assessment in this unit.

27 April 2020

Dear Students,

The purpose of this assessment is to give you feedback on your progress in this unit. The
written answer format to a series of questions gives you the opportunity to briefly explain
how the law applies to practical problems and also to show that you understand the basic
concepts dealt with in the topics. This format is also good preparation for the final
examination.

Content covered in the assessment and the task

There will be 10 questions covering Topics 3 and 4 only (CGT and Deductions). Each
question is marked out of 4. There are no negative marks given. Total marks are therefore
40.

You will be required to write short answer responses of no more than 150 words per
question in response to each of the 10 questions. There is a +/-10% leeway for the word
allowance. If you write more than 10% above the limit, the markers will not read these
words. This is strictly enforced. There is no strict minimum, however, if you have written
substantially less than the 150 words, ensure you have answered the question completely
and thoroughly. Maximum of 150 words per question does not mean 1500 words overall.
The maximum applies separately as 150 words for each individual question. Marks will be
deducted for failing to adhere to the word limit.

The questions for Assessment 2 only cover the material studied in Topics 3 and 4 including
all the prescribed reading and review questions for this topic. As a result, the question may
require you to consider matters that were not specifically covered in lectures but are
covered in the readings for these topics.

For each question you will be required to write a brief answer. You should always cite
relevant sections and cases where appropriate. You do not have to use full citation for cases,
as long as the marker can easily identify the case to which you refer (for example; Myer,

1
Whitfords). You can abbreviate the legislation to ITAA97 or ITAA36. Please ensure that
you use section numbers when citing the legislation (for example, s 6-5 ITAA97) and
please ensure the correct citation (for example, s 6-5 (correct) and not s 6.5 (this is
incorrect)).

I will post a template/example Q and A to the CloudDeakin site which is an example for
you. This is by no means the only way to answer a question, but just provides some idea of
what to expect. When answering a question you are welcome to use the IRAC method but
this is absolutely not enforced. I suggest that typing the words ‘Issue, Rule etc’ would be a
waste of words. If IRAC structure assists you then feel free to use it. This is not a formal
requirement.

Completing the assessment and submitting

You must complete this assessment through CloudDeakin.

Hard copy or emails will not be accepted under any circumstances. Please see the important
points below for further information regarding this.

1. The questions will become available at the starting time stated above. You must submit
your quiz answers before the closing time. After the closing time there will be no
submissions accepted (no late submissions).
2. You are permitted to print the test (a printable pdf file will be provided when the
questions are released) but your answers to the test can only be submitted on-line via
CloudDeakin. Written or emailed submission will not be accepted.
3. You can submit at any time during the period that the test is open. There is a space to
type your answers, or you can copy and paste them from a word document if this is
your preference.
4. There is no time limit on how long the test can be open for (within the above dates) but
you must submit before the closing time.
5. You will be able to access the test as many times as you wish while it is open. Previous
work will be saved provided the SAVE button has been pressed as each question is
completed. The completed questions are noted on the left of the screen. Provided you
have not pressed the submit button you can change your answer to previously saved
questions. If you press the submit button then you cannot go back and change your
answers. Submitting is final. Please ensure you save your work if you are entering and
exiting the assessment on CloudDeakin.
6. After the closing time submission will not be possible. Note: all times are expressed as
AEST.
7. The test can only be submitted once. Submission is made by pressing the SUBMIT
button and once this is done the submission is final and cannot be altered.
8. It is your responsibility to check that the submission is made correctly. Computer errors
etc will not be accepted as a reason for non-submission. If you fail to submit as a
result of technical, computer issues etc – you will not be able to submit late. Please
make sure you submit early or leave enough time to account for technical or computer
issues should they arise for you.
9. You are permitted to use any resources available to answer these questions, but you are
reminded that this assessment is to provide you with feedback on your current level of
understanding. Plagiarising the work of others will not assist you in identifying any
misunderstanding or weaknesses in your knowledge and is also against University
Policy (please refer to the Unit Guide).
10. Each question is marked out of 4. There are no negative marks given. Total marks are
therefore 40.

2
Late submissions and extensions

It is very important to note that after the closing time submission will not be possible.

If you require an extension please contact me in advance to arrange a special late

submission. Extensions will only be granted for serious and exceptional circumstances
beyond your control. Computer failure and work commitments are not grounds for
extensions. In your application you must include supporting documentation. Extensions
will not be granted without supporting documentation or other evidence of the relevant
circumstances.

Release of results and feedback

The test will be marked and returned within the normal 15 working days in line with
University policy. After the test has closed I will post an expected results release date to
CloudDeakin and I will update you if this date changes. When marking is completed you
will be able to access your result and some specific feedback through CloudDeakin. I will
also upload an answer guide for each question through CloudDeakin and you can compare
your answers to this. Please make sure you have read the answer guide and specific
feedback before contacting me for further feedback. Of course, if you still have questions
about your assessment feedback you are welcome to discuss these with me.

Assessment 2 CloudDeakin discussion spaces

I have opened up a CloudDeakin admin assessment discussion board where you can ask
administration questions to me. During the time over which the test is open, staff (myself
and tutors) will not provide information or comment on questions relevant to the
assessment.

I will also open up a student assessment discussion area on CloudDeakin when the
assessment is released. This is a space where you can speak to each other about the
assessment. It is a great opportunity to bounce ideas off each other and talk about possible
approaches to the question. I encourage discussions in this forum. I encourage you to ask
questions about the assessment questions and to provide ideas and comments to each other.
Please note that I will not respond to any discussions in this forum – it is just for students.

Traditionally this assessment item has been open for a maximum of 4 days to complete. I
acknowledge that there have, or might be, disruptions as a result of the current difficulties
we face as a society, and as such, the assessment is open for 6 days to complete. The
assessment spans across the weekend to cater for those who might work during the week.
I trust this will be more than enough time to complete the task. This assessment is great
preparation for the exam, and a good opportunity to practice answering problem questions.

Best regards,

Monica Hope
