CONTRACT FOR 239 KM HEAVY COAL TRANSPORT ROAD MAINTENANCE, ROAD SIGN, MARKS
AND ROAD FURNITURE WORK FOR TAVAN TOLGOI – GASHUUN SUKHAIT THROUGH
TSOGTTSETSII, BAYAN-OVOO, KHANBOGD SOUM OF UMNOGOBI PROVINCE

This CONTRACT (The “Contract”) is made in accordance with the following mutual agreements
and based on the 10 May, 2018 Bidding process awarded bidder’s bill of quantity between The City Road
Authority (The “Client”) and “Anand Road” LLC (The “Contractor”) on the 23rd day of July, 2015.

1. In accordance with the Civil Law of Mongolia, Law on Auto Road and other relevant
legislations, the significance of this contract is to regulate the relationship between client and contractor,
and to state their respective responsibilities in connection with the construction of engineering structures,
roads and road facilities, execution of repairing and maintenance, installation of equipment and
development of road construction drawings.
2. The client agrees to and authorized the budget of 1 387 831 587 / one billion three
hundred eighty-seven million eight hundred thirty-one thousand five hundred eighty-seven/ tugriks
(“contract price”) for completion of the project for Road construction en route Intersection west of
School number 118, Khoroo 8, Khan-Uul District to hilltop/KUD2015/A3-8-118 (“assignment”). This
contract budget will be equal to the amount required to complete the project.
3. Contract total budget: 1 387 831 587 /one billion three hundred eighty-seven million eight
hundred thirty one thousand five hundred eighty-seven/ MNT. From this: 1 387 831 587 /one billion
three hundred eighty-seven million eight hundred thirty-one thousand five hundred eighty-seven
comes from City Road Funds.
4. The contractor must start the construction work for Road construction en route Intersection
west of School number 118, Khoroo 8, Khan-Uul District to hilltop on 23 July, 2015 and complete it
by 25 September, 2015.
5. The following documents (“Contract documents”) will be a part of this contract. This includes:
a. Authorization to sign in the contract;
b. Other Required Documents;
c. Contract Special Requirements;
d. Contract General Requirement;
e. Work size and figures;
f. Drawings;
g. Budget;
h. Construction schedule day-to-day provided by the contractor;

6. This contract acts as the final agreement from both sides to complete the construction of the
project. In case of a conflict depending on the contract documents, it will be resolved through the
importance of order above.
7. The contractor shall complete the construction of the project within time in accordance with the
required works from the contract including any complaint from Defects Notification Period.
8. The client is obligated to pay the contractor the amount required by the contract budget and to
consider works based Defects Notification Period.
9. The parties shall communicate via official writings or telephone for any issues relating to the
contract.
