaurants and bars are not exempt from this closure, but can continue to provide room service. This
order also explicitly excludes alcohol from being consumed on premise. See the full order here.

Clarification on Gatherings of 10+ and Staffing

The order restricting groups of more than ten from gathering does not include staffing, per the Colorado
Department of Public Health and Environment. Your staff can be larger than ten, but you should follow the
CDPHE guidelines for restaurants AND restrict customers who have come in for take-out to five or fewer
in your space at one time. Customers waiting in line should be six feet apart from one another.

The Public Health Order closes:

 Brew pubs, breweries, microbreweries, distillery pubs, wineries, tasting rooms, special licensees,
clubs, public bars, taverns, restaurants, food courts, cafes, coffeehouses, cigar bars, gyms,
gymnasiums, theaters, and casinos to slow the spread of the COVID-19 virus

 Movie and performance theaters, opera houses, concert halls, and music halls

 Restaurants, food courts, cafes, and other similar places of public accommodation offering food
or beverage for on-premises consumption

These places are encouraged to offer food and beverage using delivery service, window service, walk-up
service, drive-through service, or drive-up service.

The restrictions imposed by this order do not apply to any of the following:

 Places of public accommodation that offer food and beverage not for on-premises consumption,
including grocery stores, markets, convenience stores, pharmacies, drug stores, and food
pantries, room service in hotels, health care facilities, residential care facilities, congregate care
facilities, and juvenile justice facilities; crisis shelters or similar institutions; food courts inside the
secured zones of airports; and any emergency facilities necessary for the response to these
events.

Denver has added breweries to its list of essential businesses, which are exempt from the City's Stay at
Home Order. There is a caveat: Establishments licensed as Brew Pubs may sell for off-site consumption.
Breweries MAY be able to sell for off-site consumption if they have an “approved for salesroom,” which is
a permit from the state. If the brewery does not have this permit, it cannot sell for off-premise use.

will visit all Denver food facilities (3000+), prioritizing facilities with onsite food handling and/or onsite
consumption, and those with highest likelihood of customer/environmental surface contact (places like
fast food facilities--think of all the surfaces people can touch while waiting in line, ordering, getting

Food trucks will receive this information, although they are lower priority due to the fact there is little
touching of surfaces by customers during their transaction.

Visits will involve delivering signage that is required to be posted at the facility entrance and in
restrooms reminding customers about the importance of washing their hands and not dining out when
having symptoms of respiratory illness.

Visits will also provide guidance on restricting ill food handlers and frequently disinfecting high-touch
environmental surfaces.

DDPHE will require that this info be posted under 24-16 DRMC. Facilities that fail to comply may be
subject to enforcement action under 24-24 DRMC.

Pursuant to Executive Order 7G and 7T, the Department of Consumer Protection issues the following
rules and procedures for the sale of alcoholic liquor for pick-up and delivery to a customer for all permit
types presently allowed to offer pick-up and delivery:

 For all pick-up and delivery orders that include alcoholic liquor, the customer receiving the order
must be of legal drinking age and cannot be intoxicated.
 If the age of the customer receiving the alcoholic liquor is in question, he or she must present a
valid operator’s license or state identify card. If the age of the customer remains in question after
reviewing the identification presented, the sale and/or delivery of the alcoholic beverage must be
declined.
 The use of age statement forms is not authorized for pick up or delivery of alcoholic beverages
off-premises.
 Any individual who delivers orders that include alcoholic liquor directly to the customer’s
residence must be at least eighteen years of age and employed as an employee of the permit
premises.
 Unless otherwise noted, the hours of sales for pick up or delivery that include alcoholic liquor
shall be the same as those for a package store.

4/2/2020- GOVERNOR LAMONT MODIFIES MAXIMUM PERIOD OF CREDIT FOR LIQUOR


PERMITEES: Extension of 30-day period of credit for liquor permittees: Executive Order 7S modifies
state law to permit the maximum period of credit for liquor permittees from certain creditors, including
wholesalers and manufacturers, to be 90 days after the date of delivery for all permittees prohibited from
engaging in on-premise sales per Executive Order No. 7D.
Further Explanation of Executive Order 7s:

 An On Premise account (“all permittees prohibited from engaging in on-premise sales per
Executive Order No. 7D”) has 90 days terms on all invoices from “wholesalers, manufacturers or
others specified in such Statute or regulations” IF: All invoices due to “wholesalers, manufacturers
or others specified in such Statute or regulations” which are 40 days from day of delivery or older
(posted invoices), as of March 16th , 2020 are paid in full. Once these invoices are paid, ALL
open invoices from “wholesalers, manufacturers or others specified in such Statute or
regulations” will not be subject to posting until they reach 90 days from day of delivery.

