Abstract

Discrimination and Human Rights Violation in India: A Legal Framework1

Human rights are universal all over the world. These are the basic rights which are inherent to
every living being born as a human. They apply equally to men and women, girls and boys
irrespective of caste, creed, colour, sex, race and all other worldly affairs. All the individuals are
entitled to the same rights to life, education, political participation, etc. in the country. However,
these rights are being violated in multiple ways in virtually all over the country. While, women,
children, minorities, immigrants and refugees are being deprived of their basic fundamental and
human rights in India which leads to discrimination among themselves in the country. These are
the fundamental and human rights to which every individual is entitled and the rights are
protected by law. For instance, Article 21 of the Constitution of Indian talks about “Right to life
and personal liberty” which is guaranteed to all individuals in the country irrespective of caste,
creed, colour, or sex. Discrimination and the human rights violation is a harsh reality and a
common problem for most of the people and it is one of the unalterable and stern problem
existing in societies throughout India. The problem is prevalent globally despite substantial
national and international measures which are been taken towards the issue since the time
immemorial. But no concrete solutions have been found out because the root cause is the narrow
mind set of the society towards, minorities, women, sex workers, etc. Therefore, this paper will
analyse the existing framework on discrimination and human violations rights in India and
briefly discuss the veracity of the human rights issues facing people in the areas of law, health,
safety and education and emphasize the fundamental role that stigma and marginalization play in
these abuses.
