Read the following carefully and write a judgement after framing necessary issues : The plaintiff Ramesh Sahu, resident of Telibagh Raipur filed a suit against the defendant Suresh for specific performance of contract. According to plaintiff, defendant is owner of plot no. 304 at Telibagh measuring 205 square meter for which the defendant Suresh entered into agreement of Salés on 1-7-2015 for consideration of Rs. Ten lacs. It is claimed by the plaintiff that a sum of Rs. Five lacs was paid on the date of agreement as advance|and remaining amount a 40 40 Ads - of Rs. Five lacs was to be paid upto. October 2015fThe agreement of sale deed was registered on the same day)The plaintiff paid remaining amount of Rupees Five lacs through bank draft on October 3, 2015. On demand of execution of sale deed by plaintiff, the defendant refused for execution and offered to return the sum of Rs. Ten lacs received from plaintiff for which plaintiff did not agree. Plaintiff has sent a legal notice to defendant through his Advocate Dinesh Kumar which was returned with “Refused to Accept” note. The plaintiff produced agreement of sale date 1-7-2015 Ex. P1, said to be executed by defendant. In addition, plaintiff has also produced a photo-copy of Bank Draft of Rs. Five lacs date 3-10-2015 as Ex. P2. Plaintiff has also produced the copy of legal notice sent by his Advocate Dinesh Kumar as Ex. P3. The defendant has accepted the receipt of Rs. Five lacs as advance and tg na lacs as second instalment but refused the receipt of any legal notice, In addition the defendant has also argued that the property agreed to be soldis an ancestral property in which his two adult sons also have their right and they are refusing to sell the property hence under changed circumstances, it is not possible to enforce specific performance of contract. Hence the suit is liable to be dismissed. The defendant has reiterated that he is agreed to return the amount of Rs. Ten lacs received by rl . Read the following carefully and write judgement after framing the necessary charges. On June 10, 2015 at 8.00 a.m. while ‘A’ had gone to a ‘Hair Cutting Saloon’ for hair cut situated at the distance of 500 meters from his home and both of his children were in school and his wife was in bathroom, ‘B’ entered ‘A’s’ house and stole laptop which was lying in his outer room, not finding his laptop, after returning from hair cutting, ‘A’ lodged an FIR with police station (Ex. — P1). Police started investigation just after lodging the FIR and during investigation ‘C’ the neighbour of ‘A’ told that he saw ‘B’ carrying a laptop in the morning from ‘A's’ house. On 11-6-2015, the police raided the premises of ‘B’ on basis of suspicion and recovered laptop (Article Q — 1) from there. In identification proceedings ‘A’ identified his laptop: | Supporting the prosecution story A (PW — 1) stated that he identified the laptop in identification proceedings. He also produced the purchase documents (Ex. — 2) of the laptop to prove his ownership. Witness ‘C’ was also produced as PW —2 who stated that he is a neighbour of ‘A’ and on 10-6-2015 at about 8 a.m. he saw ‘B’ was carrying a laptop in front of his house.
