I, DENIS K. NDOLO, an Advocate of the High Court of Kenya practicing as such in the
firm of Kilonzo & Company Advocates for the Applicant herein do hereby certify the
Notice of Motion Application herein to be of utmost urgency requiring to be placed
before the Honourable duty Judge at the earliest opportune moment and heard on
priority basis as the entire object of this application will be defeated and rendered
nugatory should the Respondent herein proceed with the execution of the judgement
and/or decree delivered on 4th February 2019 by the Honourable Lady Justice linnet
Ndolo. There is no Stay of Execution in place and the Respondent may at any time
from then proceed and execute the aforesaid judgement/decree.

In the event that the Respondent proceeds with the execution, the Applicant stand to
suffer injustice, irreparable loss and damage hence the urgency of this Application.