3/20/2020- Governor Issues Stay Safe, Stay at Home Policy - Restaurants Still Viewed As An Essential
Industry
Today, Governor Ned Lamont announced the closing of all non-essential businesses in Connecticut
through April 22. The "Stay Safe, Stay at Home" Policy is in line with New York's early announcement to
help slow the spread of the coronavirus.

The Governor is directing all non-essential businesses and not-for-profit entities in Connecticut to prohibit
all in-person functions if they are able to, effective Monday, March 23, 2020 at 8:00 p.m. Also, he is
encouraging all businesses to employ, to the maximum extent possible, any telecommuting or work-from-
home procedures that they can safely implement.

RESTAURANTS ARE VIEWED AS AN ESSENTIAL BUSINESS and can continue to offer take-out,
curbside, drive-thru and delivery to residents around the state. In addition, they will be able to provide
alcohol for off-premise consumption.

CONNECTICUT RESTAURANT ASSOCIATION EMAIL TO RESTAURANT COMMUNITY
Governor Ned Lamont announced today in collaboration with New York and New Jersey that all
restaurants and bars may no longer serve guests wishing to be seated and dine inside. This order takes
effect at 8:00 pm on Monday, March 16, 2020 in reaction to the evolving COVID-19 Coronavirus health
crisis. There is no timetable for when this order will end. Update: Until 4/30/2020 at minimum.
Restaurant locations in Connecticut, which total more than 8,500, are allowed to continue providing food
to customers via takeout, drive-thru, curbside pickup and delivery.

4/6- With stay-at-home orders issued in all the jurisdictions it serves, Metro has decided to scale service
back even further. Starting April 6, Metro will run from 5 a.m. to 9 p.m. Monday through Friday, and 8 a.m.

Metrobus service will also end around 11 p.m. nightly, with buses that start their route before 11 p.m.
finishing to the end of the route before going out of service.

3/25: Mayor orders all non-essential businesses to close. Provisions related to restaurants:

business), but only for delivery, carry out, or “grab and go,” including food trucks and rapid made-to-order

The following COVID-19 infection control measures must be enforced for businesses providing essential
services to remain open.

 Teleworking must be maximized, especially for individuals at highest risk of poor outcomes, such
as those over age 60 and those with chronic underlying conditions.
 Follow all State and CDC guidelines and recommendations for social distancing for staff and
customers. Social distancing means remaining out of congregate settings, avoiding mass
gatherings, and maintaining distance (approximately 6 feet or 2 meters) from others when
possible (with the exception being healthcare workers using appropriate PPE).
 Screen all staff for symptoms and illness prior to entering worksite.
 Separate sick employees from other individuals immediately.
 Prohibit employees who have been told they must be isolated or quarantined from work until they
have been cleared by DPH or a medical professional.
 Have handwashing stations and / or hand sanitizer readily available for all employees throughout
the day. Staff should wash hands with warm water and soap when entering and leaving worksite.
 Enforce cough and sneeze hygiene, such as coughing into your elbow.
 Follow all State and CDC guidelines and recommendations for environmental cleaning.
 Prohibit visitors inside worksites unless they are providing essential services.

Employers must stress to employees that they are not to come to work when they are sick. We recognize
that is a difficult ask – especially for small businesses – and for employees whose paychecks depend on
every hour that they do work. But limiting public interactions of those who are sick is an important
mitigation strategy to help limit the spread of COVID-19 in Delaware.

This is a rapidly evolving situation in Delaware, in the U.S., and across the world. Recommendations from
the U.S. Centers for Disease Control and Prevention (CDC) and the World Health Organization (WHO)
are subject to frequent change.

establishments within the State of Florida to suspend on-premises food and alcohol consumption for
customers. The listed establishments may, however, operate their kitchens for the purpose of providing

3/24 - Georgia Governor Brian Kemp announced an executive order closing the state’s bars and
nightclubs and requiring Georgia’s most medically fragile residents to stay home.

 The order, which will take effect noon Tuesday, bans all gatherings of more than 10 people,
unless a six-foot distance can be maintained between individuals. The order is set to expire at
noon April 6th.
 Kemp also ordered the Department of Public Health to oversee a shelter-in-place order for those
most at risk for adverse complications from COVID-19. Those groups include people in long-term
care facilities, those receiving cancer treatments, those who have chronic lung disease and those
who have or may have a positive COVID-19 test.

All restaurants in the City of Atlanta are operating under a to-go only policy after Atlanta Mayor Keisha
Lance Bottoms signed an executive order on Thursday closing all restaurant dining rooms. After news of
the order broke, the restaurant community reached out her on Twitter to advocate for the ability to also
sell alcohol, a big revenue driver for the industry.

