Republic of the Philippines s) DEPARTMENT OF LABOR AND EMPLOYMENT a, Intramuros, Manila ee aaah DEPARMENT ORDER NO. ay avons Series of 2019 E GUIDELINES ON THE IMPLEMENTATION OF THE DOLE-GOVERNMENT INTERNSHIP PROGRAM (DOLE-GIP) Pursuant to Executive Order No. 139, Series of 1993, implementing the youth work program, KABATAAN: 2000, and as provided under Republic Act No. 11260 or the FY 2019 General Appropriations Act (GAA) on Page 1024 of the GAA Item No. 3. Government Internship Program, this Department Order is hereby issued prescribing the standards and procedures for effective implementation of the DOLE-Government Internship Program (GIP). SECTION 1. OBJECTIVES a. To engage beneficiaries into public service by involving them in government programs and projects, through the various GIP partner agencies; b. To provide program beneficiaries, particularly the poor/indigent, opportunity to demonstrate their talents and skills in the field of public service with the ultimate objective of attracting the best and the brightest who want to pursue a career in government service, particularly in the fields and disciplines related to labor and employment; and c. To fast-track the implementation and monitoring of DOLE programs and projects related to employment facilitation and social protection, all of which directly contribute to the goal of inclusive growth through massive employment generation and substantial poverty reduction. SECTION 2. SCOPE AND COVERAGE This Guideline shall apply to qualified beneficiaries in areas with any of the following conditions: a. Priority areas for intervention as identified by the Joint Human Development and Poverty Reduction Cluster and NEDA-Social Development Committee; b. Implementing National Skills Registry Program (NSRP); ¢. Implementing Child Labor Prevention and Elimination Program (CLPEP) and other related initiatives; d. Hit by natural disasters, man-made calamities, or affected by armed conflict; e. Areas where government regulations that caused displacements were implemented; or f. Other areas identified by the DOLE Regional Offices where beneficiaries are entitled to the availment of the GIP provided that they meet the qualifications. Page 1 0f 6 SECTION 3. DEFINITION OF TERMS: As used herein, the following terms shall mean: b. k. DOLE - refers to the Department of Labor and Employment who shall manage and supervise the implementation of the program. GIP - refers to Government Internship Program, a component of the KABATAAN: 2000 under Executive Order or EO 139, Series of 1993, which aims to provide opportunities and engage program beneficiaries to serve the general public in government agencies/entities projects and programs at the national and local level. . Intern/Beneficiary — refers to the individual as qualified recipient of the DOLE-GIP. |. Internship — refers to the period of work experience to give beneficiaries exposure to the world of work. Minimum of three (3) months to a maximum of six (6) months. . Stipend — refers to the allowance received by the GIP beneficiaries. GIP Partner Agencies — refers to the executive, legislative, and judicial bodies at the regional and national levels, Public Employment Service Offices (PESOs), public hospitals and public schools or educational institutions, government financial institutions (GFls), government-owned and controlled corporation (GOCCs), and local government units (LGUs) within the residence or in nearby localities of the beneficiaries. |. GSIS — refers to Government Service Insurance System, a social insurance institution, who shall issue Group Insurance Accident policies for the beneficiaries. . GPAI — refers to Group Personal Accident Insurance issued by the GSIS. CLPEP - refers to Child Labor Prevention and Elimination Program which aims to remove children from child labor particularly in its worst form. Senior Citizen — refers to any resident citizen of the Philippines at least sixty (60) years old. PWD - refers to the Person with Disability. SECTION 4. QUALIFICATIONS Beneficiaries must be: b. c. Individuals aged 18-30 years old, except those as may be determined by DOLE Regional Offices based on Section 2 (d) and (e) of this Guidelines; At least a graduate of High School/Senior High, or its equivalent level under the Alternative Learning System, or technical-vocational graduate; and Without work experience except those identified under Section 2 (d) and (e) of this D.O. SECTION 5. REQUIREMENTS Applicants must submit any of the following whichever is applicable: a. Transcript of Records (TOR); or b. Form 137/Form 138; or ¢. Diploma or Certificate of Graduation; or Page 2 of 6 d. Certification from the school/institution or any document/proof equivalent to this effect. For beneficiaries under Section 2 (d) and (@), a certification from the Barangay that the applicant is a resident of the areas mentioned shall be submitted. SECTION 6. PRIORITY FOR INDIGENTS Applicants who submitted a Certificate of Indigency shall be prioritized to avail the program. SECTION 7. DUTIES AND FUNCTIONS The following duties and functions may be required