According​ ​to​ ​“The​ ​Legal​ ​Rights​ ​of​ ​Students​ ​and​ ​Teachers”​ ​written​ ​by​ ​Nelda​ ​H.

Cambron-McCarthy,​ ​Martha​ ​M​ ​McCarthy,​ ​and​ ​Suzanne​ ​E.​ ​Eckes,​ ​the​ ​state​ ​of​ ​Nevada​ ​is​ ​in​ ​the

ninth​ ​circuit​ ​court​ ​of​ ​appeals.​ ​The​ ​state​ ​constitution​ ​of​ ​Nevada​ ​has​ ​19​ ​Articles,​ ​which​ ​can​ ​be

found​ ​in​ ​resource​ ​section​ ​of​ ​the​ ​companion​ ​website​ ​of​ ​ ​“School​ ​Law​ ​for​ ​Teachers:​ ​Concepts​ ​and

Applications”​ ​by​ ​Julie​ ​Underwood​ ​and​ ​L.​ ​Dean​ ​Webb.​ ​ ​Article​ ​11​ ​deals​ ​with​ ​education.​ ​There

are​ ​10​ ​sections​ ​included​ ​for​ ​education.

The​ ​first​ ​section​ ​says​ ​that​ ​the​ ​state​ ​legislature​ ​should​ ​encourage​ ​intellectual,​ ​moral,​ ​and

scientific​ ​improvements​ ​and​ ​provide​ ​a​ ​“superintendent​ ​of​ ​public​ ​instruction”​ ​and​ ​have​ ​a​ ​law​ ​that

governs​ ​the​ ​superintendent.

Section​ ​2​ ​makes​ ​it​ ​so​ ​all​ ​public​ ​schools​ ​are​ ​following​ ​the​ ​same​ ​system​ ​of​ ​instructions​ ​and

any​ ​schools​ ​that​ ​deviate​ ​from​ ​the​ ​system​ ​will​ ​lose​ ​their​ ​funding​ ​until​ ​they​ ​get​ ​back​ ​with​ ​the

program.​ ​Also​ ​they​ ​have​ ​to​ ​pass​ ​laws​ ​to​ ​make​ ​sure​ ​students​ ​get​ ​to​ ​class​ ​(truancy​ ​laws)​ ​and

schools​ ​have​ ​to​ ​hold​ ​sessions​ ​at​ ​least​ ​six​ ​months​ ​a​ ​year.

The​ ​third​ ​section​ ​just​ ​says​ ​that​ ​any​ ​money​ ​the​ ​state​ ​makes​ ​off​ ​of​ ​the​ ​land​ ​set​ ​aside​ ​for

educational​ ​purposes​ ​and​ ​any​ ​money​ ​from​ ​fines​ ​from​ ​penal​ ​laws​ ​must​ ​be​ ​used​ ​for​ ​educational

purposes​ ​and​ ​cannot​ ​be​ ​moved​ ​to​ ​another​ ​fund.

Section​ ​4​ ​says​ ​that​ ​the​ ​legislature​ ​will​ ​provide​ ​for​ ​a​ ​state​ ​university​ ​that​ ​has​ ​programs​ ​in

Mining,​ ​Agriculture,​ ​and​ ​Mechanics.​ ​The​ ​legislature​ ​will​ ​also​ ​pass​ ​laws​ ​to​ ​make​ ​a​ ​Board​ ​of

Regents​ ​to​ ​oversee​ ​the​ ​university.

Section​ ​5​ ​states​ ​that​ ​the​ ​legislature​ ​can​ ​make​ ​normal​ ​schools​ ​as​ ​it​ ​deems​ ​appropriate​ ​and

that​ ​educators​ ​in​ ​these​ ​schools​ ​have​ ​to​ ​take​ ​the​ ​oath​ ​in​ ​article​ ​15​ ​of​ ​the​ ​state​ ​constitution​ ​and​ ​any

teacher​ ​that​ ​fails​ ​to​ ​act​ ​accordingly​ ​to​ ​the​ ​laws​ ​that​ ​work​ ​with​ ​section​ ​5​ ​will​ ​not​ ​be​ ​paid​ ​with

state​ ​funds.

Section​ ​6​ ​says​ ​that​ ​normal​ ​schools​ ​get​ ​funding​ ​from​ ​the​ ​state,​ ​that​ ​grades​ ​k-12​ ​are

budgeted​ ​first,​ ​and​ ​if​ ​they​ ​fail​ ​to​ ​do​ ​this​ ​they​ ​have​ ​to​ ​hold​ ​special​ ​sessions.

Section​ ​7​ ​just​ ​states​ ​that​ ​the​ ​governor,​ ​superintendent​ ​of​ ​public​ ​instruction,​ ​and​ ​secretary

of​ ​state​ ​will​ ​serve​ ​as​ ​the​ ​university's​ ​board​ ​of​ ​regents​ ​until​ ​a​ ​full​ ​board​ ​with​ ​set​ ​duties​ ​is​ ​elected

in​ ​four​ ​years.

The​ ​eighth​ ​section​ ​makes​ ​it​ ​so​ ​the​ ​interest​ ​from​ ​the​ ​initial​ ​education​ ​funds​ ​is​ ​used​ ​to​ ​fund

the​ ​mining​ ​department​ ​of​ ​the​ ​state​ ​university,​ ​while​ ​money​ ​made​ ​from​ ​selling​ ​public​ ​lands​ ​given

to​ ​the​ ​state​ ​by​ ​the​ ​federal​ ​government​ ​is​ ​used​ ​to​ ​fund​ ​the​ ​Agriculture,​ ​Mechanic,​ ​and​ ​military

tactic​ ​departments​ ​of​ ​the​ ​university.​ ​In​ ​Addition,​ ​if​ ​any​ ​of​ ​this​ ​money​ ​is​ ​lost,​ ​the​ ​state​ ​will​ ​pay

the​ ​difference​ ​so​ ​the​ ​fund​ ​remains​ ​even.

Section​ ​9​ ​prohibits​ ​sectarian​ ​instruction.

Finally,​ ​Section​ ​10​ ​prohibits​ ​public​ ​money​ ​being​ ​used​ ​for​ ​sectarian​ ​purposes.