Now, restaurants with licenses are going to temporarily be able to allow alcoholic beverages to leave the
premises. The order mention wine and/or malt beverages but not liquor. The exemption will only last
through the emergency declaration she previously signed in response to the COVID-19 pandemic and will
not exceed 60 days.

Governor Pritzker has issued an official Executive Order that mandates the closure of on premise dining
in Illinois restaurants. Due to the advocacy of the IRA, the Executive Order clarifies that "to-go", carry out,
and take out will be permitted at Illinois restaurants.

4/6 Effective April 5, Governor Holcomb has extended the state of disaster emergency to end May 5,

On Monday, 3/23- Gov. Eric J. Holcomb told Hoosiers to stay at home starting March 25 until at least April

4/15 Governor Kelly has extended the stay at home order until May 3 or until further notice. All conditions

On Saturday March 28, Governor Kelly announced a statewide “Stay at Home order” in an effort to slow

 Alcohol licensee may make curbside sales to customers with all existing provisions of the Kansas
Liquor Control Act, for the duration of this policy only:

 Drinking establishments and class A clubs, class B clubs may sell bottles of beer or wine
curbside, in accordance with the provisions of K.S.A. 41-2653. For the duration of this policy only,
beer or wine sold in this fashion needs to be opened on the licensed premises and properly
sealed, but does not need to be partially consumed on the licensed premises.

 To accommodate these curbside sales, the licensee shall designate specific “to-go” parking stalls
or similar locations, which must all be located within a 50-foot radius of the entrance to their

radius are strictly prohibited.

On March 23, 2020, Governor Gretchen Whitmer issued an executive order requiring all Michigan
residents and most businesses to stay in their homes to slow the spread of coronavirus COVID-19.
Executive Order 2020-21 prohibits all businesses and operations from requiring workers to leave their
homes unless those workers are necessary to sustain or protect life or to conduct minimum basic
operations. Businesses must determine which of their workers are necessary to conduct minimum basic
operations. Restaurants will still be allowed to provide take-out options. Whitmer previously ordered the
temporary suspension of all dine-in services. This order takes effect on March 24, 2020 at 12:01 am, and
continues through April 13, 2020 at 11:59 pm.

4/1 Governor Tate Reeve issued a statewide “Shelter in Place” order to go into effective 5:00 p.m
Friday April 3 through 8:00 a.m. Monday April 20th Unless modified or extended. Executive order
Order states that individuals shall remain in their homes unless leaving to attend essential activities.
When out they shall maintain the social distancing of a minimum of 6 ft each other and groups should not
contain more than 10 people.

3/24 Governor Tate Reeves issued an executive statewide order restricting dine-in service operations,
and restaurants may only offer food service to drive-thru, carryout and delivery. The restriction is effective
until April 17

The city’s curfew will be in place from 11 p.m. until 5 a.m. for at least 14 days beginning Monday. People
will not be allowed in public streets or places unless they are traveling to or from work.

First responders and law enforcement are exempt from the curfew.

The mayor also ordered social distancing throughout the city, meaning people should stay at least six feet
away from others “to the extent possible.”

During the emergency, funeral services are recommended to be held on the property of a funeral home or
in the City of Vicksburg Auditorium. Services should be held at 11 a.m. or 2 p.m. with 50 people or fewer,
the mayor said.

Other places of public gathering should limit gatherings to 10 people or fewer.

The mayor ordered that bars, nightclubs, lounges and taverns close, except to provide takeout, pickup
and delivery food. These businesses are not allowed to have more than 10 employees and 10 customers
indoors at any time and must be closed from 11 p.m. to 5 a.m.

Liquor stores can only provide curbside delivery and have no more than 10 employees inside at one time.

Under the order, barbershops, beauty shops and nail salons cannot have more than 10 employees and
10 customers inside at one time. They must also close by 6 p.m.

Anyone who violates the order faces a misdemeanor charge and a fine up to $1,000.

March 19, 2020: Executive Order 20-06. Restaurants and bars across the state will continue to serve
Nebraskans by altering their customary operations in order to provide takeout, delivery, curbside and
drive-thru service operations. Restaurants and bars temporarily have the ability to sell alcohol along with
food take-out or delivery orders. Stores and restaurants can utilize drive-thru windows or curb-side to go
pick-up procedures for the sale of alcohol.

LINCOLN

The Lincoln-Lancaster County Health Department updated its guidance for public gatherings and events
to limit the spread of the coronavirus and the disease it causes, COVID-19. LLCHD is not making
decisions regarding cancelling or postponing events. However, the health department is now
recommending that the size of events and public gatherings be limited to no more than 50 people.

