From the presentation of the clerk of the case by the clerk announcing the files together with the
defendant and questioning the defendant as whether he is the Alan Lynch, procedurally, is not properly
done.

The prosecution’s presentation of his case the defendant assaulted his victim outside the three tuns
public house in High gate which as I am sure you are aware is somewhat notorious. However this case is
not one in which alcohol is the factor. It is more in the nature of mugging.

This defence objected, in that the prosecution has already made the defendant guilty of an offence
which the court had not yet found; him. Procedurally, and according to our legal system no one is find
guilty until proven guilty by the court.

Secondly, the manner in which the prosecution asked the witness name, and his place of address,
procedurally is not correct, as
