is already in the bank to present the check for payment, Pedro noticed that the checks has been
previously dishonoured for reason of “Account Closed”. Is Pedro liable for Theft? Reason out.

3. Pedro entered the house of Juan and, by means of force and intimidation, took the Wrist Watch worth
P500,000, after a series of monitoring done by Pedro that the Wrist Watch Juan was using is the same
wrist watch that Pedro lost one month ago while inside a cockpit. Is Pedro criminally liable for Theft?
Reason out.

5. Pedro owns Pedro Hardware and Electrical Supplies. Last April 25,2020, Juan ordered electrical
supplies worth P500,000 and paid a check for the said amount dated on the same day and Juan assured
Pedro that the check will be honoured by the bank when presented for payment to the drawee-bank.
Pedro readily accepted the check and as a consequence, immediately delivered the materials to the
house of Juan. When the check was presented for payment, the bank dishonoured it for insufficiency of
funds and corresponding notice of dishonour was sent and received Juan. What crime or crimes did Juan
commit? Reason out.

6. Pedro owns a dog named “Snow”, which Pedro is so fond of. Maria, the household maid, was jealous
because it seems that Pedro considered Snow more prettier and beautiful than her (Maria) and Pedro
would sometimes say this to Maria, though by way of jest. Because of this, instead of feeding Snow the
usual dog food, Maria gave Snow a food with poison resulting in the death of Snow? What felony under
the Revised Penal Code did Maria commit? Reason out.

1. Pedro committed Robbery by use of force upon things in a private building which is in Article 302 of
the Revised Penal Code. Pawnshop is considered a private property and taking of the closed chest
with jewelries for the purpose of gaining against the owner. And force is used to enter the building

2. Yes. Even though Pedro stole dishonored checks, he still committed theft because there was still
taking of personal property which belongs to another, the taking was done with the intent to gain, the
taking was done without the consent of the owner, and it was done without use of violence against or
intimidation of persons or force upon things.
3. No. Pedro is not criminally liable. Even though he has the intent to gain, took Juan’s wrist watch.
Because that same wrist watch turned out to be his own property. He cannot commit robbery on his
own property even if he uses violence or intimidation.
4. Article 308 of the Revised Penal Code does not expressly or impliedly allows that the free
disposition of the items stolen is in any way detereminative of whether the crime of theft has been
produced. There is no crime of frustrated theft.
5. Juan committed Estafa by issuing a check in payment of an obligation and thaat such issuing of the
check was done when he had no sufficient funds to cover the amount of the check for payment of the
electrical supplies from Pedro.
6. Maria committed Malicious Mischief. Her poisoning Pedro’s dog, Snow, was due to hate and
jealousy towards the dog and with the intent to kill the dog.