OMAHA

The diagnosis of the second case of COVID-19 by community spread in Douglas County prompted new
actions on Wednesday, March 18, 2020, including the immediate order to close Omaha bars and

April 1, 2020: Governor Stephen Sisolak issued a stay at home directive, an order that moves the

April 1, 2020: The city of Las Vegas can issue a Time-Limited Alcohol Delivery permit for 30 days,
renewable based on the duration of the current restrictions on businesses, which will allow a business

deliver a meal with alcohol.

Reno

As a follow up to the City of Reno’s emergency declaration, Reno Mayor Hillary Schieve is ordering
temporary mandatory closures of bars, nightclubs, gyms and restaurants (except takeout/delivery/drive
through and pick up services) in the city until April 5, 2020 unless extended. Schieve made the
announcement during a press conference held at Reno City Hall. Those businesses should begin the
process of winding down operations starting with the goal of closing by Friday, March 20, 2020 at 5 p.m.

Jersey City: City of Jersey City Executive Order on Curfew:

Effective immediately, Mayor Steven M. Fulop is implementing a precautionary 10pm curfew for all Jersey

outlined in the Executive Order include a requirement for all establishments with allowable public capacity
greater than 25 people – such as restaurants, places of worship, and special event venues – to maintain

The public health order issued March 19, 2020 by Department of Health Secretary Kathy Kunkel

spread of COVID-19 disease. The order enacts restrictions on bars and restaurants, among other
businesses. All restaurants, bars, breweries, eateries, and other food service establishments are limited

On March 23, 2020, New Mexico Department of Health Secretary Kathy Kunkel announced a new public
health emergency order effective 8am Tuesday, March 24, 2020, closing all businesses and nonprofit

April 12, 2020: Governor Cuomo issued Executive Order 202.16 directing employers to provide essential
workers with masks free of charge to wear when directly interacting with the public. This requirement will
become effective on April 15, 2020 at 8pm.
April 6, 2020: During a press briefing in Albany, NY, Governor Cuomo announced that schools and non-
essential businesses will remain closed at least until April 29, 2020. Cuomo had initially implemented the

March 29, 2020: Governor Cuomo signed Executive Order 202.13 extending “NY State on Pause”. Any
worker who is employed by the state of New York, shall, if deemed non-essential by their agency shall
work from home or shall be able to stay home without charging their accruals until April 16, 2020.
March 20, 2020: Effective at 8pm on March 22, 2020, every New Yorker must stay at home from work,
unless they are an essential worker. Exemptions from the order will include shipping, media,
warehousing, grocery and food production, pharmacies, health care providers, utilities, banks and related
financial institutions.
All non-essential businesses that are normally open to the public must remain closed. Bars and
restaurants may provide takeout.

March 19, 2020: Governor Andrew M. Cuomo today signed an executive order mandating businesses
that rely on in-office personnel to decrease their in-office workforce by 75 percent. This follows the
Governor's directive yesterday that all businesses implement work-from-home policies.

The provisions of Executive Order 202.6 requiring in-person work environment restrictions are modified
as follows: Effective March 21, 2020 at 8 p.m. and until further notice all businesses and not-for-profit
entities in the state shall utilize, to the maximum extent possible, any telecommuting or work from home
procedures that they can safely utilize. Each employer shall reduce the in-person workforce at any work
locations by 75% no later than March 21 at 8 p.m. Any essential business or entity providing essential
services or functions shall not be subject to the in-person restrictions.

Restaurants have been deemed essential and can remain operating for takeout and delivery only. This
Executive Order is valid through April 18, 2020.

NEW YORK CITY

Effective March 17, 2020, all restaurants in New York City will have to operate as delivery and take-out

April 9, 2020: Governor Roy Cooper took action to address the spread of COVID-19 by issuing stronger
social distancing requirements and speeding up the process to get benefits to people out of work through
Executive Order 131. This Order offers clear requirements that essential businesses must implement in
order to safeguard the health of customers and employees. Some of the directives include:

 Setting limits of how many people can be in a store at one time, 5 people per 1,000 square feet of
retail space or 20% of fire marshal posted occupancy limits
 Marking 6 feet of distance for areas where people gather like checkout lines
 Requiring specific cleaning measures for retail stores

March 27, 2020: Governor Roy Cooper issues Executive Order 121, a statewide Stay at Home Order
beginning Monday, March 30, 2020 at 5pm until April 29, 2020. The Executive Order directs people to
stay at home except to visit essential businesses, to exercise outdoors or to help a family member.
Specifically, the order bans gatherings of more than 10 people and directs everyone to physically stay at
least 6 feet apart from others. Restaurants and other facilities that prepare and serve food, but only for
consumption off premises, through such means as in-house delivery, third-party delivery, drive-through,
curbside pick-up, and carry-out are deemed to be essential businesses.

