10 sip dan Hak Dasar Pasal Ill Setiap Negara Anggota harus memastikan bahwa ketentuan peraturan perundang- undangannya, dalam konteks Konvensi ini, menghormati hak-hak dasar terhadap: (a) kebebasan berserikat dan pengakuan yang efektif terhadap hak atas perundingan bersama; (b)_ penghapusan segala bentuk kerja paksa atau walib kerja; (c) penghapusan efektif pekerja anak; dan (d) penghapusan diskriminasi _berkaitan dengan pekerjaan dan jabatan. Hak Bekerja dan Sosial bagi Awak Kapal Pasal IV 1 Setiap awak kapal mempunyai hak atas tempat kerja yang aman dan terlindungi sesuai dengan standar keselamatan. 2. Setiap awak kapal mempunyai hak atas syarat-syarat kerja yang adil. 3. Setiap awak kapal mempunyai hak atas kondisi kerja dan kehidupan yang layak di atas kapal. 4. Setiap awak kapal mempunyai hak atas perlindungan kesehatan, perawatan medis, tingkat Kesejahteraan dan bentuk-bentuk — perlindungan _ sosial lainnya. Konvensi Ket 2008 sgakersen Wa Fundamental Rights and Principles Article Il Each Member shalll satisfy itself that the provisions of its law and regulations respect, in the context of this Convention, the fundamental rights to: (a (b) (c) @ freedom of association and the effective recognition of the right to collective bargaining: the elimination of all forms of forced or compulsory labour; the effective abolition of child labour; and the elimination of discrimination in respect of employment and occupation. Seafarers’ Employment and Social Rights Article IV Every seafarer has the right to a safe and secure workplace that complies with safety standards. Every seafarer has a right to fair terms of employment. Every seafarer has a right to decent working and living conditions on board ship. Every seafarer has a right to health protection, medical care, welfare measures and other forms of social protection.Setiap Negara Anggota harus memas- tikan, dalam —batas-batas —_wilayah hukumnya, bahwa hak kerja dan sosial para awak kapal yang diatur pada ayat sebelumnya dalam Pasal ini telah diterapkan sepenuhnya sesuai dengan ketentuan dalam Konvensi ini, Kecuali dinyatakan lain dalam — Konvensi, penerapan tersebut dapat _dicapai melalui hukum atau peraturan nasional, melalui perjanjian kerja bersama atau melalui kebijakan lain atau sesuai praktik yang berlaku. Pelaksanaan dan Penegakkan Tanggung Jawab Pasal V Setiap Negara Anggota_—_harus melaksanakan dan menegakkan hukum atau peraturan atau kebijakan yang telah diadopsi_untuk memenuhi_ komitmen tethadap Konvensi ini, _berkenaan dengan kapal dan awak kapal di dalam wilayah hukumnya. Setiap Negera Anggota_—harus melaksanakan kewenangan hukum secara efektif dan mengawasi kapal- kapal yang mengibarkan _bendera Negaranya melalui pembentukan sebuah sistem untuk memastikan kepatuhan tethadap persyaratan Konvensi_ ini, termasuk pemeriksaan rutin, pelaporan, pemantauan dan proses hukum sesuai hukum yang berlaku Setiap Negara Anggota harus memasti- kan bahwa kapalkapal yang mengibar- kan bendera Negaranya —memiliki 1 Each Member shall ensure, within the limits of its jurisdiction, that the seafarers’ employment and social rights set out in the preceding paragraphs of this Article are fully implemented in accordance with the requirements of this Convention. Unless specified otherwise in the Convention, such implementation may be achieved through national laws or regulations, through applicable collective bargaining agreements or through other measures or in practice. Implementation and Enforcement Responsibil Article V Each Member shall implement and enforce laws or regulations or other measures that it has adopted to fulfil its commitments under this Convention with respect to ships and seafarers under its jurisdiction. Each Member shall effectively exercise its jurisdiction and control over ships that fly its flag by establishing a system for ensuring compliance with the requirements of this Convention, including regular inspections, reporting, monitoring and legal proceedings under the applicable laws. Each Member shall ensure that ships that fly its flag carry a maritime labour certificate and a declaration of maritime Martie Labour Convention, 2006
