AN ACT THAT LEGALIZES EUTHANASIA AND PROVIDES LEGAL AUTHORITY


TO PEOPLE IN TERMINATING THEIR OWN LIFE UNDER LEGAL AND MEDICAL
CIRCUMSTANCES

Be it enacted by the senate and the House of Representatives of the Philippines in


Congress assembled:

EXPLANATORY NOTE

According to the 1987 Constitution of the Republic of the Philippines Article III: Bill of Rights,
you have the right to life, liberty property and equal protection of the law. It shall guarantee the
rights of the people about making legal decision and choices on their lives, under medical and
legal circumstances with sufficient diagnosis.

There are many diseases like cancer which may be accountable in terminating once life.
Likewise, people tend to rely on their family members in making such decisions (Mercy Killing
or Euthanasia).

1 Section 1: Short Title. - This Act shall be known as the “Legalization of Euthanasia Bill”

2 Section 2: Declaration of Policy. - The act allows and gives legal permission to people suffering

3 from incurable diseases to be entitled in making decision whether to undergo euthanasia or not
4 and legalizes the process of euthanasia as mandated by the government enforcing agency.

5 Section 3: Objectives. – This Act aims to achieve the following objectives:

6 (a) Legalizing of euthanasia does not encourage people to die but aims to end

7 people’s suffering.

8 (b) Legalizing of euthanasia allows dying patients to choose between life or death.

9 (c) Reducing financial and emotional burdens.

10 (d) Allows to choose individual’s freedom and rights.

11 Section 4: Definition of Key Terms. – For purposes of this Act, the following terms hereby

12 defined as follows:

13 (a) Euthanasia- act or practice of painlessly putting to death persons suffering from

14 painful and incurable disease or incapacitating physical disorder or allowing them

15 to die by withholding treatment or withdrawing artificial life- support measures.

16 (b) Medical circumstances- used in statutory language that encompasses a person’s

17 physical and mental issues and major condition.

18 Section 5: Applicability. – This Act shall be applied/implemented to:

19 (a) All areas in the Philippines

20 (b) Those persons subjected to euthanasia for being terminally ill and suffered in a

21 severe pain in the country.

22 Section 6: Implementing Agency. – The main agency is the Department of Health following the

23 proper procedure/administration of the euthanasia process.

24 Section 7: Penalties. - Any action that violates to implement the provisions of this bill shall be

25 penalized for One Hundred Thousand Pesos (Php 100,000.00) for the first violation, not more

than

26 Three Hundred Thousand Pesos (Php 300,000.00) for the second violation and Four Hundred

27 Thousand Pesos (Php 400,000.00) and six years imprisonment under legal investigation for the

28 third violation.

29 Section 8: Effectivity. - This bill shall take effect fifteen (15) days after its publication in the

30 Official Gazette or in at least two (2) newspapers of general circulation being approved.