 Effective March 17, 2020 at 5pm, Governor Cooper issued Executive Order 118, limiting
operations of restaurants and bars and broadening unemployment insurance benefits in response
to COVID-19. The State Health Director is exercising quarantine and isolation authority to limit
access to facilities that sell food and beverage to carry-out, drive-through, in-room dining and
delivery services only. Outdoor food and beverage service is allowed if patrons practice social
distancing of at least 6 feet.

 CDC has also discouraged events of more than 50 people for the next 8 weeks so restaurants
and hotels should take that into account.

On March 19, 2020, Governor Doug Burgum issued an executive order closing restaurants, bars,
breweries, cafes, and similar on-site dining establishments to on-sale and on-site patrons. The order took
effect at 12pm on Friday, March 20, 2020 and continues through Monday, April 6, 2020. Take-out,
curbside, drive-through, delivery, and off-sale services are still encouraged during this period.

Recommendations for the hospitality industry:

 Provide alcohol-based hand sanitizer stations throughout the operation.


 Increase cleaning and disinfecting frequency for high-touch surfaces.
 Closely monitor employee health. Reinforce personal hygiene and cough etiquette.
Encourage symptomatic employees to stay home.
 Have employees disinfect all personal hard surfaces referenced on the product label.
 Educate and inform all employees of infection status and proper infection control
procedures.
 Consider implementing social distancing in your dining room; since guest counts may be
down, remove tables and provide increased distance between guests.
 Consider marketing to customers that you are implementing this practice.
 Increase hand-washing requirements for all employees entering the kitchen and food
preparation areas.

FARGO

April 7, 2020: Mayor Tim Mahoney issued a Stay at Home directive for the City of Fargo to reduce the
spread of COVID-19. The directive will remain in effect until the underlying state of emergency has
ended.

March 23, 2020: The Fargo City Commission has approved the curbside, to-go sale and delivery of
alcohol within Fargo city limits for a period of 30 days beginning Monday, March 23, 2020. Proof of age
and open container laws are not affected by the temporary policy change and businesses will remain held
to a high standard of conduct pertaining responsible service.

WEST FARGO

April 7, 2020: West Fargo City Commission President Bernie Dardis issued a Stay at Home directive for
the City of Fargo to reduce the spread of COVID-19. The directive will remain in effect until the
underlying state of emergency has ended.

Per the Ohio Restaurant Association: 4/13- Gov. DeWine announced that in-person sales of liquor in
Ashtabula, Trumbull, Mahoning, Columbiana, Jefferson, and Belmont Counties will be restricted
only to Ohioans after instances of persons from Pennsylvania coming into these counties for the sole
purpose of purchasing liquor. From this point forward, individuals in those counties must present a valid
Ohio photo ID or a valid military photo ID. Sale of liquor to a person with a valid non-Ohio photo ID may
only occur with additional information showing that the person resides in Ohio, including mail with the
person’s name and Ohio address on it or a letter from an employer placing the person as an essential
Ohio employee.

Governor DeWine announced an Emergency Revised Order for Carry Out and Delivery Sales of
Beer, Wine, Mixed Beverages and Spiritous Liquor

The ORA has been advocating for the addition of spiritous liquor for carry out and delivery. Today the
ORA participated in an Emergency Meeting of the Ohio Liquor Control Commission in which they
approved forwarding the proposed rule to the Governor, who then announced it at his daily news

Here is the Order: Emergency suspension of sales of beer, wine, mixed beverages, and spirituous liquor
for on-premises consumption. Expansion of sales for off-premises consumption. This rule reflects the
need to ensure the public health and safety of all Ohio residents and to prevent the spread of COVID-19
within the state of Ohio. It shall apply to all liquor permit holders that are authorized for on-premises
consumption, whether for general consumption or tasting samples, of beer or intoxicating liquor.

A. All permit holders are prohibited from selling or furnishing beer or intoxicating liquor for any such on-
premises consumption.

B. Sale and delivery of beer, wine, and mixed beverages in the original packages for off-premises
consumption is permitted by the holders of these permits to the extent permitted by law or rule.

C. Liquor permit holders authorized to sell for on-premises general consumption may sell and deliver
beer, wine, mixed beverages or spirituous liquor by the individual drink for off-premises consumption,
provided the following requirements are met:

1. The permit holder may sell and deliver drinks that it prepares on the premises for a personal
consumer for off-premises consumption;

4. Any sale under this paragraph shall include a food purchase from the premises;
5. No more than two drinks may be sold per meal;
6. The permit holder must comply with all applicable state tax laws; and
7. The permit holder remains subject to all liquor laws and rules including hours of operation,
minimum age requirements, and the prohibition against sales to intoxicated persons.

