PEOPLE OF THE PHILIPPINES, plaintiff-appellee vs. LYDIA RAMA,
defendant-appellant.

Facts:

The 5-year old daughter of Cristina Bungalon went disappeared while


playing near their house at Tondo, Manila. Bungalon searched for her
missing daughter and on April 1, 1986, Lydia rama was arrested and thn
there admitted to Bungalon that she sold her daughter for Php 400 and she
was in a house in Muslim Center. Bungalon went to the Muslim house and
found several other children including her mssiing daughter.

Hence, in due course Lydia Rama and her company Emelinda Renteno
werwe charged for kidnapping at the RTC Manila.

Rama interposed that the court could not convict her of the crime based on
her alleged extrajudicial confession which was made without a counsel.

Issue:

Whether or not Lydia Rama’s admission is considered extrajudicial


confession?

Held:

No,. The appeal is without merit. A reading of the decision of the court a
quo does not show that there was any extrajudicial confession on which the
conviction was predicated. While the extrajudicial confession without the
assistance of a counsel may not be admissible in evidence against him, the
recovery of the missing children in the very place indicated by the suspect
is clear evidence of his guilt

Decision is affirmed.
