Bihar Minerals (Prevention of Illegal Mining, Transportation and Storage)
(Amendment) Rules, 2014.
No. 4@oh0eq0&20&40@14&3084@,e0—In exercise of the powers conferred by section
23C of the Mines & Minerals (Development & Regulation) Act, 1957, the Governor of
Bihar is hereby pleased to make the following Rules to amend the Bihar Minerals
(Prevention of Illegal Mining, Transportation and Storage) Rules, 2003 :-
1. Short title, extent and commencement–(1) These Rules may be called Bihar
Minerals (Prevention of Illegal Mining, Transportation and Storage) (Amendment)
Rules, 2014.
(2) It shall extend to the whole of the State of Bihar.
(3) It shall come into force with effect from the date of its publication in the
Official Gazette.
2. The following new sub rule (vii) shall be added after sub rule (vi) of Rule 4 of the
said Rules, 2003:-
"(vii) The transportation of stone mineral from other states into the State of Bihar
shall be permitted only in the form of stone chips supplemented with valid
transporting challans/ transit pass issued by the lease holders/ stone stockist licensees
of the State concerned from where the said mineral has been dispatched. No stone
boulder shall be permitted to be transported into the State of Bihar from other States:
Provided that in the interest of the State and in emergent situation, the stone
boulders may be permitted to be transported into the State of Bihar from other States
by the Works Departments of the State Government and/ or their authorized
representatives, for which the District Collector shall be the competent authority."
3. The words " except of stone minerals used for crusher" used in the first proviso of
sub rule (1) of Rule 7 of the said Rules, 2003 shall be substituted by the words
"except for stone in the form of boulders brought from outside the State of Bihar
and from within the State of Bihar."
4. The second proviso of sub rule (1) of Rule 7 shall be substituted by the following :-
"Provided further that no person shall be permitted to erect, install or operate a stone
crusher outside a lease hold area or stock stone mineral in any form outside the lease
hold area for the purpose of being used by a stone crusher;
Provided futher that the existing stockist license held for stone mineral used
for crusher shall remain operational till the validity of their license period, on the
condition of the licensee abiding by all the relevant rules/ provisions of law.”

5. The figures and words "Rs. 500/-" used in clause (a) of sub rule (2) of Rule 7 of the
said Rules, 2003 shall be substituted by the figures and words "Rs. 5000/-" and the
figures and words "Rs. 100/-" in clause (c) shall be substituted by the figures and
words "Rs. 1000/-"
6. Form "CA" of the said Rules, 2003 is hereby deleted.