D. All purchases are subject to open container law upon leaving the permit premises.

E. All persons engaged in the sale of beer, wine, mixed beverages, and spirituous liquor for consumption
off the premises where sold should reasonably attempt to ensure that all patrons and staff maintain a
distance of six feet or greater when possible for the health and safety of all individuals engaged in the
transaction.

Per Ohio Restaurant Association newsletter on 4/5: Governor DeWine encouraged Ohioans to follow the
Centers for Disease Control and Prevention’s (CDC) recommendation to wear cloth face coverings
(masks) in public to help slow the spread of COVID-19. Employers are encouraged to allow their
employees to wear masks as well.

For the restaurant industry, the most critical information is the new Order that says All Persons Stay at

Operations includes:

The state is raising the level of the fight against the Coronavirus pandemic to an official order that
will restrict public movements.

Gov. DeWine said the order signed by Department of Health Director Dr. Amy Acton would go into effect
at 11:59 p.m. Monday, March 23rd, and is in effect thru April 6th (at which time it will be reassessed). It will
require citizens to remain in their homes with certain exceptions.

 Those permitted exceptions include "essential activities" involving health and safety, gathering
necessary supplies and services, outdoor activities except for closed playgrounds, certain types
of work deemed essential, or to take care of others, he said. (see Section 5 of the Order)
 The governor's order also lists essential businesses that will be allowed to stay open (see Section
12 of the Order) and provides guidelines for their operations. Gov. DeWine said those will include
mandated protocols to protect the public health, such as social distancing of at least 6 feet,
washing hands, the availability of sanitizing and cleansing supplies for customers and workers,
and more (see Section 15 of the Order). "These are just basic, common-sense things that we
have already covered", he said.
 The order, however, comes with the heft of enforcement, which the governor said will be pursued
by local health departments and local law enforcement (see Section 17 of the Order).
 The state's action follows those by California, Illinois and New York, which have issued what
some officials have characterized as "shelter in place." "It's pretty much the same thing," Gov.
DeWine said. The state’s order heavily follows US Department of Homeland Security guidance

 Lt. Gov. Husted announced a specific page on the state’s coronavirus resources page dedicated

 Gov. DeWine also announced restrictions on daycares that will become effective Thursday. As of
that day, all daycare centers must operate under a temporary pandemic license that will limit
services to six children per room and teacher, he said. Guidelines for daycares will also include
"rigorous cleaning" schedules and recommendation for no common space, he said. Daycares are
directed to keep children and parents of the same employer together, and limit interactions at
drop-offs and pick-ups.

April 1, 2020: Governor Kevin Stitt held a press conference to provide an update on the State’s response
to COVID-19 and announced he has issued Seventh Amended Executive Order (EO) 2020-07. Seventh
Amended EO 2020-07 extends all of the provisions in Executive Order 2020-07 to April 30, 2020 and
applies to all 77 counties in Oklahoma.

The amended Executive Order provides for the following statewide measures:

 Closes all businesses not identified as being within a critical infrastructure sector, such as gyms,
salons, massage parlors and movie theaters, where counties have community spread effective
through April 30.
 Requires restaurants in all 77 counties to provide take-out and delivery options only and closes all
bars through April 30.
 Postpones all elective surgeries, minor medical procedures and non-emergency dental
procedures until April 30.
 Issues a statewide “Safer at Home” order for adults over the age of 65 and vulnerable individuals
with serious underlying medical conditions until April 30.
 Prohibits visitations to nursing homes and long-term care facilities through April 30.
 Limits gatherings to no more than 10 people through April 30.

March 24, 2020: Governor Kevin Stitt held a press conference to provide an update on the State’s
COVID-19 response and announce amendments to Executive Order 2020-07. Gatherings are limited to
no more than 10 people. Restaurants in Oklahoma counties with confirmed COVID-19 cases are
required to provide take-out and delivery options only and bars in those counties are closed.

March 23, 2020: The Oklahoma ABLE Commission issued a revised Emergency Order allowing mixed
beverage, caterer/mixed beverage, and on-premise beer and wine licensees whose primary purpose is
that of a restaurant, qualifying as a “Type-2” establishment wherein persons under 21 are allowed to
enter, may sell closed original packages of beer and wine only when ancillary to an in conjunction with
food sales, and when such sales are completed in a curbside pick-up or drive through manner only.
Deliveries of alcoholic beverages to consumers shall remain prohibited. This order will expire on April 17,
2020 unless amended or revoked on a prior date.