to be performed by GIP beneficiaries: a. Assist the DOLE and its partner agencies personnel/staff; b. Assist in the encoding of registrants in the PESO Employment Information System (PEIS); ¢. Assist in profiling child laborer/s, persons with disability (PWD) and senior citizen in concerned barangays; moo |. Assist public school/hospital personnel/staff; . Assist LGU personnel/staff; and Perform duties that are not highly-technical in nature assigned by the government agencies or GIP partners. SECTION 8. PROGRAM IMPLEMENTATION AND MANAGEMENT ‘A. Provide technical support and issuance of advisory services to the DOLE Regional Offices to ensure effective implementation of the program; . Provide technical support to other participating government agencies/ entities as needed; . Evaluate and review the proposals submitted by the DOLE ROs prior to submission to DOLE CO; . Develop, establish, and maintain a database of DOLE-GIP beneficiaries; . Monitor progress of implementation of DOLE-GIP at the regional level and submit accomplishment and assessment reports; and . Provide pro-forma forms and templates for the implementation and monitoring of the DOLE-GIP (attached as Annex), as follows: a) Application Form — Form A b) Memorandum of Understanding — Form B ¢) Internship Agreement — Form C 4d) Template for Intern's Identification Card/ID measuring 8.5x12cm with 2x2 photo — Form D @) Certificate of Completion — Form E f)_List of GIP Beneficiaries — Form F 9) Monitoring Forms — Form G h) List of Absorbed Beneficiaries — Form H Page 3 of 6 i) GIP Feedback Form — Form | B. The Regional Offices shall: 1. 2. Facilitate and supervise the implementation of the Program at the regional/provincial level; Shall assist/coordinate with the proponent partner agencies on the submission of requirements such as profiled list of beneficiaries, work program, and project proposal and review the same prior to endorsement to the BLE for endorsement to the DOLE Central Office (DOLE CO); . Execute with requesting and receiving partner agencies, and/or instrumentalities, including public schools or institutions, a Memorandum of Understanding in the implementation of the DOLE-GI Facilitate the enrollment of beneficiaries to GSIS-GPAI; . Assign the interns to perform functions in DOLE and other partner agencies/entities where the DOLE has effected an MOU, as enumerated under Section 7 of this D.O.; . Issue identification cards to the interns for purposes of accounting them as program beneficiaries and, for purposes of claiming their allowancesistipend. The ID shall have a unique code starting from the year of implementation and the region where the intern is or will be assigned (e.g. 19NCR00001). This identification card may be separate from the ID to be issued by the GIP Partner Agencies; . Determine, process, and facilitate the payment of the stipend equivalent to the highest prevailing minimum wage in the Region where the interns are assigned. The DOLE-ROs may adopt the payroll system, or any other form or mode of payment for the intern’s stipend/allowance as they deem efficient and effective; . Facilitate through the LGU Public Employment Service Offices (PESOs), educational institutions based on Job Placement Office (JPO), and Network of Career Guidance Counselors and Advocates the engagement of the interns in government agencies, particularly in convergent programs run by government agencies (ie., HELPME, CLPEP, SPES, NSRP); . Explore, recommend and forge agreement with financial institution (e.g. Landbank, Lhuillier, LBC and similar institutions), as far as practicable, to facilitate the payment of stipend/allowance of the intern; 10.Submit the prescribed GIP Monitoring Forms and the List of GIP beneficiaries on a quarterly basis to the Bureau of Local Employment and post the same in their respective websites. The list of beneficiaries shall be regularly updated and made accessible to the public. No other information except the names of the beneficiaries shall be posted in the DOLE-ROs website in compliance with Republic Act 10173 or the Data Privacy Act of 2012; and 11.Issue a Certificate of Completion to the intern upon fulfillment of the Agreement. Page 4 0f 6 SECTION 9. DURATION OF ENGAGEMENT, PAYMENT OF ALLOWANCE, AND GSIS PREMIUM a. The Internship Agreement shall be for a minimum of three (3) months to a maximum of six (6) months computed from the date that the Intern reported for work in his/her office of assignment. Provided that: 1. Former GIP beneficiaries may be re-admitted for a minimum of three (3) months to a maximum of six (6) months upon recommendation of the partner agencies, whether local or national; Provided further, that they will be designated to perform tasks that would enable them to acquire additional competencies that would merit a potential position, whether contractual, casual or permanent in the government service; and 2. That such recommendation contains: (a) Performance rating or evaluation of the intern; (b) Needed skills of the intern for enhancement; and (c) the Intent to hire or absorb the GIP as a contractual, temporary