This Petition is filed pursuant to Presidential Decree (“PD”) No, 1529,! Republic Act (“RA”) No. 26? Land Registration Commission (“LRG”) Circular No. 35, and other applicable rules. IL THE PARTIES 2. PUBLIC RESPONDENT REGISTRY OF DEEDS FOR THE PROVINCE OF ANTIQUE (“RD-Antique”) is impleaded in its official capacity as a public repository or records of instruments affecting registered or unregistered lands, The RD-Antique may be served with notices and other processes of this Honorable Court at Ground Floor, Old Capitol, San Jose, Antique. Il THE PROPERTIES 6. The properties involved in this Petition are the parcels of land known as Cadastral Lot Nos. 1442 and 1449 located in San Jose, Antique (the “Properties”). 7. Petitioners are lawful heirs of Dolores Tiscar Satterthwaite and Rosa Tiscar, and are lawful owners by intestate succession of the Properties, as proved by the respective Deeds of Extrajudicial Settlement covering the Properties. 8. ‘These Deeds of Extrajudicial Settlement were published in Panay News for three (3) consecutive weeks.> A. OCT No, 7424 (Lot No, 1442) 9, Lot No. 1442 is covered by OCT No. 7424, with an area of approximately 7,361 square meters, more particularly described as follows: “An original copy of the Deed of Extrajudicial Settlement of the Estate of Dolores Tiscar Satterthwaite (Lots Nos. 1442 and 1449, among others) is attached hereto as Annex “A” and ‘made an integral part hereof. ‘An original copy of the Deed of Extrajudicil Setslement of the Fstate of Rosa Tiscar (Lot No. 1449) is attached hereto as Annex “B" and mace an integral part hereof. es of the Affidavits of Publication, both dated 20 July 2009, and both executed by Elijah $. Fajardo, the Editor-in-Chief of Panay News, are attached hereto as series" and made integral parts hereof. 5 “A PARCEL OF LAND (Lot 1442 Cad, 216 San Jose Cadastre), situated in the Brgy. of Poblacion, Mun. of San Jose, Prov. of Antique, Island of Panay. Bounded on the NE, along lines 1-2 by Lot 1448; along lines 2-3 by lot 1449; on the SE,, along lines 3-4 by Calle Romana; on the SW., along lines 4-5-6-7 by lot 1441; along lines 7-8 by lot 1431 along lines 8-9 by lot 1420; along lines 9-10-11 by lot 1419; along lines 11-12 by lot 1417; on the NW., along lines 12-13 by Calle Teniente; along lines 13-14-1 by lot 1443 all of Cad. 216 San Jose cadastre x00%"6 10. OCT No. 7424 was issued in the name of Dolores Tiscar Satterthwaite,’ pursuant to Cadastral Case No. 12, G.L. R.O. Cadastral Record No, 943.8 11. Petitioners are in possession of an Owner’s Duplicate of OCT No. 74242 12. However, upon inquiry, the RD-Antique issued a Certification dated 28 January 2013 stating that it no longer has any record of OCT No. 7424.° The RD-Antique also issued a Certification dated 22 February 2013 stating that the record of such title “was one of those destroyed by fire during the World War Il, which resulted in the destruction of over 500 Certificate{s} of Title and comprises more than ten percent of all the titles in [the RD-Antique]”.!* B. OCT No. 6202 (Lot No. 1449) « (Original copies of the Technical Description for Lot 1442 (1 original, 2 duplicate copies and 1 xerox copy), issued by the Lend Management Bureau (“LMB"), are attached hereto as Annexes “D" so "D-seriee” and made integral parts hereof. ? OCT No. 6202 was issued in the names of Rosa Tiscar and Dolores Tiscar Satterthwaite, pursuant to Cadastral Case No. 12, G.L. R.O. Cadastral Record No, 943,13 15. Petitioners are no longer in possession of any copy or Owner’s Duplicate of OCT No. 6202. 16.