STILLWATER

Beginning at 8 a.m. tomorrow, March 18, 2020 the City of Stillwater is ordering the closure of many public
venues and restricting restaurants to take out or delivery options within Stillwater city limits. These
additional restrictions are to prevent the spread of the virus within the Stillwater community. These
restrictions will remain in effect until Sunday, April 5—but may be extended.

Effective immediately, Mayor Bynum issued an executive order to close all Tulsa bars. At midnight, the
Mayor has directed the closure of all commercial establishments and places of public accommodation,
including restaurants, food courts and large entertainment venues. The executive order applies to places
like taverns, breweries, hookah bars, fitness centers, spas, amusement parks, etc. The executive

On March 23, 2020, Governor Kate Brown issued Executive Order 20-12, directing everyone in Oregon to
stay home to the maximum extent possible and adding to the list of businesses that will temporarily be
closed to stem the spread of COVID-19 in Oregon. This order is effective immediately and remains in
effect until ended by the Governor. Restaurants, bars, taverns, brew pubs, wine bars, cafes, food courts,
coffee shops, or other establishments that offer food or drink are prohibiting on-premises consumption but
are allowing take-out or delivery service.

On March 16, 2020, Governor Kate Brown announced new measures to flatten the curve of coronavirus
transmission in Oregon. The new orders on social distancing measures are effective March 17, 2020 for
at least four weeks, and they include:

 A statewide cancelation of all events and gatherings larger than 25 people — exempting essential
locations like workplaces, grocery stores, pharmacies, and retail stores. It is additionally
recommended that Oregonians avoid gatherings of 10 people or more.

 Restaurants, bars, and other establishments may not offer food or beverages for on-site
consumption; they are restricted to carry out and delivery only.

 Food service at health care facilities, workplaces, and other essential facilities will continue.

 All other businesses are urged to assess their practices, implement strong social distancing

Pennsylvanians wear a mask any time they leave their homes for life-sustaining reasons. As COVID-19
cases steadily rise in the state, Gov. Wolf stressed the need to intensify all measures to help stop the
spread of the virus.

April 1, 2020: Governor Tom Wolf and Secretary of Health Dr. Rachel Levine announced all 67
Pennsylvania counties will be under stay-at-home orders effective at 8pm on April 1, 2020. The statewide
stay-at-home order will continue until April 30, 2020. All Pennsylvania schools will remain closed until
further notice and non-life-sustaining business closures remain in effect. All essential state services will
continue.

March 31, 2020: Governor Tom Wolf and Secretary of Health Dr. Rachel Levine revised the Stay at
Home Order to include Cameron, Crawford, Forest, Franklin, Lawrence, Lebanon and Somerset counties.
The amended order went into effect at 8pm on March 31, 2020 and will continue until April 30, 2020. All
individuals residing in these counties are ordered to stay at home except as needed to access, support,
or provide life sustaining business, emergency or government services.

March 19, 2020: Governor Tom Wolf ordered all non-life sustaining businesses in Pennsylvania to close
their physical locations as of 8pm. Life sustaining businesses may remain open, but they must follow, at
a minimum, the social distancing practices and other mitigation measures defined by the Center for
Disease Control to protect workers and patrons. Businesses that offer carry-out, delivery and drive-
through food and beverage service may continue, so long as social distancing and other mitigation
measures are employed to protect workers and patrons.

This order is effective immediately and will remain in effect until further notice.

On March 16, 2020, Governor Tom Wolf has ordered that all restaurants and bars close their dine-in

On March 15, 2020, the city of Pittsburgh prohibited all public gatherings of 50 or more people to help
stop the spread of the COVID-19 virus. On Friday March 13, 2020, the city announced all events of 250
people or more would be prohibited starting at 9am the following day. That ban was extended to require
the cancellation of all gatherings of 50 or more people in the city. The Alleghany County Health
Department has additionally called for a voluntary 14-day closure of all non-essential businesses in the

April 11, 2020: Governor Wanda Vázquez Garced announced the signing of the new Executive Order
2020-033 that establishes the extension of the period of “lock down” and curfew until May 3, 2020. In
relation to businesses, the Executive Order maintains that those who offer services such as selling
prepared food using the “servi-cart” model, pick-up or delivery, businesses related to food distribution
chains, supermarkets, grocery stores and food kiosks fresh, will be exempt from closure.

Those supermarkets that offer delivery or delivery services will be allowed to do them until 10:00 pm,
Monday through Saturday, in order to promote this method. However, on Sundays the supermarkets and
grocery stores will be closed to the public and by way of exception, will limit their operations to cleaning,
disinfection and handling of merchandise.

