PROSECUTION’S STORY

1. A company named NLC Pvt. Ltd. owned by Simarjeet Vashishth & Suryansh
Setia produced the drug ‘SARACETAMOL’ to cure Tebola while Arunima K. was
the financer and benami owner. Simarjeet wanted the drug to be sold at cheap price
as it would help people like his wife, who died of Tebola virus.

2. But Suryansh and Arunima had other plans, they wanted to sell the drug at high
price while aiming to procure funds and they decided to sell it to Silverlines Pvt.
Ltd. owned by Ankit Singh. Silverlines had offered higher price than other
companies in the market. Also Ankit Singh immediately showed interest in the
deal considering the huge profits that his company can harvest from it.

3. Simarjeet Vashishth and suryansh setia were the on record owner of the
company and without both of their consent (majority; section 47 CA’2013) the
drug cannot be sold. Arunima K. was only a financer and hence she did not had a
right to vote and to sell the drug legally to silverlines company the consent of both
the owners was required unanimously. After Suryansh, Arunima and Ankit ran out
of all the tantrums to get the ball in their court, the three accused in the final
meeting on 17th September to lure Simarjeet, which Simarjeet left angrily. After
Simarjeet left the three accused conspired to kill Simarjeet.

4. They all conspired to kill Simarjeet but to get rid of the charges they tried to
portray it as an accident. Ankit Singh decided execute his plan of action in the
party which was going to happen at Silverlines. The three accused and Simarjeet
arrived at the party as per the plan, after a meeting which was held in Silverlines
Tower as their last attempt to lure Simarjeet.

6. At the party, Arunima entered into a heated argument with Simarjeet making
him aggressive and then went down stairs angrily. Ankit went to Simarjeet with a
drink to engage him into a deep conversation. During this there was a power cut
while taking the advantage of darkness Ankit Singh put down his glass of drink
and tried to pull Simarjeet down the rooftop by holding his collar and left hand and
during the fight Simarjeet's watch fall down and broke. While this rustle was going
on, suddenly Suryansh hit Simarjeet with some object on the left side of his head.
These chains of events helped them to push Simarjeet down the building. Due to
hit on his head, blood spilled on the watch and floor.

7. At one point during the power cut everyone heard a scream and a loud thud,
finding a man down. People rushed down in panic, but the three accused namely
Arunima, Suryansh and Ankit stayed back to tamper the evidences. Firstly, they
washed out the floor off. They hid the object of attack. To their utter misfortune the
watch had blood drops too, and to clean the same they picked it up, washed it and
placed it back at the crime scene. But they forgot that when the watch fell, it fell on
the glass side which broke the glass but they placed it facing upside down.

Arunima was seen going down in the video footage before the lights went out.
After the lights came back Arunima can be seen coming upstairs midway.

On 5th august the deal was accepted by SIlverlines for which it gave 10 crores to
Suryansh as commission for getting the deal done. But since Simarjeet was not
ready to sell the drug, the three accused tried to lure him over a period of almost
1 month uptil 17th September. When finally on 17th September Simarjeet refused
to accept the deal and sign the paper of sale, after Simarjeet left, the three
accused conspired to kill him in the party that was organised by Silverlines.
