Sunil Barthwal, Joint Secretary, Ministry of Steel, GOI for the following (1) To ensure that all the project authorities and other end users are instructed to use only BIS certified products with their Standard Marks to avoid safety and security hazards of using inferior grades of ste! (2) Giving wide publicity to steel! quality control orders issued by Ministry of Steel vide notification no. S. ©. 414 (E) and 415 (E) dated 12" March 2012, enclosed as ‘At’ & ‘A2' respectively. These orders cover 16 products critical to safety and security of infrastructure, housing, construction, and public at large. Order No. 414(E) was enforced with effect from September 2012. However Order No. 415 (E) has got several amendments and its date of enforcement was extended from time to time. The Order No. 415 (E) has got several amendments. Second Order, 2012. (2) This Order shall come into force with effect from the 12" September, 2012. Defintions- inthis Order, uniess the context otherwise requires, "Act" means the Bureau of Indian Standards Act, 1906 (63 of 1986); “appropriate authority” means, - (0) amofficer not below the rank of an Under Secretary in the Ministry of Stet: (i) General Managers, District Industies Centres of State Governments; and (ii) Directors or Commissioners of Industries of the Stale Govemments or Union teritories; dealer’, in relation to steel and stee! products, means a person who, or a firm or a Hindu undivided family or @ company or a co-operative society, which carries on, directly or otherwise, the business of buying, selling, supplying or distributing stee! and steel products whether in cash or for defered payment or for commission, remuneration or other valuable consideration; “ITC (HS) Code’, in relation to stee! and steel products means the Indian Trade Classification (Harmonised Systems) Codes as specified in the entries in column (3) of the Schedule “manufacturer’, in relation to steel and steel products, means a person who or a firm or a Hindu undivided family or a company or a co-operative society, which produces, makes, assembles or manufactures steel and steel products and includes a person who, of a firm or Hindu undivided family or a company ora co- operative society which claims such stee! and steel products to be produced, made, assembled or manufactured by such person or firm or Hindu undivided family or a company or a co-operative society, as the case may be; “Schedule” means the Schedule annexed to this Order, “specified standard’, in relation to steel and steel products means the Indian Standard as specified in the entries in column (1) of the Schedule; “State Government” in relation to a Union territory, means the Administrator thereof,6 @ 0 THE GAZETTE OF INDIA : EXTRAORDINARY (Par hie 36) “sleel and steel products” mean the items specified in column (2) of the Schedule; words and expressions used herein and not defined but defined in jhe Act shall have the meanings respectively assigned to them in the Act. Prohibition regarding manufacture, storage, sale, distribution etc.- (1) No person shall by himself or through any person on his behatf manufacture or store for sale, cell or distrbute any stee! and stee! products specified in the Schedule, which do rot conform to the specified standards and do not bear Standard Mark of the Bureau of Indian Standards, on obtaining certification marks licence: Provided that nothing in this Order shall apply in relation to export of stecl and steel products required for export, which conform to any specification required by the foreign buyer. (2) The sub-standard or defective steel and stee! products, which do not conform to the specified standard, shall be disposed off as scrap as per the scheme of testing and inspection ofthe Bureau of Incian Standards Obligation for certfcation.-(1) All manufacturers of steel and steel products shall make an application to the Bureau of Indian Standards for obtaining licence for tse of the Standard Mark, within forty-five days from the date of coming into force of this Order, ifnot already obtained (2) The grant of licence by the Bureau of Indian Standards for use of the ‘Standard Mark shall be a8 per the provisions of the Act and rules and regulations made there under (3) When any person by himsetf or through any person on his behaif proposes to manufacture steel and steel products, he shall commence regular production only after obtaining a valid licence from Bureau of Indian ‘Standards for the use of the Standard Mark (4) Consequent to the expiry of any licence or cancellation thereof by the Bureau of Indian Standards for one or more of the steel and steel products, the said Bureau shall inform the same to the appropriate authority. Power to callfor information, ete.- The appropriate authority may, with @ View to securing compliance with this Order,-fom are 349) (a) “require any person engaged in the manufacture, storage for sale, sale Or. Samples of any steel and steel products bearing the Standard Mark and drawn by the appropriate authority, for ascertaining whether they conform to the specified standard, shall be tested in the laboratory approved by the Bureau of Indian Standards and as specified in the relevant Indian Standard 7. Power to issue direction to manufactures and dealers. - The appropriate authority may issue such directions to manufacturers and dealers, consistent with the provisions of the Act or this Order, as may be necessary for carrying out the provisions of this Order. 3. Compliance of directions - Every person engaged in the manufacture, storage for sale, sale or distribution of any steet and steel products specified in the Schedule to whom any direction is issued under this Order, shall comply with such direction, .