or regular employee, subject to the willingness of the intern and applicable Civil Service Rules and Regulations. b. For purposes of computation, each month shall be equivalent to twenty two (22) work days exclusive of special non-working holidays. In case there are non-working holidays within the duration of the GIP agreement, the period may extend beyond the end date to utilize the allocated budget for twenty two (22) work days a month. Policies on compensatory time off (CTO) shall not be applied to GIP. However, overtime services rendered and accumulated for eight (8) hours shall be computed as one (1) working day. The same shall be applied to the services rendered during holidays which shall form part of the three (3) or six (6) months period of engagement; c. Existing minimum wage shall be construed and understood as the highest or maximum of the regional minimum wage rates; d. The Intern shall also be entitled to an insurance coverage of not less than P50,000 but not more than P100,000.00, based on the premium agreed by the DOLE and the GSIS. The insurance premium shall not be deducted from the beneficiary's allowance but from the general supplemental budget for DOLE-GIP; and e. In case where the intern voluntarily terminated the Internship Agreement prior to the expiration of the Agreement, the DOLE RO may provide another intern as a substitute who shall cover only the unexpired term of the Agreement. SECTION 10. SPECIAL PROVISIONS: INTERNS FOR DOLE CENTRAL OFFICE a. The Human Resource Development Service (DOLE-HRDS) shall facilitate and process the recruitment of applicants for the DOLE Bureaus and Services; and Page § of 6 b, The DOLE-HRDS shall prepare and submit report to the DOLE-BLE which includes the list of Interns hired, office of assignment, and their tentative date of report to work, including beneficiaries absorbed as Permanent, Job Order, Contractual, or Project Based employees. SECTION 11. REPEALING CLAUSE All orders, rules, regulations, and other administrative issuances or provisions thereof, which are contrary to or inconsistent herewith, are hereby repealed, amended or modified accordingly. SECTION 12. EFFECTIVITY This Guidelines takes effect on the date of the effectivity of Republic Act No. 11260 or the 2019 General Appropriations Act (GAA). Manila. WHEREAS, the DOLE through RO __ and GIP Partner Agency have agreed to enter into a Memorandum of Understanding for the purpose of achieving the goals of the Government Intemship Program of the DOLE, that is, to provide opportunities and engage program beneficiaries to serve the general public in goverment agencies/entiies’ at the national and local level; WHEREAS, the DOLE through RO ___, as the implementor of the GIP undertakes to provide and assign the interns/beneficiaries to the GIP Partner Agency to perform tasks and duties within those prescribed under Department Order No.__, Series of 2019; NOW, THEREFORE, this Memorandum of Understanding is executed to set forth the duties and responsibilities of the parties hereto, including the terms and conditions of the MOU with respect to the implementation of the DOLE-GIP. PURPOSE: 1. To implement the DOLE-GIP in cooperation and partnership with other government agencies, and instrumentalities to promote exposure to public service. DUTIES AND RESPOSIBILITIES OF DOLE-RO: 1. Provide a number of intem/s available to handle the required tasks and duties as requested by the GIP Partner Agency; and 2. Process and pay the stipend/allowance of the intern equivalent to the highest Prevailing Regional minimum wage for the services rendered; 3. Process and pay the enrolment of the Group Personal Accident Insurance (GPA\) of the intern to the GSIS; 4, Adopt a scheme/method in processing the payment of the intem’s stipend/allowance using any mode/form most efficient and/or expeditious for the intern’s benefit; and 5. Issue and transmit the standard identification card/ID of the intem as beneficiary of the DOLE-GIP to be used in claiming their stipend/allowance. OBLIGATIONS OF GIP PARTNER AGENCIES: In addition to applicable labor rules and regulations, the GIP Partner Agency shall: 1. Ensure that the Intern will not be exposed to any hazardous undertaking/s ‘specifically provided under the Anti-Child Labor Law and other pertinent laws relevant thereto; 2. Submit to the DOLE-RO the daily time record of the intern at least two (2) days before the 15" and 30” of the month for the processing of payment of the intern's allowance; 3. Submit a report to the DOLE-RO, a complete and/or updated record of all the intems assigned in their office/department. A special report shall be submitted to the DOLE-RO, in case of intern's voluntary termination prior to the completion of the six-month intemship agreement, specifically stating the reasons for such termination. Confidentiality: The Intern must maintain confidentiality, when and where appropriate, during and after the internship, of all the data and information where ‘such information is not already within the public domain and is indicated or understood to be confidential.