April 7, 2020: Governor Wanda Vázquez Garced signed an amendment to Executive Order 2020-029,
related to the closure of shops and businesses, specifically for this Easter weekend, from April 10-12,

 On Friday, March 20, after a meeting in the Governor’s mansion, another letter was sent to the
governor presenting specific requests and necessary actions.
 To better understand the economic status of the industry, we conducted an electronic survey (a)
asking an estimate of loss in sales; (b) if they were currently operating; and (c) if they expected to
continue operations in a limited way. The preliminary results were:
o Almost 80% of those surveyed revealed that they estimated their sales losses in about
75% or more.
o Even so, due to their commitment to their employees and customers, 50% expected to
continue operating during this period of crisis. We are planning on repeating this survey
in the near future for updating purposes.

We have made ourselves available to the government, through the Puerto Rico Business Emergency
Center to serve as liaison, support, tactical advice and communication in both ways of our industry

On Tuesday (March 17), Gov. Henry McMaster announced that all bars and restaurants statewide must
cease offering dine-in service, effective Wednesday (March 18). Gatherings of more than 50 people are

3/31- Laredo TX- Starting Thursday, all people in Laredo over the age of 5 will have to wear some kind of

3/31- Governor Greg Abbott today issued an Executive Order implementing Essential Services and

Activities Protocols for the entire state of Texas. The protocols direct all Texans to minimize non-essential

gatherings and in-person contact with people who are not in the same household. The Governor’s

Executive Order renews and amends his previous order enforcing federal social distancing guidelines for

COVID-19, including closing schools and instructing Texans to avoid eating or drinking at bars and

restaurants. The protocols allow exceptions for essential activities and services based on the Department

of Homeland Security’s guidelines on the Essential Critical Infrastructure Workforce. Examples of these

The Executive Order renews and expands the Governor's previous directive to minimize social gatherings

and minimize contact with people who are not in the same household. It also renews the Governor's

directive to avoid eating or drinking at bars, restaurants, and food courts, and visiting gyms or massage

establishments, and it expands the order to include tattoo studios, piercing studios, and cosmetology

salons.

In accordance with federal guidelines, people are still prohibited from visiting nursing home, state

supported living centers, assisted living facilities, or long-term care facilities unless to provide critical

assistance. Additionally, schools will remain temporarily closed to in-person classroom attendance

through May 4, 2020.

This Executive Order does not prohibit people from accessing essential services or engaging in essential

daily activities, such as going to the grocery store or gas station, providing or obtaining other essential

 All food employees must be knowledgeable of the relationship between personal health, hygiene
and food safety. Due to the COVID-19 pandemic, guidance regarding COVID-19 is in
accordance with 64 CSR 17 Food Establishment Rule - 2013 FDA Food Code—8-304.11(H).
 Employers are being requested to monitor their employees daily for common symptoms of
COVID-19, including checking employee’s temperature upon arrive for work.

3/24 - Wisconsin Governor Tony Evers has issued a month-long safer at home order that closes all non-
essential business and prohibits all non-essential travel in the state during the coronavirus outbreak.

The order will go into effect at 8 a.m. Wednesday, March 25 and remain in effect until 8 a.m. on Friday,
April 24, unless the governor announces otherwise.

On March 17th, the Governor declared a ban on gatherings of 10 people or more.

Additionally, the Governor declared closing of dining rooms in restaurants. Foodservice establishments

Food Establishments

 Restaurants may remain open for take-out or delivery service only. No seating may be provided,
and food may not be consumed at the restaurant. Restaurants shall preserve social distancing of
six feet between customers during pick up.

 Retail food establishments (grocery stores, convenience stores, farmer’s markets), as long as the
requirements listed below are followed

o Close all seating intended for serving food;

o Cease self-service operations of salad bars, beverage stations, and buffets; and

o Prohibit customers from self-dispensing all unpackaged food.

All gatherings that bring together or are likely to bring together less than 10 people in a single room or
confined or enclosed space at the same time must:

 Preserve social distancing of six feet between people; and


 Follow all other public health recommendations issued by DHS and CDC.

Restaurant Carryout Zone Program

In an effort to slow the spread of the COVID-19 virus, on March 16 Governor Tony Evers restricted
restaurant service to delivery and carry-out only. To assist restaurants that currently do not have a
"Loading Zone" adjacent to their business, the City of Milwaukee has implemented a temporary program
to provide "Restaurant Carryout Zones".

 "Restaurant Carry-Out Zones" are intended to make it safe and convenient for customers to pick-
up orders from restaurants. The expectation is that orders will be taken out to the customer’s
vehicle and lessen possible exposure to COVID-19
