Memo re: Precautionary Measures in the Delivery of Frontline Services in line with the Enhanced Community Quarantine dated 17 March 2020; c. RA 11032 - An Act of Promoting Ease of Doing Business and Efficient Goverment Delivery Services Amending for the Purpose Republic Act No. 9485, Otherwise Known as the Anti-Red Tape Act, and for Other Purposes; and d. RIRR of RA 9514 Otherwise Known as the Fire Code of the Philippines of 2008. 2. As per ref “a” and in order to ensure unhampered delivery of BFP services to the Filipino people during emergency period, you are hereby directed to adopt measures to extend the validity of all applications for the renewal of FSIC until the Enhanced Community Quarantine is lifted. 3. Further, applications for renewal of expired FSIC shall be treated as the regular application and the issued Notices and Orders with elapsed grace period shall be processed without penalty and it shall be deemed extended. @O 4. Kung gusto ninyo magloko, huwag itong panahon na ito.” President Rodrigo Roa Duterte 24 March 2020 Address to the Nation Consistent with the letter and intent of the recently enacted Republic Act No. 11469 or the “Bayanihan to Heal As One Act” authorizing the President to undertake emergency measures to expedite delivery of government services in view of the declaration of a State of Calamity? throughout the Philippines due to Corona Virus Disease 2019, the Anti-Red Tape Authority (Authority), pursuant to its mandate to implement and oversee a national policy on anti-ed tape and ease of doing business* and complemented by the President's directive to eliminate overregulation to promote efficiency of government processes’, hereby issues the following advisory for the adoption of fast-track measures during this period, * Specifically, Section 4 thereof. * Presidential Proclamation No. 929. 3 See. 17 (a) of Republic Act No, 11032 (Ease of Doing Business and Efcient Government Service Delivery Act of 2018). * Administrative Order No, 23 dated February 21, 2020. Smarter Initiatives, | 2 I, PURPOSE ‘This ADVISORY is issued to all Government Agencies including Local Government Units (LGUs), as defined in Section Ill herein, with measures and tools they can adopt to fast track and simplify their respective procedures and documentary requirements, consistent with the policies of RA Nos. 11032 and 11469, the mandate of Pres. Proc. No. 929, and the recent pronouncements of the President. il, COVERAGE This ADVISORY shall apply to all government agencies falling within the jurisdiction of the Anti-Red Tape Authority pursuant to Section 3 of RA No.11032, fo wit: “This Act shall apply to all government offices and agencies including Local Government Units (LGUs), govemment-owned or -controlled corporations and other government instrumentalties, whether located in the Philippines or abroad, that provide services covering business and nonbusiness related transactions as defined in this Act." IV, SUGGESTED MEASURES {In reviewing their respective procedures and documentary requirements for purposes of simplifying and streamiining these to speed up government service delivery, all Government ‘Agencies may be guided by the following measures: 4. Emergency Extensions. This pertains to extension of the validity of permits, licenses, certifications and other similar authorizations that are expiring within the period of State of National Emergency, particularly licenses whose application for renewal or extension may not be filed, processed, or are pending approval due to the ECQ. Some agencies already adopted this emergency measure such as the Land Transportation Office (LTO) $ and Bureau of Customs (BOC). Thus, the Heads of Agencies are likewise encouraged to exercise their discretion in adopting similar practice of extending the validity of their agencies’ issued license, clearance, permit, certification oF authorization, without prejudice to existing laws. 2. Electronic Submissions and Approvals. Agencies previously operating through ‘manual procedures may consider accepting applications or reports through email and ‘other online platforms, including submissions of digital copies of supporting documents. Approvals may likewise be issued via email or other online platforms, provided adequate security measures are in place. Further, it s suggested that these transactions be subjected to post-audits when able. Thus, the Heads of Agencies are likewise encouraged to exercise their discretion in adopting similar practice. 3, Suspension of Notarization Requirement for Documents to be Submitted, Unless. Required by Law. Itis to be noted that when private documents required by law to be ‘entered in public records are submitted and stored in the records of government agencies, these are then converted into public documents. Hence, agencies may ‘consider accepting signed and unnotarized copies of these documents, which are converted into public documents once accepted and stored in public records. Also, ‘submission of a falsified document whether notarized or not, Is already punishable by the Revised Penal Codet. 