A computer consist of a physical computing unit and software that execute different data processing
scenarios for the end user. It is verily the combination of hardware and software and functionalities of
both these parts are entwine with each other. Software develops by contriving different phrases and
numerical data values in various media. Software consist of two types, the first one is system software
and the second one is application software. System software works as an interface between hardware
and user whereas application software accommodate various data processing tasks. Furthermore,
software is categorized as source code and object code. Data scientist or programmer writes program in
source code and then covert it into object code for end users. Previously, companies were in a habit to
sell out the systems (computers) with the free accommodation of software but with the superlative
market penetrability of computer science, the software itself became a commodity and now there is an
independent and more broader market spectrum for software. Open source software is one of the types
of software’s that are available in market and unquestionably it is providing more facilities for the users.
The open software provide both the source and object code to the user and this accommodation
provide assistance to the user to change the source code of the software to correct errors and bugs as
well as to add different additional functionalities for better use within the policies and agreement of
purchased license. Open source software enables user to use the software on a broader spectrum. The
difference between “FOSS” are significant to the philosophical purpose of open source, but neither
definition has any meaningful impact on a finding of commercial use. The difference between ‘’FOSS’’
and commercial software is the difference of licensing difference because in this case ‘’FOSS’’ has
broader scope and indeed it is a royalty-free distribution system in which the user can reverse the
engineering of software. Previously, authors of software had hold on the copyrights but now they have
given this hold to the Free Software Foundation. The most common open source licenses are MIT
License (MIT), the GNU General Public License (GPL) and the Apache License. There are many copyright
holding problems while dealing with the open source type software. The copyright holding problems
move towards more complexity when a commercial developer wants to release the commercial
software as open source software. The “FOSS” cannot be survived in the medium term without legal
challenge. It is necessary that open source licenses be examined, especially with regard to how they can
be brought into line with the collaborative development approach.
