Where the tenderer has been asked to propose the Completion Date, an adjustment should be made to reflect the value to the Emplayer of having the works completed as soon as possible. Ideally this is based on the delay damages stated in the Contract Data part one, but if delay damages are not used the Employer should make an assessment of the value of completion — or the cost of fate completion, which should amount to the same thing, Almost every contract will nave some compensation events, resulting in an outturn cost higher than the tendered total of the Prices. This assessment assumes that the cost of most of the basic resources involved in compensa- tion events will be the same for all tenderers and so only examines elements where there will be differences. The Employer must first make an estimate of the likely difference between tender and outturn prices; this will vary depending on various factors such 2s the nature of the work to be carried out, the nature of the site and the degree of site investigation work carried out. The difference is expressed as a percen- tage of the tendered total of the Prices. This difference must then be subdivided into cost elements ~ people, Equip- ment, Subcontractors, design and the Contractor's Fee. Note that design may be tequited for temporary works even if the Contractor is not responsible for ‘the design of any of the works. Note that the two elements making up the Fee (the direct fee percentage and the subcontracted fee percentage) are applied to different parts of the adjustments. The figure derived from these adjustments is not an estimate of the final ‘outturn cost as It only takes into account those elements which will differ between tenderers. In the example that follons, the following figures will be used to illustrate the procedure. The purpose of this example is to help those unfamiliar with the NEC system to complete the tender documents. It should be read in conjunction with the notes included under the chapter ‘Tender Documents’. The following points should be noted. * The ECC text of the Contract Data formats is reproduced es printed, together with the explanatory sentences which are In bold type, The explana: tory sentences (e.g. ‘Statements given in all contracts’ and sentences beginning ‘If...) are only for the guidance of users and should not be repro- Guced on an actual Contract Data. ‘+ For clarity, quantities have been inserted in the appropriate places. The figures given are imaginary and should not be taken as typical and certainly do not have the status of ‘recommended by the NEC Panel’. The examples of entries are not necessarily consistent throughout. © Most optional statements have been completed so that users can see what should be written if that Option is chosen. In a real enquiry only those state- ‘ments relevant to the Options chosen should be completed. © If an optional statement is required it should be inserted in an appropriate position in the actual Contract Data, within the statements for the relevant section of the ECC. ‘* The statements in the boxes only provide a very abbreviated commentary ‘on completing the Contract Data and should not be relied on. Reference must be made to the conditions themselves and to the relevant guidance notes for a fuller treatment of topics. * The Employer must decide actual details based on the nature of the contract and the allocation of risk required. * Those drawing up tender documents are advised to take care when ‘completing the Contract Data that excessive risks are not passed to the Contractor. The ECC system is much more flexible than any other published ‘contract and allows @ wide range of Employer's choice of allocation of risks ‘on the Contractor, which would be limited in other documents. Common sense needs to be applied otherwise bids will reflect the unrealistic aspira- tions of the Employer. In particular combinations including tight programmes, extended defects dates, large bonds, fixed prices, large retentions and heavy damages should only be used if the Employer's key strategy demands them. * The words of the ECC Contract Data formats should be reproduced without change.