4, Reduction of Signatories and Requirements. In accepting applications, renewals or requests, Government Agencies may process incomplete applications, subject 10 completion after a designated period or when conditions normalize. Electronic signatures or pre-signed license, clearance, permit, certification or authorization with adequate security and control mechanism may be used. In case the authorized signatory is on official business or offical leave, an alternate shall be designated as signatory. The Bureau of Customs (BOC) adopted a similar procedure, generally, for provisional goods declaration (pursuant to the Customs Modernization and Tarif Act), and more specifically applying to relief consignments."° The Food and Drug ‘Administration (FDA) also adopted the same in relation to clearance of imported medical health devices.’ Thus, the Heads of Agencies are likewise encouraged to exercise their discretion in adopting similar practice. 5, Whole-of-Government Approach. Government Agencies shall take an integrated approach to public service delivery, characterized by seamless govemment transactions, integrated policy design and implementation across several agencies, inter-operabilty of government processes, horizontal coordination, and strengthened linkages among government units. 6. Payments of Processing Fees. References: a. Memorandum from the Executive Secretary dated 16 March 2020 detailing the Enhanced Community Quarantine for the entire Luzon; b. Presidential Proclamation Number 922 dated 09 March 2020 declaring a State of National Public Health Emergency; . c. Memorandum signed by CDS dated 06 February 2020 re: 2019 Novel Corona Virus Acute Respiratory Disease (nCOV RD); d. Reiteration on the Corona Virus Disease — 2019 (COVID-19) ‘signed by Chief Health Service dated 10 March 2020; e. Department of Health (DOH) latest update re: COVID-19; and f. World Health Organization (WHO) latest update re: COVID-19. 2. In line with the above cited references and the Enhanced Community Quarantine (ECQ) for the Island of Luzon ordered by President Rodrigo Roa Duterte, all units are hereby directed to observe the following precautionary measures and directives in the delivery of frontline services: a. All Regional Directors are hereby directed to prepare a Service Continuity Plan as to the delivery of frontline services of all units (fire stations, provincial/district offices and regional offices) within their AOR. b. You are directed to ensure continuity of service such as acceptance, processing and releasing of important permits issued by the BFP (FSIC, FSEC and FSC); the conduct of fire safety inspection to scheduled validation inspections (those with compliances); and other pre-scheduled fire safety inspections (those with previously issued Inspection Order) c. Fire Safety Inspection Activities are NOT SUSPENDED however. strict precautions should be made in engaging clients such as maintaining social distancing, use of available face masks and strict observance of the universal precaution for Covid-19 such as constant hand washing with soap and the use of alcohol and disinfecting agents during and after conduct of inspection d. Considering that most LGU's will still operate basic services such as business permit processing, strict precautions should be made in the transmittal of hard/printed documents between offices. The use of drop- boxes is encouraged. @. Establishments previously scheduled for inspection but upon visitation were observed to be closed in compliance with the ECQ should be re- scheduled after the ECQ period however, pictures or proof of closure should be provided. {. Establishments with Notices to Comply (NTC) or Notice to Correct Violations (NTCV) that will lapse during the period covered by the ECQ should be given notice by the station through phone calls or email and require said establishments to transmit back proof of compliance through the same method in order to delay for the mean-time the succession of administrative courses of action. g. Fire prevention activities connected with the BFP frontline services such as Fire safety Lectures, Drills and Seminars to companies and businesses are likewise SUSPENDED until further notice. h. Precautionary measures should also be observed by Collecting Officers depositing Fire Code fees collection to AGDB, Use of official service vehicle must be observed in order to avoid commuting. 3. Other precautionary measures should also be implemented in all units such as the following. a, Observe proper distance when communicating with the public. b. Avoid close contact with people who are sick and suspected having the said disease. Properly wear approved mask during the conduct of inspection. Disinfect before/after entering a building/establishment through hand washing and/or application of sanitizer/alcohol. Avoid touching your eyes, nose and mouth all the time. Cover your mouth when you cough and sneeze. Clean and disinfect frequently touched objects and surfaces using a regular household cleaning spray or wipe. Wash your hands often with soap and water for at least 20 seconds. ‘Wear mask when dealing with customers. Apply alcohol/sanitizer as often as needed. a9 -=F One 4. Moreover, personnel who are sick shall not be issued with Inspection/Mission/Travel Orders, and shall not be allowed to conduct fire safety inspection and are hereby directed to stay home to avoid the spread of illness. 5.
