Trademark Infringement Swiss watchmaker, Swatch Group has filed a lawsuit in the U.S. District Court for the Southern District of New York against Samsung Electronics Co and Samsung Electronics America Inc for trademark infringement. The plaintiff allege that the defendants infringed upon its trademark on the design of some downloadable watchfaces for Gear-line smartwatches. The plaintiff claims that the marks used in some downloadable watchfaces distributed by Samsung is similar to the Swatch trademark which has caused a whole lot of damages, unfair competition and unfair business practice. “This unabashed copying of the Trademarks can have only one purpose – to trade off the fame, reputation, and goodwill of the Swatch Group Companies’ products and marks built painstakingly over decades,” Swatch Group said. The plaintiff argues that the marks that is infringed is exclusively owned by Swatch group brands including Longines, Omega, Swatch, and Tissot. According to the lawsuit, the case was filed in the United States because that was where its trademarks were registered and where apps for Samsung’s Gear Sport, Gear, S3 Classic and Frontier watches could download watch face designs that infringed its trademarks. “This is a blatant, wilful and international violation of our trademarks by Samsung,” a Swatch spokesman said. Swatch seeks trail and payment of more than $100 million in damages. U.S News | Besweet Creations Sue Trureflections over Gummy Bear Trademark Infringement This week, a Florida-based vitamin company, Besweet Creations has filed a lawsuit in the US District Court for the Southern District of Florida against a Texan rival, Trureflections for trademark infringement over its line of “vitamin gummies”. The plaintiff owns the ‘Sugarbearhair’ brand of hair vitamin products which was registered in 2015 with registration number US number 5,033,503. According to the lawsuit, the plaintiff claims that they have used the registered mark in marketing a line of vitamin products, including hair vitamins and have invested significant resources into developing its brad which presently has earned goodwill and a great reputation. The plaintiff allege that Trureflections copied its signature gummy bear design and the decorative bottle without authorization. The plaintiff allege that the infringement has caused damages, confusion and unfair competition.
